{"id":78761,"date":"2016-10-17T12:15:02","date_gmt":"2016-10-17T06:45:02","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=78761"},"modified":"2016-11-29T18:47:43","modified_gmt":"2016-11-29T13:17:43","slug":"the-food-safety-and-standards-food-products-standards-and-food-additives-amendment-regulations-2016-notified","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2016\/10\/17\/the-food-safety-and-standards-food-products-standards-and-food-additives-amendment-regulations-2016-notified\/","title":{"rendered":"Draft of Food Safety and Standards (Food Products Standards and Food Additives) Amendment Regulations, 2016, notified"},"content":{"rendered":"<p style=\"text-align: right;\">New Delhi, the 10th October, 2016<\/p>\n<p style=\"text-align: justify;\"><strong>No. Stds\/SP(Water &amp; Beverages)\/Notif (1)\/FSSAI-2016.\u2014<\/strong>The following draft of certain regulations, further to amend the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, which the Food Safety and Standards Authority of India proposes to make with previous approval of the Central Government, in exercise of the powers conferred by clause (e) of sub-section (2) of Section 92 read with Section 16 of the Food Safety and Standards Act, 2006 (34 of 2006), is hereby published as required by sub-section (1) of Section 92 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft regulations will be taken into consideration after the expiry of the period of thirty days from the date on which copies of the Official Gazette in which this notification is published are made available to the public.<br \/>\nObjections or suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, Food and Drug Administration Bhawan, Kotla Road, New Delhi- 110002 or,\u00a0 may be sent at regulation@fssai.gov.in;<br \/>\nObjections or suggestions, which may be received from any person with respect to the said draft regulations before the expiry of period so specified, shall be considered by the Food Authority.<\/p>\n<p style=\"text-align: center;\"><strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/strong><strong> Draft Regulations<\/strong><\/p>\n<p style=\"text-align: justify;\">3.<strong> Short title and commencement.\u2014\u00a0<\/strong>(1) These regulations may be called the Food Safety and Standards (Food Products Standards and Food Additives) \u2026\u2026\u2026\u2026 Amendment Regulations, 2016.<br \/>\n(2) They shall come into force on the date of their final publication in the Official Gazette.<\/p>\n<p style=\"text-align: justify;\">4. In the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011,-<\/p>\n<p style=\"padding-left: 30px; text-align: justify;\">(a) in Regulation 2.10 relating to \u201cBEVERAGES, (Other than Dairy and Fruits &amp; Vegetables based)\u201d, in sub-regulation 2.10.6 after clause 2 relating to caffeinated beverages, the following shall be inserted namely: &#8211;<\/p>\n<p style=\"padding-left: 60px; text-align: justify;\">\u20183. \u201c<strong>Non-carbonated Water Based Beverages (Non-Alcoholic)<\/strong>\u201d means beverages containing water conforming to the standards prescribed for packaged drinking water under these regulations without added carbon dioxide and may contain any of the following, singly or in combination:<br \/>\n(i)\u00a0 sugar, liquid glucose, dextrose monohydrate, invert sugar, fructose, honey, fruits and vegetables extractives, herbs, spices and their derivatives and permitted flavouring;<br \/>\n(ii)\u00a0 added herbs shall comply with safety requirements as specified in the Act and the Regulations made thereunder and shall also be declared on the label;<br \/>\n(iii)\u00a0 only the food additives in accordance with the provisions of these Regulations shall be used;<br \/>\n(iv)\u00a0 the products covered in this standard shall comply with the microbiological requirements given in Appendix B of these Regulations;<br \/>\n(v)\u00a0 the products shall comply with the packaging and labelling requirements as laid down under the Food Safety and Standards (Packaging and Labelling) Regulations, 2011.<\/p>\n<p style=\"text-align: justify;\"><strong>Note:<\/strong><br \/>\n3. Data of toxicological analysis to be provided for its approval for the Herbs when added in the beverages.<br \/>\n4. Shall not include any psychotropic substance as defined in the Schedule to the Narcotic Drugs and Psychotropic Substances Act, 1985 (61 of 1985) and the Rules made thereunder, and substances listed in Schedules E and E1 of the Drugs and Cosmetics Rules, 1945.\u2019;<br \/>\n(b) in APPENDIX B relating to \u201cMicrobiological Requirements\u201d, after Table 7, the following shall be inserted, namely: &#8211;<\/p>\n<p style=\"text-align: left;\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0\u201cTABLE 8<\/p>\n<p style=\"text-align: left;\">Microbiological Requirements for Non-Carbonated Water Based\u00a0 Beverages (Non Alcoholic)<\/p>\n<p>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0<strong> \u00a0 Sl.
