Uttarakhand High Court: <\/span><\/b>In an appeal relating to the conviction and sentence of an accused under Sections 307 and 149 Indian Penal Code, 1860, U. C. Dhyani, J, partly allowing the appeal explained that the law does not enjoin that the evidence of police witnesses should not be believed but the evidence tendered by the police personnel is acceptable so long as the same inspires confidence. In the present case, the accused had tried to fire on the police personnel during a chase but there was no actual hurt caused but the police had charged him under an attempt to murder. The Court held that it was difficult to believe the prosecution story as far as attempt to murder was concerned. The charges were thus set aside. Karan Singh v. State of Uttarakhand, Criminal Appeal No. 308 of 2003, <\/i>decided on 29 May, 2014 <\/o:p><\/i><\/span><\/p>\n
