{"id":68121,"date":"2016-09-09T18:36:44","date_gmt":"2016-09-09T13:06:44","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=68121"},"modified":"2017-01-12T16:15:12","modified_gmt":"2017-01-12T10:45:12","slug":"where-accused-is-not-prejudiced-by-non-framing-of-written-charge-defect-can-be-cured","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2016\/09\/09\/where-accused-is-not-prejudiced-by-non-framing-of-written-charge-defect-can-be-cured\/","title":{"rendered":"Where accused is not prejudiced by non-framing of written charge, defect can be cured"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Calcutta High Court:<\/strong>\u00a0While deciding a revisional application against the order of the Special Court (CBI) in a corruption case, the Court held that where the accused was not prejudiced as no written charge was framed against him, the defect can safely be cured.<\/p>\n<p style=\"text-align: justify;\">The petitioner contended that a charge-sheet was filed against all the accused, the Special Court did not frame the \u00a0charges \u00a0in writing in its order dated May 31, 2010 and that no form was filled in. The counsel for CBI contended that\u00a0non-filling up of the form is one\u00a0irregularity and no illegality and for that reason, the prosecution case cannot\u00a0suffer. He submitted that vide the impugned order\u00a0dated May 15, 2014 , the learned court tried to cure the\u00a0irregularity by framing a written charge to cure the defect.<\/p>\n<p style=\"text-align: justify;\">The Court observed that in the instant case the charge was framed\u00a0against the accused and that was read over the explained to the accused petitioner also but unfortunately at a later stage of proceeding it was\u00a0found that the form of charge was not there in the record.\u00a0The court ought to have made administrative inquiry as to why that form of charge was not there in the record.<\/p>\n<p style=\"text-align: justify;\">The Court held that the only point involved was that\u00a0whether this accused was prejudiced as no written charge was framed against\u00a0him when the order dated 31st of May, 2010, was passed vide which charge was\u00a0read over and explained. The Court observed that the said order had not been\u00a0assailed before the court and as such it stands and cannot be interfered with.\u00a0On scrutiny of the said order it appeared that charge was framed against the petitioner\u00a0along with other accused persons and this accused was charged in\u00a0respect of the offence punishable under Section 420\/511 \u00a0IPC read with Section 120-B of the Code.<\/p>\n<p style=\"text-align: justify;\">The Court held that Section 464 CrPC naturally comes after Section 228(1)(b) of the Code and\u00a0naturally this Court can say that Section 464 of the Code is a curative section\u00a0and the defect that the trial court even did not frame in writing a charge\u00a0against the accused can safely be cured.\u00a0Dismissing the application, the Bench of Indrajit Chatterjee, J observed that as the circumstances of this case do not\u00a0show that any prejudice was caused to this accused, there was no need to frame fresh charge in the format in the case
