{"id":71531,"date":"2016-09-19T18:20:36","date_gmt":"2016-09-19T12:50:36","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=71531"},"modified":"2016-09-19T18:20:36","modified_gmt":"2016-09-19T12:50:36","slug":"draft-of-insurance-ombudsman-rules-2016-notified","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2016\/09\/19\/draft-of-insurance-ombudsman-rules-2016-notified\/","title":{"rendered":"Draft of Insurance Ombudsman Rules, 2016 notified"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>NOTIFICATION<\/strong><br \/>\nNew Delhi, the 15th September, 2016<\/p>\n<p style=\"text-align: justify;\"><strong>G.S.R. 886(E).\u2014<\/strong>The following draft of certain rules which the Central Government proposes to\u00a0make, in exercise of powers conferred by section 24 of the Insurance Regulatory and Development Authority\u00a0Act, 1999(41 of 1999) and in supersession of the Redressal of Public Grievances Rules, 1998, except as\u00a0respects things done or omitted to be done before such supersession, is hereby published for the information\u00a0of all persons likely to be affected thereby, and notice is hereby given that the said draft rules will be taken\u00a0into consideration after the expiry of a period of forty-five days from the date on which the copies of the\u00a0Gazette of India in which the notification is published are made available to the public;<br \/>\nAny objections or suggestions which may be received from any person with respect to the said draft\u00a0rules within the period specified above will be considered by the Central Government;<\/p>\n<p style=\"text-align: justify;\">Objections or suggestions, if any, may be addressed to the Secretary, Ministry of Finance, Department\u00a0of Financial Services, Third Floor, Jeevan Deep Building, Parliament Street, New Delhi-110001.<\/p>\n<p style=\"text-align: center;\"><strong>Draft Rules<\/strong><\/p>\n<p><strong>1. Short title and commencement.\u2014<\/strong>(1) These rules may be called the Insurance Ombudsman Rules,\u00a02016.<br \/>\n(2) They shall come into force from the date of their final publication in the Official Gazette.<br \/>\n<strong>2. Application.\u2014<\/strong>These rules shall apply to all insurers and their representatives in respect of complaints\u00a0of all personal lines of insurance, group insurance policies, policies issued to sole proprietorship and\u00a0micro enterprises.<\/p>\n<p style=\"text-align: justify;\"><strong>3. Definitions.\u2014<\/strong>(1) In these rules, unless the context otherwise requires,\u2014<br \/>\n(a) \u201caward\u201d means an award passed by the Insurance Ombudsman under Rule 16;<br \/>\n(b) \u201cfinancial year\u201d means a period of twelve months commencing on the 1st day of April and ending\u00a0on the 31st day of March;<br \/>\n(c) \u201cInsurance Council\u201d means the Life Insurance Council and the General Insurance Council\u00a0constituted under section 64 C of the Insurance Act, 1938 (4 of 1938);<br \/>\n(d) \u201cExecutive Council\u201d means the Executive Council constituted under rule 4;<br \/>\n(e) \u201cInsurance Ombudsman\u201d means the Insurance Ombudsman established under rule 6;<br \/>\n(f) \u201cIRDAI\u201d means the Insurance Regulatory and Development Authority of India established under\u00a0section 3 of the Insurance Regulatory and Development Authority Act, 1999;<br \/>\n(g) \u201cOmbudsman\u201d means a person appointed as an Insurance Ombudsman under these rules;<br \/>\n(h) \u201cpersonal lines\u201d means an insurance policy taken or given in an individual capacity;<br \/>\n(i) \u201cGroup insurance\u201d means insurance cover obtained by a group of individuals, either through an\u00a0employer or otherwise, under a single contract;<br \/>\n(j) \u201csole proprietorship\u201d means a business that legally has no separate existence from its owner and\u00a0the income and losses are taxed on the individual&#8217;s personal income tax return;<br \/>\n(k) \u2018\u2019micro enterprise\u2019\u2019 means the micro enterprises as defined in clause (h) of section 2 of the Micro,\u00a0Small and Medium Enterprises Development Act, 2006 (27 0f 2006).<br \/>\n(2) All other words and expressions used in these rules but not defined shall have the meanings\u00a0respectively assigned to them in the Insurance Act, 1938 and the Insurance Regulatory and\u00a0Development Authority Act, 1999.<\/p>\n<p style=\"text-align: justify;\"><strong>4. Executive Council.\u2014\u00a0<\/strong>(1) There shall be an Executive Council consisting of nine members including the Chairperson.<br \/>\n(2) The members of the Executive Council shall comprise of\u2014<br \/>\n(i) two persons representing life insurers to be nominated by the Life Insurance Council ;<br \/>\n(ii) two persons representing non-life insurers other than stand-alone health insurers to be\u00a0nominated by the General Insurance Council;<br \/>\n(iii) one person representing stand-alone health insurers to be nominated by the General\u00a0Insurance Council;<br \/>\n(iv) one representative of the IRDAI; and<br \/>\n(v) one representative of the Central Government in the Ministry of Finance from the\u00a0Department of Financial Services not below the rank of Director;<br \/>\n(vi) the Chairman, Life Insurance Corporation of India (LIC of India) established under the\u00a0Life Insurance Corporation Act, 1956 (31 of 1956) or the Chairman, General Insurers\u2019\u00a0(Public Sector) Association of India (GIPSA) established under the General Insurance\u00a0Business (Nationalisation) Act, 1972 (57 of 1972) provided they are not acting as\u00a0Chairman of the Executive Council.<br \/>\n(3) The Chairperson of the Executive Council shall be either the Chairman of the LIC of India or\u00a0the Chairman of the GIPSA by rotation.<br \/>\n(4) The term of the Chairperson and members of the Executive Council shall be three years from\u00a0the date of assumption of charge.<br \/>\n(5) The nominations to the Executive Council shall be revised every three years or as and when the\u00a0vacancy arises, whichever is earlier.<br \/>\n(6) A member of the Executive Council shall not be eligible for re-nomination for a period of three\u00a0years from the date he ceases to be a member:<br \/>\nProvided that this sub-rule shall not apply to the Chairperson or to the members nominated under\u00a0clause (iv) and clause (v) of sub-rule (2).<\/p>\n<p style=\"text-align: justify;\"><strong>5. Functions of the Executive Council. \u2014\u00a0<\/strong>(1) The Executive Council shall, with the prior approval of the IRDAI, issue such guidelines,\u00a0including, inter-alia, relating to the procedure for the day to day administration, secretariat staffing,\u00a0secretariat administrative infrastructure, and such other related aspect of its functioning.<br \/>\n(2) The Executive Council may constitute such committees and\/or obtain the assistance of outside\u00a0expertise as deemed necessary for preparing the guidelines referred to in sub-rule (1).<\/p>\n<p style=\"text-align: justify;\"><strong>6. Insurance Ombudsman. \u2014\u00a0<\/strong>(1) There shall be established such number of Insurance Ombudsman for such territorial jurisdiction\u00a0as the Executive Council may specify, for receiving complaints and for the settlement of claims of the\u00a0policy holders under these rules.<br \/>\n(2) An Ombudsman shall be selected from amongst persons having experience of the industry, civil\u00a0service, administrative service or judicial service.<br \/>\n(3) An Ombudsman shall be selected by a Selection Committee comprising of\u2014<br \/>\n(a) Chairperson of the IRDAI, who shall be the Chairperson of the Selection Committee;<br \/>\n(b) one representative each of the Life Insurance Council and the General Insurance Council from the\u00a0Executive Council &#8211; members<br \/>\n(c) A representative of the Government of India not below the rank of Joint Secretary or equivalent in\u00a0the Ministry of Finance from the Department of Financial Services\u2014member.<br \/>\n(4) The Executive Council shall prepare a panel through an open process by inviting applications\u00a0from amongst the eligible candidates and the selection process shall be in accordance with the\u00a0selection criteria finalised by the Central Government in the Ministry of Finance.<br \/>\n(5) An Ombudsman shall be appointed after satisfactory vigilance clearance and medical fitness\u00a0report from an authorised doctor.<\/p>\n<p style=\"text-align: justify;\"><strong>7. Term of office of Insurance Ombudsman. \u2014\u00a0<\/strong>An Ombudsman shall be appointed for a term of three years and shall be eligible for re-appointment:<br \/>\nProvided that no person shall hold office as an Ombudsman after he has attained the age of sixtyfive\u00a0years in case of appointment for the first-time and seventy years in case of re-appointment.<\/p>\n<p style=\"text-align: justify;\"><strong>8. Removal from office of Insurance Ombudsman. \u2014\u00a0<\/strong>An Ombudsman may be removed from office on the ground of gross misconduct during his term of\u00a0office, after following due procedure specified as under, namely:-<br \/>\n(a) The Executive Council shall draw up articles of charge or charges if any, on the Ombudsman after\u00a0giving him a reasonable opportunity of being heard;<\/p>\n<p style=\"text-align: justify;\">(b) The Executive Council shall, as and when deemed necessary, appoint such person or persons to\u00a0inquire into the allegations levelled against the Insurance Ombudsman;<br \/>\n(c) Upon conclusion of the inquiry, the Executive Council or the person nominated by it shall forward\u00a0the inquiry report to the concerned Ombudsman who shall submit his comments or submissions\u00a0within a specified time;<br \/>\n(d) Upon receipt of the comments or submissions or after the expiry of the stipulated period, the\u00a0Chairman of the Executive Council shall forward the inquiry report, the submissions of the concerned\u00a0Insurance Ombudsman along with the recommendations of the Executive Council to the IRDAI;<br \/>\n(e) The IRDAI shall decide upon the action to be taken, if any, against the concerned Insurance\u00a0Ombudsman and shall communicate such decision to the Executive Council who shall implement the\u00a0decision of the IRDAI.<br \/>\n(f) The IRDAI may, wherever it considers necessary, initiate an inquiry suo moto against any\u00a0Insurance Ombudsman and in such case, it shall request the Executive Council to initiate the\u00a0proceedings and the Executive Council shall proceed with the inquiry in accordance with the\u00a0procedure laid down in this rule.<\/p>\n<p style=\"text-align: justify;\"><strong>9. Remuneration, etc., of Insurance Ombudsman. \u2014<\/strong>(1) The Ombudsman shall be allowed a fixed pay of eighty thousand rupees per month and any\u00a0pension to which he is entitled from the Central Government or a State Government or any other\u00a0organisation or institution shall be deducted from his salary.<br \/>\n(2) The revised pay and admissibility of other allowances and perquisites shall be such as may be\u00a0determined by the Central Government.<\/p>\n<p style=\"text-align: justify;\"><strong>10. Territorial jurisdiction of Insurance Ombudsman. \u2014\u00a0<\/strong>(1) The office of the Insurance Ombudsman shall be located at such places and shall have such\u00a0territorial jurisdiction as may be specified by the Executive Council from time to time.<br \/>\n(2) The Executive Council shall specify the territorial jurisdiction of each Ombudsman.<br \/>\n(3) The Ombudsman may hold sitting at various places within his area of jurisdiction in order to\u00a0expedite disposal of complaints.<\/p>\n<p style=\"text-align: justify;\"><strong>11. Offices of Executive Council and Insurance Ombudsman. \u2014\u00a0<\/strong>(1) The Insurance Ombudsman shall have such secretarial staff as may be determined by the\u00a0Executive Council with the prior approval of the IRDAI.<br \/>\n(2) The salary, allowances and perquisites payable to the staff of the Insurance Ombudsman\u00a0secretariat and all expenses incurred in connection with administration, including expenses to be\u00a0incurred by the Executive Council shall be borne by the Life Insurance Council and the General\u00a0insurance Council in such proportion as the Executive Council may with the prior approval of IRDAI,\u00a0by a general or special order specify, from time to time, in this behalf.<br \/>\n(3) The Insurance Ombudsman shall submit its annual budget requirements for the ensuing financial\u00a0year by the 31st January every year to the Executive Council and the Executive Council shall finalise\u00a0the budget in consultation with the Ombudsman and advise the Life Insurance Council and General\u00a0Insurance Council to allocate the funds to the respective offices of Insurance Ombudsman.<br \/>\n(4) The decision of the Executive Council on allocation of fund to an office of Insurance Ombudsman\u00a0shall be final.<\/p>\n<p style=\"text-align: justify;\"><strong>12. Duties and functions of Insurance Ombudsman. \u2014\u00a0<\/strong>(1) The Ombudsman shall receive and consider complaints\/ disputes relating to\u2014<br \/>\n(a) delay in settlement of claims, beyond the time specified under the Insurance Regulatory and\u00a0Development Authority (Protection of Policyholders\u2019 Interests) Regulations, 2002 framed under the\u00a0Insurance Regulatory and Development Authority of India Act, 1999;<br \/>\n(b) any partial or total repudiation of claims by the life insurer; non- life insurer or health insurer ;<\/p>\n<p style=\"text-align: justify;\">(c) disputes over premium paid or payable in terms of insurance policy;<br \/>\n(d) misrepresentation of policy terms and conditions at any time in the policy document or policy\u00a0contract;<br \/>\n(e) legal construction of insurance policies giving rise to the grievance;<br \/>\n(f) forgery, tampering, misrepresentation and other misconduct relating to the proposal for insurance\u00a0policy;<br \/>\n(g) policy servicing related grievances against insurers and their representatives;<br \/>\n(h) issuance of life insurance policy, general insurance policy including health insurance policy which\u00a0is not in conformity with the proposal form submitted by the proposer;<br \/>\n(i) non-issuance of insurance policy after receipt of premium in life insurance and general insurance\u00a0including health insurance; and<br \/>\n(j) any other matter resulting from the violation of provisions of the Insurance Act, 1938, regulations,\u00a0circulars, guidelines or instructions issued by the IRDAI from time to time or the terms and\u00a0conditions of the policy contract in so far as they relate to issues mentioned at clauses (a) to (g) .<br \/>\n(2) The Ombudsman shall act as counsellor and mediator relating to matters specified in sub-rule (1)\u00a0provided there is written consent of the parties to the dispute.<br \/>\n(3) The Central Government or as the case may be, the IRDAI may, at any time refer any complaint\u00a0or dispute relating to insurance matters specified in sub-rule (1), to the Insurance Ombudsman and\u00a0such complaint or dispute shall be entertained by the Insurance Ombudsman and be dealt with as if it \u00a0is a complaint made under rule 13.<\/p>\n<p style=\"text-align: justify;\"><strong>13. Manner in which complaint to be made. \u2014\u00a0<\/strong>(1) Any person who has a grievance against an insurer, may himself or through his legal heirs,\u00a0nominee or assignee, make a complaint in writing to the Insurance Ombudsman within whose\u00a0territorial jurisdiction the branch or office of the insurer complained against is located.<br \/>\n(2) The complaint shall be in writing, duly signed by the complainant or through his legal heirs,\u00a0nominee or assignee and shall state clearly the name and address of the complainant, the name of the\u00a0branch or office of the insurer against whom the complaint is made, the facts giving rise to the\u00a0complaint, supported by documents, the nature and extent of the loss caused to the complainant and\u00a0the relief sought from the Insurance Ombudsman.<br \/>\n(3) No complaint to the Insurance Ombudsman shall lie unless\u2014<br \/>\n(a) the complainant makes a written representation to the insurer named in the complaint and\u2014<br \/>\n(i) either the insurer had rejected the complaint; or<br \/>\n(ii) the complainant had not received any reply within a period of one month after the insurer received\u00a0his representation; or<br \/>\n(iii) the complainant is not satisfied with the reply given to him by the insurer;<br \/>\n(b) The complaint is made within one year\u2014<br \/>\n(i) after the order of the insurer rejecting the representation is received; or<br \/>\n(ii) after receipt of decision of the insurer which is not to the satisfaction of the complainant;<br \/>\n(iii) after expiry of a period of one month from the date of written representation if the insurer named\u00a0fails to furnish reply to the complainant .<br \/>\n(4) No complaint before the Insurance Ombudsman shall be maintainable on the same subject matter\u00a0on which proceedings are pending before any court or consumer forum or arbitrator.<\/p>\n<p style=\"text-align: justify;\"><strong>14. Insurance Ombudsman to act fairly and equitably. \u2014\u00a0<\/strong>(1) The Ombudsman may, if he deems fit, allow the complainant to adopt a procedure other than\u00a0under sub-rule (1) or sub-rule (2) of rule 13 for making a complaint, after notifying the parties to the\u00a0dispute.<br \/>\n(2) The Ombudsman shall have the power to ask the parties concerned for additional documents in\u00a0support of their respective contentions and wherever it considers it necessary, the Ombudsman may\u00a0collect factual information relating to the dispute available with the insurer and may make available\u00a0such information to the parties concerned.<br \/>\n(3) The Ombudsman may obtain the opinion of professional experts, if the disposal of a case warrants\u00a0it.<br \/>\n(4) The Ombudsman shall dispose of a complaint after giving the parties to the dispute a reasonable\u00a0opportunity of being heard.<\/p>\n<p style=\"text-align: justify;\"><strong>15. Recommendations made by the Insurance Ombudsman. \u2014\u00a0<\/strong>(1) Where a complaint is settled through mediation under sub-rule (2) of rule 12, the Ombudsman\u00a0shall make a recommendation which it thinks fair in the circumstances of the case, within one month\u00a0of the date of receipt of mutual written consent for such mediation and the copies of the\u00a0recommendation shall be sent to the complainant and the insurer concerned.<br \/>\n(2) If the recommendation of the Ombudsman is acceptable to the complainant, he shall send a\u00a0communication in writing within fifteen days of receipt of the recommendation, stating clearly that he\u00a0accepts the settlement as full and final.<br \/>\n(3) The Ombudsman shall send to the insurer, a copy of its recommendation, along with the\u00a0acceptance letter received from the complainant and the insurer shall, thereupon, comply with the\u00a0terms of the recommendation immediately but not later than fifteen days of the receipt of such\u00a0recommendation, and inform the Ombudsman of its compliance.<br \/>\n<strong>16. Award. \u2014\u00a0<\/strong>(1) Where the complaint is not settled by way of mediation under rule 15, the Ombudsman shall pass\u00a0an award, based on the pleadings and evidence brought on record.<br \/>\n(2) The award shall be in writing.<br \/>\n(3) Where the award is in favour of the complainant, it shall state the amount granted to the\u00a0complainant:<br \/>\nProvided that the Ombudsman shall not award any compensation in excess of the loss suffered by the\u00a0complainant as a direct consequence of cause of action, or for an amount not exceeding rupees thirty\u00a0lakhs (including relevant expenses, if any), whichever is less.<br \/>\n(4) The Ombudsman shall finalise its findings and pass an award within a period of three months of\u00a0the receipt of the complaint.<br \/>\n(5) A copy of the award shall be sent to the complainant and the insurer named in the complaint.<br \/>\n(6) The insurer shall comply with the award within fifteen days of the receipt of the award and\u00a0intimate compliance of the same to the Ombudsman.<br \/>\n(7) The complainant shall be entitled to such interest at a rate per annum as specified in the Insurance\u00a0Regulatory and Development Authority (Protection of Policyholders\u2019 Interest) Regulations, 2002 \u00a0framed under the Insurance Regulatory and Development Authority of India Act, 1999 from the date\u00a0the claim ought to have been settled as per the said regulations till the date of payment of the amount\u00a0awarded by the Ombudsman.<br \/>\n(8) The award of Insurance Ombudsman shall be binding on the insurers.<br \/>\n(9) In case an insurer fails to comply with the award within the time specified in sub-rule (6), the\u00a0matter shall be referred to the Executive Council for taking action as it deems appropriate.<\/p>\n<p style=\"text-align: justify;\"><strong>17. Review of activities of Insurance Ombudsman. \u2014\u00a0<\/strong>(1) The Ombudsman shall prepare an annual report detailing the activities undertaken during the\u00a0previous financial year under their jurisdiction, statement of accounts and any other relevant\u00a0information and submit to the Executive Council with a copy to the IRDAI by the 30th June every\u00a0year.<br \/>\n(2) The Executive Council shall on receipt of annual reports of all Insurance Ombudsman, furnish a\u00a0report containing a general review of the activities of Insurance Ombudsman during the preceding\u00a0financial year and such other information as may be considered necessary by it, to the Central\u00a0government and to the IRDAI which shall be furnished any time after the 30th June but not later than\u00a0the 30th September every year.<br \/>\n(3) The IRDAI shall consider the annual reports so furnished under sub-rule (1) and the report of the\u00a0Executive Council under sub-rule (2) and take suitable steps as it deems fit and necessary.<\/p>\n<p style=\"text-align: justify;\"><strong>18. Advisory Committee. \u2014\u00a0<\/strong>(1) An Advisory Committee consisting of eminent persons not exceeding five and including one\u00a0Central Government nominee shall be constituted by the IRDAI to review the performance of the<br \/>\nInsurance Ombudsman from time to time.<br \/>\n(2)The IRDAI shall decide the time, venue and quorum of the meeting of the Advisory Committee.<br \/>\n(3)The Advisory Committee shall submit its report to the IRDAI for review and further action as\u00a0deemed necessary.<\/p>\n<p style=\"text-align: justify;\"><strong>19. Recommendations to Central Government\u2014\u00a0<\/strong>The IRDAI, in consultation with the Executive Council, may recommend to the Central Government,\u00a0proposals for effecting improvements in the functioning of the Insurance Ombudsman.<\/p>\n<p style=\"text-align: right;\">[F.
