{"id":83281,"date":"2016-11-03T17:32:15","date_gmt":"2016-11-03T12:02:15","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=83281"},"modified":"2016-11-26T22:25:33","modified_gmt":"2016-11-26T16:55:33","slug":"the-real-estate-regulation-and-development-removal-of-difficulties-order-2016-notified","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2016\/11\/03\/the-real-estate-regulation-and-development-removal-of-difficulties-order-2016-notified\/","title":{"rendered":"The Real Estate (Regulation and Development) Removal of Difficulties Order, 2016, notified"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>S.O. 3347(E).\u2013\u2013<\/strong>Whereas, certain sections of the Real Estate (Regulation and Development) Act,\u00a02016 (16 of 2016) (hereinafter referred to as the Act) came into force with effect from the 1st day of May,\u00a02016;<br \/>\nAnd whereas, sub-section (1) of Section 4 of the Act provides that every promoter shall make an\u00a0application to the Real Estate Regulatory Authority (hereinafter referred to as the Authority) for registration of\u00a0the real estate project in such form, manner, within such time and accompanied by such fees as may be\u00a0specified by the regulations made by the Authority;<br \/>\nAnd whereas, Section 6 of the Act provides that the registration granted under Section 5 may be\u00a0extended by the Authority on an application made by the promoter due to force majeure, in such form and on\u00a0payment of such fee as may be specified by the regulations made by the Authority;<br \/>\nAnd whereas, sub-section (2) of Section 31 of the Act provides that the form, manner and fees for\u00a0filing complaint under sub-section (1) of said section shall be such as may be specified by the regulations\u00a0made by the Authority;<br \/>\nAnd whereas, matters regarding form, manner, time and required fees and documents for registration\u00a0of real estate agents under sub-section (2) of Section 9, manner and fees for renewal of registration of real\u00a0estate agents under sub-section (6) of Section 9 and the form and fees for filing appeal with the Real Estate\u00a0Appellate Tribunal under sub-section (2) of Section 44 of the Act are to be provided by rules made by the\u00a0appropriate Government;<br \/>\nAnd whereas, there appears to be inconsistency in the said provisions as the Authority has been\u00a0empowered to make regulations in respect of matters specified in the aforesaid sections, while the appropriate\u00a0Government is empowered to make rules in respect of matters provided in Sections 9 and 44, making it\u00a0difficult to implement certain provisions of the Act;<br \/>\nAnd whereas, proviso to sub-section (2) of Section 17 of the Act provides that \u201cin the absence of any\u00a0local law, the promoter shall hand over the necessary documents and plans, including common areas, to the\u00a0association of the allottees or the competent authority, as the case may be, within thirty days after obtaining\u00a0the occupancy certificate\u201d. However, common areas can only be handed over to the association of the\u00a0allottees or the competent authority upon issuance of the completion certificate instead of occupancy\u00a0certificate;<br \/>\nAnd whereas, in order to avoid the said ambiguity mentioned in the preceding paragraph, it is\u00a0considered necessary to amend the proviso to sub-section (2) of said Section 17;<br \/>\nNow, therefore, in exercise of the powers conferred by sub-section (1) of Section 91 of the Real Estate\u00a0(Regulation and Development) Act, 2016 (16 of 2016), the Central Government hereby makes the following\u00a0Order to remove the aforesaid difficulties, namely:\u2013\u2013<\/p>\n<table>\n<tbody>\n<tr>\n<td style=\"text-align: justify;\" width=\"26\"><\/td>\n<td style=\"text-align: justify;\" width=\"472\">1. (1) This Order may be called the Real Estate (Regulation and Development) Removal of Difficulties Order, 2016.<\/p>\n<p>(2) It shall come into force on the date of its publication in the Official Gazette.<\/td>\n<td style=\"text-align: justify;\" width=\"118\">Short title and commencement.<\/td>\n<\/tr>\n<tr style=\"text-align: justify;\">\n<td width=\"26\"><\/td>\n<td width=\"472\">2. In the Real Estate (Regulation and Development) Act, 2016,\u2013\u2013<\/p>\n<p>(i) in Section 4, in sub-section (1), for the words \u201cspecified by the regulations made by the Authority\u201d, the word \u201cprescribed\u201d shall be substituted;<\/p>\n<p>(ii) in Section 6, for the words \u201cspecified by regulations made by the Authority\u201d, the word \u201cprescribed\u201d shall be substituted;<\/p>\n<p>(iii) in Section 17, in sub-section (2), in the proviso, for the word \u201coccupancy\u201d, the word \u201ccompletion\u201d shall be substituted;<\/p>\n<p>(iv) in Section 31, in sub-section (2), for the words \u201cspecified by regulations\u201d, the word \u201cprescribed\u201d shall be substituted;<\/p>\n<p>(v) in Section 84, in sub-section (2),\u2013\u2013<\/p>\n<p style=\"padding-left: 30px;\">\u00a0(A) for clause (a), the following clauses shall be substituted, namely:\u2013\u2013<\/p>\n<p style=\"padding-left: 60px;\">\u201c(a) the form, time and manner of making application and fees payable therewith under sub-section (1) of Section 4;<\/p>\n<p style=\"padding-left: 60px;\">(ab) information and documents for application to the Authority for registration under clause (m) of sub-section (2) of Section 4;<\/p>\n<p style=\"padding-left: 60px;\">(ac) the form of application and the fees for extension of registration under Section 6;\u201d;<\/p>\n<p style=\"padding-left: 30px;\">(B) after clause (o), the following clause shall be inserted, namely:\u2013\u2013<\/p>\n<p style=\"padding-left: 60px;\">\u201c(oa) the form, manner and fees for filing of a complaint under sub-section (2) of Section 31;\u201d;<\/p>\n<p>(vi) in Section 85, in sub-section (2), clauses (a), (b) and (g) shall be omitted.<\/td>\n<td width=\"118\">Amendments in certain sections of Act<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"text-align: right;\">[F.
