The conference featured discussions on monetary remedies, asset recovery in the digital era and ethical standards in international arbitration.

In a panel discussion at the conference titled, “The Road Less Travelled: Asset Recovery in Arbitration Amid the Age of Digital Assets”, the panellists examined the evolving challenges of tracing, preserving and recovering digital assets in arbitration proceedings. The discussion focused on the identification of cryptocurrency holders, forensic investigation, freezing injunctions, emergency arbitration, jurisdictional challenges, loss of private keys, parallel proceedings, and more.

Moderated by Ms. Karishma Vora, Barrister, 39 Essex Chambers, the panel consisted of esteemed legal professionals namely, Mr. Vinay Garodia, Partner, EY Forensic & Integrity Services; Ms. Juhi Mathur, Partner, Trilegal; Mr. Manavendra Mishra, Partner, Khaitan & Co; and Mr. Aniz Ahmad Amirudin, Partner, Cecil Abraham & Partners.

What are digital assets?

Responding to Ms. Karishma Vora’s question, Mr. Vinay Garodia said that he had previously described it as something held digitally or in a binary format, with value that can be redeemed or owned. While the technical definition remains the same, he underscored a change in common or legal parlance: digital assets increasingly mean cryptocurrency, NFTs, or tokens held in a binary format in a wallet that hold value. In India, such assets are ‘virtual digital assets’, which include cryptocurrency, NFTs, tokens, etc., but exclude currency notes or e-rupee or e-currency.

On the role of wallets, Ms. Juhi Mathur explained that the digital wallet is the holder of an asset, which also acts like a gateway to an asset as it allows access to it upon receipt of credentials. It typically holds the cryptographic keys through which users can transact the asset. Thus, she stated that while conducting asset recovery, investigators examine balances in wallets, which are available on online platforms.

Identifying the culprit in digital asset fraud

Reflecting on her first digital asset fraud case, Ms. Vora underscored that one of the greatest difficulties in tracing digital assets is that the victim does not know who they have been defrauded by.

Agreeing with Ms. Vora, Mr. Aniz Ahmad Amirudin added that identifying the movement of the assets does not necessarily identify the person responsible for the fraud. In this regard, he delved into the process of a Norwich Pharmacal Order (NPO):

Identify the exchange: The victim shall engage a digital forensic expert to trace the stolen cryptocurrency and identify the wallet addresses to which the assets have been transferred. This forensic investigation might establish that the cryptocurrency has entered an account maintained by a Centralised Cryptocurrency Exchange (Exchange) such as Binance or Coinbase.

Apply for an NPO: The victim shall file an application before the Court for an order compelling the Exchange to disclose information concerning the account holder.

Obtain identifying information: The Exchange might be required to disclose the account holder’s name, identification documents, KYC (Know Your Customer) and AML (Anti-Money Laundering) verification records, residential addresses, email addresses, IP addresses, linked bank accounts and payment details, transaction history, etc.

Identify the wrongdoer: The information obtained might enable the victim to identify the person responsible, commence substantive proceedings, and seek appropriate freezing or proprietary relief.

He remarked that in Malaysia, parties had been successful in obtaining an NPO which enabled them to identify the wrongdoers.

Ms. Vora added that the NPO process was similar to the English process wherein parties can approach the Court to direct an internet service provider or Exchange to disclose information.

From the Indian perspective, Ms. Mathur stated that such remedy was available for safeguarding personality rights, wherein Indian Courts could be approached for issuing John Doe orders against impersonation or infringement of personality rights. In such cases, parties could include the intermediary like Facebook, Google, etc., as a pro forma party to provide information about the unknown culprit. She stressed that such rationale could be applied to digital asset disputes for identification of the anonymous wallet holder.

Evidence gathering and the challenges of asset tracing

Mr. Manavendra Mishra highlighted the practical difficulties involved in gathering evidence, particularly when digital assets move rapidly across jurisdictions. He observed that even in cases where the parties know the location of an asset and the person holding it, there is no legal means to establish the transaction. He pointed out that obtaining information from internet service providers and telecom operators in India can take approximately 21 days, during which the assets might move across multiple jurisdictions.

He further discussed how parties have increasingly explored obtaining freezing orders in jurisdictions such as Singapore and Dubai before pursuing enforcement measures in India. This could aid the process of pursuing action against the culprit in India. Thus, selecting the appropriate jurisdiction can be more important than determining the precise location of the asset at a particular point in time.

Regarding the process of asset tracing, Mr. Garodia explained that the basic methodology of asset tracing remains similar for physical and digital assets, although the latter involves distinct challenges. He identified three important considerations:

Timing: Asset tracing should begin early, preferably before formal proceedings or disclosure orders, as digital assets can move rapidly between wallets and jurisdictions.

Confidentiality: Forensic investigations should be conducted discreetly so that the other party does not become aware of the information being gathered.

Digital footprints: Unlike physical assets, digital assets may not generate conventional documentary records. Their traces may instead be found in electronic records, wallet numbers, passkeys, screenshots of transactions, account statements, and beneficiary details.

Mr. Garodia also highlighted the importance of gathering discrete information from people within the individual’s immediate surroundings, including employees, assistants, drivers, receptionists, and family members, who might have knowledge of the existence or approximate value of digital assets. Illustrating the role of forensic investigation, he referred to a case in which a review of thousands of pages of bank statements revealed a small redemption entry linked to a cryptocurrency wallet. The entry helped establish that the counterparty held an undisclosed wallet and enabled investigators to trace the original wallet containing the assets.

Freezing injunctions and preservation of digital assets

Turning to the importance of securing assets before they are transferred or dissipated, Mr. Amirudin explained that a Worldwide Freezing Order (WFO) restrains a defendant from disposing of, dealing with, or diminishing the value of assets worldwide up to a specified amount, pending the determination of substantive proceedings.

“There’s little point in spending considerable time and resources tracing stolen cryptocurrency if the fraudster can simply transfer the assets to another wallet before we can obtain an injunctive relief.”

He also distinguished between the two forms of relief:

Proprietary injunction: Protects specific assets belonging to the claimant, including identified cryptocurrency and its traceable proceeds.

Worldwide freezing order: Restrains the defendant from dissipating assets generally, including bank accounts, shares, properties and other digital assets, to ensure that an eventual judgment is not rendered ineffective.

He observed that both remedies may be sought in cryptocurrency fraud cases, depending on the circumstances. However, he cautioned that obtaining a WFO does not automatically compel Exchanges or custodians across the world to freeze the assets. Additional steps may be required to secure compliance, including recognition or enforcement of the order in the jurisdiction where the intermediary operates.

“The real challenge is, of course, making sure that the order is effective, not merely on paper, but in the jurisdictions and against intermediaries where the digital assets are actually held.”

From the Malaysian perspective, he noted that the principles governing Mareva freezing injunctions could be applied to digital assets, subject to the applicable legal requirements and evidence.

Emergency Arbitration for digital asset preservation

Ms. Mathur discussed the potential of emergency arbitration in disputes involving digital assets, particularly given the volatility of cryptocurrency prices and the urgency associated with preservation measures. She observed that emergency arbitration can be useful where the respondent has been identified, the arbitration agreement covers the dispute, and there is visibility regarding the asset that requires protection. For example, emergency arbitration could be particularly useful in disputes between users and Exchanges involving frozen wallets or those involving misplaced tokens or unauthorised transactions.

Ms. Mathur also discussed the possibility of using an escrow arrangement through a tribunal-controlled multi-signature wallet. Under such an arrangement, cryptocurrency could be held in a wallet requiring multiple signatures, with the tribunal acting as one of the signatories, until the dispute is decided. Thus, emergency arbitration could complement court proceedings seeking Mareva injunctions or worldwide freezing orders.

Jurisdictional challenges in cross-border digital asset recovery

Moving further, the panel examined how courts and arbitral tribunals determine jurisdiction when digital assets exist in a virtual environment and may move across multiple countries.

Mr. Mishra highlighted the prevalence of benami arrangements in India, where digital assets can be held through wallets operated in the names of drivers, cooks, or other individuals rather than the actual beneficial owners. He also referred to blockchain analysis, which can help investigators identify the movement of tokens between wallets, the source of transactions, and the instructions associated with them. However, he noted that such investigations can be expensive.

In India, he opined that lawyers consider approaching courts of original jurisdiction where interim relief may be more readily available, instead of high courts. Furthermore, cryptocurrency exchanges in India have increasingly begun responding to legal notices and may temporarily hold assets while parties pursue appropriate legal remedies.

On jurisdictional strategy, he referred to Dubai and the UK as jurisdictions where parties have been able to obtain freezing orders, and courts readily assume jurisdiction. However, jurisdictions like Sri Lanka, Bhutan and Bangladesh faced difficulties in enforcement in cases where assets move across jurisdictions.

From a Malaysian perspective, Mr. Amirudin explained that in Malaysia the primary question is not whether the asset is digital, but whether there’s a legally recognisable dispute, and whether the particular forum has jurisdiction to determine it.

He noted that Bitcoin has been recognised as property in Malaysia and that disputes involving unauthorised cryptocurrency transactions, custody obligations and alleged misappropriation have been brought before Malaysian courts.

Also read: Crypto currency qualifies as property that may be held in trust: Inside Madras High Court’s significant decision

Referring to Section 4 of the Malaysian Arbitration Act, 2005, he explained that disputes involving digital assets may be arbitrated where there is a valid arbitration agreement, the dispute falls within its scope, and the subject matter is arbitrable.

He further emphasised the distinction between the jurisdiction of courts and arbitral tribunals. While tribunals derive jurisdiction from the parties’ agreement, courts may grant relief against third parties, subject to applicable legal requirements. The distinction becomes particularly important in digital asset recovery because very often the person who allegedly misappropriated the cryptocurrency is not the only party involved. There may be cryptocurrency exchanges, wallet providers, custodians, and other intermediaries holding information or controlling access to their assets.

Thus, Mr. Amirudin stated that even where the substantive disputes refer to arbitration, the courts may still play an important supporting role, particularly in granting urgent injunctive relief, disclosure orders, and preservation orders.

Adding to the conversation, Ms. Vora mentioned that in England, a task force was created pre-COVID which had taken the view that if the victim of the crypto fraud or a digital asset fraud is located in England, then English courts will confer jurisdiction on themselves, making it a bit easier.

Indian courts and jurisdiction

Speaking on the Indian position, Ms. Mathur explained that establishing jurisdiction over digital assets is complicated because they do not have a conventional physical location. She identified several possible jurisdictional connections, such as the location of the victim or the person who holds the key, the location of the exchange or the platform, or the closest connection to the digital asset.

She referred to Rhutikumari v. Zanmai Labs (P) Ltd., 2025 SCC OnLine Mad 9290, arising from the 2024 WazirX hack, where a user based in Chennai approached the court under Section 9 of the Arbitration and Conciliation Act, 1996 (the Act), after withdrawals from the platform were suspended. The Madras High Court accepted jurisdiction on two grounds. First, the WazirX application was being operated through the user’s mobile phone in Chennai, providing access to his digital assets. Second, the bank account through which payments were made to the application for conversion into cryptocurrency was located in Chennai.

She added that the dispute involved a Singapore-seated institutional arbitration and that the proviso to Section 2(2) of the Act was relevant to the maintainability of the Section 9 petition. While the court granted relief in the form of a bank guarantee, it did not freeze the cryptocurrency itself. Ms. Mathur suggested that the presence of the cryptocurrency wallet outside India with Binance, and the resulting jurisdictional objections, may have influenced the decision.

She described this decision as an important step in developing the Indian position on jurisdiction and the availability of preservation orders for digital assets.

Adding to the discussion, Ms. Vora shared her experience of a case in which the cryptocurrency being traced had moved through 37 jurisdictions, including the British Virgin Islands, Dubai, and Bali. In this case, the English High Court had to be convinced that it could apply a worldwide injunction.

According to her, the issue was whether the courts and arbitrators are willing to apply established legal principles to emerging digital asset disputes, such as Mareva injunctions, attachment orders, etc. It is also important to demonstrate jurisdiction and explain the movement of assets across different jurisdictions to the court.

She further noted the need to distinguish between primary fraudsters, who may have devised and perpetrated the fraud, and secondary individuals whose wallets may have been used to transfer cryptocurrency without necessarily having played a direct role.

Loss of private keys and recovery of digital assets

Regarding challenges arising from the loss of private keys or passkeys, Mr. Garodia distinguished between a person claiming to have lost a passkey and an actual loss of access credentials. In cases where a person claims to have lost a passkey, forensic investigators may be able to recover traces from deleted files, password aggregators or accounts linked to Apple and Android devices.

He explained that recovery may be relatively easier where digital assets are held through centralised or exchange-based wallets, as users may be able to regain access through renewed KYC verification. However, the position is considerably more difficult with self-custodial wallets, where the loss of a private key may result in permanent loss of access to the assets.

Illustrating the issue, he referred to the case of a man who had discarded a hard drive containing Bitcoin and subsequently attempted to recover it after the value of the cryptocurrency increased. Despite efforts to locate the discarded hard drive, he could not retrieve it and lost the case after 12 years.

Mr. Garodia emphasised that while wallet technology is becoming more user-friendly and recovery mechanisms are improving, losing access credentials in older self-custodial arrangements remains a significant challenge.

Adding the legal perspective, Ms. Vora observed that the question also arises as to whether a programmer may owe a fiduciary duty requiring them to hand over the passkey.

Parallel criminal proceedings, insolvency and recovery of attached assets

Mr. Mishra examined the intersection of arbitration proceedings with parallel criminal complaints, insolvency proceedings and investigations by enforcement agencies. He observed that criminal complaints are increasingly being filed alongside arbitration proceedings in India.

He identified two situations:

Cases involving genuine fraud, including banking, investor or shareholder fraud, where the claimant seeks recovery of assets acquired using the proceeds of crime.

Cases where digital assets have been acquired using proceeds of a banking fraud, but a third party subsequently asserts a claim over those assets through arbitration or proceedings under Section 9 of the Act.

He explained that where assets have been attached by the Enforcement Directorate under the Prevention of Money Laundering Act, 2002 (PMLA), or by the CBI or Economic Offences Wing (EOW), the appropriate remedy must be pursued before the relevant court rather than before the arbitral tribunal or the National Company Law Tribunal. He referred to Sections 8(7) and 8(8) of the PMLA in the context of restoration and restitution of assets, particularly where the claimant is the entity from whose funds the assets were acquired or has acquired a legal right through insolvency proceedings.

In cases involving CBI, EOW or cyber cell investigations, Mr. Mishra explained that parties may pursue return-of-property applications. The claimant must establish the source of their legal right and demonstrate why they have a superior claim to the assets compared with other claimants. He also discussed the practical possibility of offering a bond, or an undertaking to return the asset if required after the conclusion of the criminal trial, in order to obtain earlier access to the property.

Further, Mr. Mishra referred to the use of the Money Restoration Module by cyber cells for the recovery of money diverted through digital transactions. He explained that parties may approach the police with evidence showing how their funds were transferred and converted, following which the court may direct the cyber cell or police to facilitate recovery. This process is being implemented in cases involving alleged impersonation and diversion of company funds across cities including Mumbai, Bengaluru, and Hyderabad.

Conclusion

The discussion highlighted that asset recovery in digital asset disputes extends well beyond obtaining an arbitral award or a freezing order. Identifying the beneficial owner, tracing cryptocurrency across wallets and jurisdictions, securing timely disclosure, obtaining effective freezing orders, and navigating parallel legal proceedings were challenges that parties and their lawyers have to navigate regularly.

The panellists emphasised the importance of combining digital forensic expertise with established legal remedies, including NPOs, John Doe orders, proprietary injunctions, WFOs, and emergency arbitration. Lastly, the overarching takeaway was that traditional legal principles continue to provide a framework for digital asset recovery, but their effectiveness depends on timely evidence gathering, appropriate jurisdictional choices, and the ability to secure enforceable relief across borders.

SCC Times is the Information & Documentation Partner for the ICC India Arbitration Conference 2026.
