{"id":68501,"date":"2016-09-11T10:33:39","date_gmt":"2016-09-11T05:03:39","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=68501"},"modified":"2017-01-27T12:32:54","modified_gmt":"2017-01-27T07:02:54","slug":"judges-and-lawyers-should-update-themselves-with-the-latest-trend-of-law","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2016\/09\/11\/judges-and-lawyers-should-update-themselves-with-the-latest-trend-of-law\/","title":{"rendered":"Judges and Lawyers should update themselves with the latest trend of law"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Madras High Court:<\/strong> \u00a0While hearing a revisional petition against the decision of the \u00a0Additional Sessions Judge, Fast Track Mahila Court, Thoothukudi\u00a0 dismissing the petition of the de facto complainant under Section 173 CrPC seeking re-investigation, \u00a0the Bench of Dr. P. Devadass, J. observed that it is well settled that further investigation can be undertaken by the police even at the instance of the de facto complainant, \u00a0under Section 173(8) CrPC \u00a0and that the Judges and Lawyers should update themselves with the latest trend of law.<\/p>\n<p style=\"text-align: justify;\">The petitioner- de facto complainant had filed a missing girl complaint and \u00a0sought re-investigation of the case, which prayer was dismissed by the the \u00a0Additional Sessions Judge, relying on the decision in <em>Reeta Nag v. State of West Bengal, <\/em><a href=\"http:\/\/www.scconline.com\/LoginForNewsLink\/2009_9_SCC_129\">(2009)\u00a0\u00a09 SCC 129 <\/a>on the ground that under Section 173(8) CrPC, the <em>de facto <\/em>complainant cannot ask for fresh investigation and dismissed the petition.<\/p>\n<p style=\"text-align: justify;\">Allowing the petition, the Court observed that the view taken by the \u00a0Supreme Case in <em>Reeta Nag&#8217;s case<\/em>, that the police alone can do further investigation has been deviated subsequently \u00a0in<em> Vinay Tyagi&#8217;s case<\/em> \u00a0and also in <em>Chandra Babu<\/em> v. <em>State<\/em>, <a href=\"http:\/\/www.scconline.com\/LoginForNewsLink\/2015_8_SCC_774\">\u00a0(2015) 8 SCC 774<\/a>. \u00a0It is well settled that not only at the instance of the police, even at the instance of the de facto complainant, further investigation under Section 173(8) CrPC can be undertaken by the Police to find out the truth of the matter. But, the subordinate court is not competent to direct fresh, new, de novo investigation, which is entirely different from further investigation.<\/p>\n<p style=\"text-align: justify;\">The Court observed that \u201cit seems that the learned Additional Sessions Judge, Fast Track Mahila Court, Thoothukudi, has not been informed of the latest trend of\u00a0 law on this aspect. \u00a0Judges and Lawyers should update themselves with the latest trend of law. Law is a living organism. It grows every day. It must be &#8216;dynamic&#8217; and also &#8216;pragmatic. And should not be &#8216;static&#8217;. Law and judge-made law (case-law) must undergo change in tune with the change in Society. Otherwise, it will be a dull subject. Thus, March of Law is bound to be.\u201d<\/p>\n<p style=\"text-align: justify;\">Observing that the issue involved in this case has not been adjudicated before the trial court and had been left open by the learned Judge, the Court directed the lower court to rehear the matter and decide the application \u00a0under Section 173(8) CrPC, according to law.
