Patnaik and Jagdish Singh Khehar, JJ<\/span><span> held that <\/span><span>that even though more than one remedies are available in Section 64 of the Act, the word <\/span><span  >\u201c<\/span><span  >or<\/span><span  >\u201d<\/span><span  > used therein separating the different remedies provided therein, would disentitle them, to avail of both the remedies, for the same purpose, simultaneously. If a <\/span><span  >\u201c<\/span><span>revocation petition<\/span><span  >\u201d<\/span><span  > is filed by <\/span><span  >\u201c<\/span><span  >any person interested<\/span><span  >\u201d<\/span><span  > in exercise of the liberty vested in him under Section 64(1); of the Act, prior to the institution of an <\/span><span  >\u201c<\/span><span>infringement suit<\/span><span  >\u201d<\/span><span  > against him, he would be disentitled in law from seeking the revocation of the patent (on the basis whereof an <\/span><span  >\u201c<\/span><span>infringement suit<\/span><span  >\u201d<\/span><span  > has been filed against him) through a <\/span><span  >\u201c<\/span><span>counter-claim<\/span><span  >\u201d<\/span><span  >. <i><\/i><\/span><i><span  >Dr. Aloys Wobben v.
