However, if the use of such land is \u201cas of right\u201d means that the use is without the permission of the landowner. Accordingly, it was held that such use is not \u201cof right\u201d or \u201cby right\u201d, but is carried on as if it were by right, hence \u201cas of right\u201d. <i>R v North Yorkshire County
