{"id":61031,"date":"2016-08-11T08:52:20","date_gmt":"2016-08-11T03:22:20","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=61031"},"modified":"2018-04-27T11:10:03","modified_gmt":"2018-04-27T05:40:03","slug":"amendments-to-the-maternity-benefit-act-1961","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2016\/08\/11\/amendments-to-the-maternity-benefit-act-1961\/","title":{"rendered":"Amendments to the Maternity Benefit Act, 1961"},"content":{"rendered":"<p style=\"text-align: justify;\">The Union Cabinet has given its ex-post facto approval for amendments to the Maternity Benefit Act, 1961 by introducing the Maternity Benefit (Amendment) Bill, 2016 in Parliament.<\/p>\n<p>The maternity benefit Act 1961 protects the employment of women during the time of her maternity and entitles her of a &#8216;maternity benefit&#8217; &#8211; i.e. full paid absence from work &#8211; to take care for her child. The act is applicable to all establishments employing 10 or more persons. The amendments will help 1.8 million (approx.) women workforce in organised sector.<\/p>\n<p>The amendments to Maternity Benefit Act, 1961 are as follows:<\/p>\n<p>\u2022 Increase Maternity Benefit from 12 weeks to 26 weeks for two surviving children and 12 weeks for more than two childern.<\/p>\n<p>\u2022 12 weeks Maternity Benefit to a &#8216;Commissioning mother&#8217; and &#8216;Adopting mother&#8217;.<\/p>\n<p>\u2022 Facilitate&#8217;Work from home&#8217;. \u2022 Mandatory provision of Creche in respect of establishment having 50 or more employees.<\/p>\n<p><b>Justification:<\/b><\/p>\n<p>\u2022 Maternal care to the Child during early childhood &#8211; crucial for growth and development of the child.<\/p>\n<p>\u2022 The 44th, 45th and 46th Indian Labour Conference recommended enhancement of Maternity Benefits to 24 weeks.<\/p>\n<p>\u2022 Ministry of Women &amp; Child Development proposed to enhance Maternity Benefit to 8 months.<\/p>\n<p>\u2022 In Tripartite consultations, all stake holders, in general supported the amendment proposal.<\/p>\n<p style=\"text-align: right;\">Press Information
