{"id":7254,"date":"2015-07-27T17:07:00","date_gmt":"2015-07-27T17:07:00","guid":{"rendered":"http:\/\/localhost\/sccblog\/?p=7254"},"modified":"2015-11-03T11:11:18","modified_gmt":"2015-11-03T05:41:18","slug":"guidelines-issued-by-the-goi-for-allowing-visitor-s-into-jail","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2015\/07\/27\/guidelines-issued-by-the-goi-for-allowing-visitor-s-into-jail\/","title":{"rendered":"Guidelines issued by the Government for allowing visitor(s) into Jail"},"content":{"rendered":"<p><span lang=\"EN-US\">On 24.07.2015, the Government of India issued guidelines for all the States\/ Union Territories for allowing any private individual\/ Press\/ NGO\/ Company, whether Indian or foreigner, into jail for the purpose of making documentaries, writing articles, interviewing inmates or any other similar research activity.<\/span><\/p>\n<p><span lang=\"EN-US\">The Government of the State\/ Union Territory may allow entry of visitors\/ press\/ documentary makers into the prison only on the satisfaction that the documentary\/ article\/ research will serve the purpose of creating positive social impact, or relates to prison reforms, or the Government itself decides to invite press\/ filmmakers to cover a particular event.<\/span><\/p>\n<p><b><span lang=\"EN-US\">Measures to be taken for granting permission are as follows:<\/span><\/b><\/p>\n<ul type=\"disc\">\n<li><span lang=\"EN-US\">The visitor(s) has to submit an application to the Jail Superintendent (atleast 30 days before the date of visit). In case of foreigners (atleast 60 days before the date of visit). And, in case of article by print media (atleast 7 days before the date of visit).<\/span><\/li>\n<li><span lang=\"EN-US\">The Jail Superintendent should immediately send the same to the Home\/Prison Department of the State\/ Union Territory (which is the competent authority to grant such permission) along with his comments.<\/span><\/li>\n<li><span lang=\"EN-US\">While granting such permissions, various guidelines of the Supreme Court (<i>Smt. Prabha Dutt v. UOI and others<\/i> (1982) 1 SCC 1, <i>Sheela Barse v. State of Maharashtra<\/i> 1988(1); Bom CR 58, etc.) has to be kept in mind.\u00a0<\/span><\/li>\n<li><span lang=\"EN-US\">The Jail Superintendent, after receiving the permission from the Home\/Prison Department of the State\/ Union Territory may allow such visitor(s) to see the prisoner in the visitor area. Provided, the visitor(s) has to sign an undertaking as well as submit a Security Deposit of Rs.1 lakh by way of a Demand Draft\/local Bankers Cheque in the name of the Jail Superintendent of the concerned jail.\u00a0<\/span><\/li>\n<li><span lang=\"EN-US\">Visitors <\/span><span lang=\"EN-US\">may be allowed only Handycam\/Camera\/Tape recorder or equipments directly connected with the purpose of the visit. Tripod\/stand mounted cameras\/equipments should not be allowed.\u00a0 No mobile phones\/papers\/ book\/pen etc. should be allowed.<\/span><\/li>\n<li><span lang=\"EN-US\">The Jail Superintendent (or the next senior most officer) should himself be present\u00a0while the visitor(s) are touring the prison or interviewing the inmates.<\/span><\/li>\n<li><span lang=\"EN-US\">No videography\/ photography should be allowed which may create potential security risk or social\/communal disturbance.<\/span><\/li>\n<li><span lang=\"EN-US\">The visitor(s) has to handover all their equipments like Handycams, Dictaphone, Camera, tape recorder\u00a0 or any other equipment to the Jail Superintendent for a period of three days after the completion of his visit.<\/span><\/li>\n<li><span lang=\"EN-US\">The Jail Superintendent is empowered to delete any portion of the recording which he feels is objectionable. After careful scrutiny\/editing of the said recording, the equipment shall be returned to the visitor.<\/span><\/li>\n<\/ul>\n<ul type=\"disc\">\n<li><span lang=\"EN-US\">The visitor(s) has to seek a \u201cNo objection certificate\u201d from the State Government\/Union Territory Administration\/Head of Prison Department for publication\/ release of the said film\/ research paper\/ articles\/ books.<\/span><\/li>\n<li><span lang=\"EN-US\">In case of any violation of these guidelines, or the undertaking given by the visitor(s), the Jail Superintendent is empowered to forfeit the security deposit and initiate suitable legal action against the said visitor(s).<\/span><\/li>\n<\/ul>\n<p><b><span lang=\"EN-US\">Undertaking to be submitted by the Visitor(s) to the <\/span><span lang=\"EN-US\">Jail\u00a0Superintendent:<\/span><\/b><\/p>\n<p><span lang=\"EN-US\">The visitor shall:<\/span><\/p>\n<ul type=\"disc\">\n<li><span lang=\"EN-US\">Carry\u00a0 only\u00a0 one\u00a0 recording\u00a0 device\u00a0 as\u00a0 permitted\u00a0 by\u00a0 the\u00a0 Jail\u00a0 Superintendent.\u00a0 <\/span><\/li>\n<li><span lang=\"EN-US\">Not\u00a0carry\u00a0any\u00a0hidden\u00a0recording\u00a0devices\u00a0while\u00a0visiting\u00a0the\u00a0jail.\u00a0<\/span><\/li>\n<li><span lang=\"EN-US\">Follow\u00a0the\u00a0journalistic\u00a0conduct\u00a0as\u00a0prescribed\u00a0by\u00a0the\u00a0Press\u00a0Council\u00a0of\u00a0India while writing the\u00a0news\u00a0article\/magazine. <\/span><\/li>\n<li><span lang=\"EN-US\">Publish only the vetted and approved material of the research paper\/ documentary\/ film\/ article\/ book after obtaining the \u2018No Objection Certificate\u2019 from State Government\/ Union Territory Administration\/ Head of prison Department.<\/span><\/li>\n<li><span lang=\"EN-US\">Release\u00a0 the\u00a0 film\/\u00a0 documentary\u00a0 only\u00a0 after\u00a0 clearance\u00a0 from\u00a0 the\u00a0 Jail\u00a0 Superintendent\u00a0 is\u00a0 received.\u00a0 <\/span><\/li>\n<li><span lang=\"EN-US\">Handover all the equipments (Handy cams\/ Cameras\/ tape recorders\/ Dictaphone etc.) to the Jail Superintendent after completion of the visit and collect them after 3 days.\u00a0 <\/span><\/li>\n<li><span lang=\"EN-US\">Not\u00a0 release\u00a0 the\u00a0 documentary\/\u00a0 articles\/\u00a0 papers\/\u00a0 books\u00a0 or\u00a0 any\u00a0 content\u00a0 thereof\u00a0 to\u00a0 the\u00a0 media\/\u00a0 social\u00a0 media\u00a0which\u00a0is\u00a0different\u00a0 than\u00a0 the\u00a0vetted\u00a0material.<\/span><\/li>\n<li><span lang=\"EN-US\">Immediately\u00a0 withdraw\u00a0 from\u00a0 circulation\u00a0 the\u00a0 documentary\/\u00a0 article\/\u00a0 paper\/\u00a0 book\u00a0 or\u00a0 any\u00a0 content\u00a0 thereof,\u00a0 if\u00a0 called\u00a0 upon\u00a0to\u00a0do\u00a0so\u00a0by\u00a0the\u00a0authorized\u00a0officer\u00a0of\u00a0the\u00a0State\u00a0Government\/Union Territory.\u00a0<\/span><\/li>\n<li><span lang=\"EN-US\">Enclose a\u00a0 Demand\u00a0 Draft\/\u00a0 Bankers\u00a0 Cheque\u00a0 of\u00a0 Rs.1\u00a0 lakh\u00a0 and\u00a0 undertake\u00a0 that\u00a0if there of violation of any\u00a0 guidelines\/\u00a0instructions\u00a0 of\u00a0 the\u00a0 Authorities,\u00a0 the\u00a0 same\u00a0may\u00a0be\u00a0forfeited.\u00a0<\/span><\/li>\n<\/ul>\n<p><b><span lang=\"EN-US\">\u00a0<\/span><\/b><\/p>\n<p align=\"right\"><b><span
