{"id":46141,"date":"2016-05-06T16:33:41","date_gmt":"2016-05-06T11:03:41","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=46141"},"modified":"2016-06-27T17:53:09","modified_gmt":"2016-06-27T12:23:09","slug":"notaries-amendment-rules-2016","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2016\/05\/06\/notaries-amendment-rules-2016\/","title":{"rendered":"Notaries (Amendment) Rules, 2016"},"content":{"rendered":"<p style=\"text-align: justify;\">The Central Government in exercise of the powers conferred by section 15 of the Notaries Act, 1952, makes Notaries (Amendment) Rules, 2016 in order to amend the Notaries Rules, 1956. The said Rules will come into force on the date of their publication in the Official Gazette, namely &#8211;<\/p>\n<ol style=\"text-align: justify;\">\n<li>In the Notaries Rules 1956, (hereinafter referred to as the said rules), in rule 7, in sub-rule (3), after clause (e), the following proviso shall be inserted, namely:-<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u201cProvided that in respect of categories (b) and (c), if the memorial in Form II is found to be in order, the competent authority may issue certificate of practice as Notary directly by exempting appearance before the Interview Board\u201d.<\/p>\n<ol style=\"text-align: justify;\" start=\"2\">\n<li>In the said rules, in rule 7A, after sub-rule (2) the following proviso shall be inserted, namely:-<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u201cProvided that the appropriate Government may dispense with the condition of holding of interviews for which reasons are to be recorded in writing\u201d.<\/p>\n<ol style=\"text-align: justify;\" start=\"3\">\n<li>In rule 8, in sub-rule, (4A) after the second proviso, the following proviso shall be inserted, namely:-<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u201cProvided also that in case, request for enhancement of quota is received from Union Territory or the State concerned, the same shall be considered as per the following criteria:-<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (a)\u00a0 if there is an increase in the population of the concerned State or the Union Territory;<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (b)\u00a0 if there is increase in the number of districts or tehsil or taluka of the concerned State or Union Territory\u201d.<\/p>\n<ol style=\"text-align: justify;\" start=\"4\">\n<li>In the said rules, in the Schedule, in column (1) :-<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">(i) against serial number \u20181\u2019 relating to \u2018Andhra Pradesh\u2019, in column. (2), for the figures \u2018575\u2019, the figures \u2018865\u2019 and in column (3), for the figures \u2018863\u2019, the figures \u20181306, shall respectively be substituted;<\/p>\n<p style=\"text-align: justify;\">(ii) against serial number \u20182\u2019 relating to \u2018Bihar\u2019, in column (3), for the figures \u2018925\u2019, the figures \u20181925\u2019 shall be substituted;<\/p>\n<p style=\"text-align: justify;\">(iii) against serial number \u20184\u2019 relating to Gujarat\u2019, in column (2), for the figures \u20181173\u2019, the figures \u20181760\u2019 shall be substituted;<\/p>\n<p style=\"text-align: justify;\">(iv) against serial number \u20185\u2019 relating to \u2018Kerala\u2019, in column (2), for the figures \u2018704\u2019, the figures \u20181000\u2019 shall be substituted;<\/p>\n<p style=\"text-align: justify;\">(v) against serial number \u20186\u2019 relating to \u2018Madhya Pradesh\u2019, in column (3), for the figures \u20181688\u2019, the figures \u20182500\u2019 shall be substituted;<\/p>\n<p style=\"text-align: justify;\">(vi) against serial number \u20187\u2019 relating to \u2018Tamil Nadu\u2019, in column (2), for the figures \u2018907\u2019, the figures \u20181360\u2019 and in column (3), for the figures \u20181088\u2019, the figures \u20182500\u2019 shall respectively be substituted;<\/p>\n<p style=\"text-align: justify;\">(vii) against serial number \u20188\u2019 relating to \u2018Maharashtra\u2019, in column (2), for the figures \u20182463\u2019, the figures \u20183700\u2019 shall be substituted;<\/p>\n<p style=\"text-align: justify;\">(viii) against serial number \u20189\u2019 relating to \u2018Karnataka\u2019, in column (2), for the figures \u2018844\u2019, the figures \u20181266\u2019 shall be substituted;<\/p>\n<p style=\"text-align: justify;\">(ix) against serial number \u201812\u2019 relating to \u2018Rajasthan\u2019, in column (2), for the figures\u20191000\u2019, the figures \u20181500\u2019 and in column (3), for the figures \u20191200\u2019, the figures \u20182000\u2019 shall respectively be substituted;<\/p>\n<p style=\"text-align: justify;\">(x) against serial number \u201814\u2019 relating to West Bengal, in column (3), for the figures \u20182625\u2019, the figures \u20183625\u2019 shall be substituted;<\/p>\n<p style=\"text-align: justify;\">(xi) against serial number \u201827\u2019 relating to Chhattisgarh, in column (3), for the figures \u2019600\u2019, the figures \u20181350\u2019 shall be substituted;<\/p>\n<p style=\"text-align: justify;\">(xii) against serial number \u201829\u2019 relating to Delhi, in column (2), for the figures \u2018610\u2019, the figures \u20181000\u2019 shall be
