It proposes a pluralistic framework combining LADCS with assigned counsel to strengthen access to justice while ensuring fair representation for indigent accused persons.

Assigned counsel system

The constitutional guarantee of “equal justice and free legal aid”<a id="fnref1" href="#fn1" title="1. This led to the enactment of the Legal Services Authorities Act, 1987 (hereinafter referred to as, “the Act”), envisioned as a transformative instrument for marginalised populations. The Act brought legal services institutions to life to ensure that economic or other disabilities do not impede the pursuit of justice.<a id="fnref2" href="#fn2" title="2. Nonetheless, some people fail to secure such representation due to economic and other factors. To address this gap, assigned counsel, or empanelled lawyers, were tasked with representing indigent and deserving defendants in criminal matters. Under this setup, legal services institutions entrusted private attorneys with cases involving indigent and deserving people. This decentralised setup offered the marginalised, a ray of hope for justice. These legal aid counsels, in addition to their assigned cases, were allowed to maintain private practices. Consequently, they failed to devote themselves fully to fulfilling the guarantee mandated by the Constitution. This failure was exacerbated by inadequate and irregular remuneration, which compelled them to engage in corrupt and exploitative practices, such as demanding fees and being irregularly available to those seeking legal help.<a id="fnref3" href="#fn3" title="3. As a result, the standard of legal aid deteriorated to the lowest standard.

In addition, the panel system also contravened the basic notion of equality, as most appointments under the system were driven by the whims of appointing authorities. Transparency and objectivity are crucial at the appointment stage to ensure the integrity and effectiveness of legal services. The system lacked a proper legal framework to regulate the appointments and functioning of those entrusted to represent indigent defendants. Regulations enacted under Section 29 of the Act assume a crucial role in this regard. Clause 8 delineates competency, integrity, suitability, and relevant experience as essential prerequisites for empanelment. Nevertheless, counsels continued to be empanelled on the sole basis of years of experience at the Bar rather than their commitment and competence. Moreover, informal and performative interviews remained the dominant mode of selecting legal aid counsels, rather than merit-based selection procedures. Overall, the setup lacks any mechanism to evaluate attorneys’ competence at the time of empanelment.

The Monitoring and Mentoring Committee (hereinafter, “MMC”), attached to legal services institutions at every level, acting as a superintending authority under the regulation, oversees legal aid dispensation and guides and advises panel lawyers.<a id="fnref5" href="#fn5" title="5. LADCS serves as a fulcrum between voiceless, deserving accused and the judicial institutions. Since its inception, the System has created a pool of eligible and dedicated lawyers seeking to bridge the gap between marginalised sections of society and the legal system. LADCS was rolled out in 2020 as a Central-sector scheme through the NALSA in 17 States and several Union Territories (UTs) as a pilot project. To alleviate the suffering of accused or convicted persons in custody and of persons eligible under Section 12 of the Act, LADCS operates to provide free legal services at the pre-arrest, remand, trial, and appellate stages in criminal matters. LADCS promotes an altruistic approach to legal aid by forming a body of paid, effective defence counsel not driven by ulterior interests. The System replaces the age-old empanelled advocate system. The public defender system, operational in countries like the USA, Argentina, the UK, etc. inspired the implementation of LADCS in India. Whereas in some countries, the legal aid delivery system comprises both the public defender system and the assigned counsel system, India has shifted completely to LADCS.<a id="fnref10" href="#fn10" title="10. The System is perceived as harming private practitioners because it undermines their dominant position in criminal law practice. It is perceived as threatening private practitioners’ economic interests. The lawyers of Punjab, Haryana and Chandigarh declared a “no-work” strike in July 2026.<a id="fnref14" href="#fn14" title="14. It is alleged that the System is erecting a “Parallel Bar” exclusively controlled by the State. Consequently, there is growing clamour to scrap the System in the interests of private practitioners and the System’s beneficiaries.

The allegations of a “Parallel Bar” have far-reaching consequences and warrant deeper enquiry. A dedicated body of lawyers relying solely on government contracts may be inclined to favour the government, which may adversely affect the quality of representation for the accused. Because prosecution is already a State domain, the engulfing of the assigned counsel system by LADCS might tilt our adversarial criminal justice system in the State’s favour. The State cannot be allowed to play the dual role of a protector and a facilitator of punishment. Impartial and fair counsel is incidental to the right to effective counsel. The adversary system of criminal justice will be at the State’s disposal if it excludes private practitioners in such cases. Independence and fairness for legal aid counsel cannot be dispensed with under the guise of a more robust and effective system, i.e. LADCS.

Following the turmoil, NALSA, by an order dated 4 August 2026, has halted the renewal of LADCS contracts for September in Haryana, Chandigarh and Punjab. Alternatively, District Judges of the districts concerned have been directed to assign legal aid matters to private practitioners instead of LADCS while the competent authority constituted by NALSA, reviews the LADCS scheme. Playing roulette with a lifeline by shifting the fate of undertrial prisoners from experienced LADCSs to assigned counsels is not advisable at a time when our criminal justice system is endeavouring to shed its colonial flavours and striving to craft a justice-oriented criminal justice system. Although cases assigned to the System formed a meagre fraction of the total cases filed in any court, NALSA has resolved not to renew the LADCS contracts in the remaining States also after the completion of recent terms.

Suggestions

The lack of comparable, definitive empirical data on the efficacy of LADCS and the assigned counsel system makes it difficult to determine which methodology is more effective. Data on LADCS are systematically available, whereas data on the assigned counsel system are scattered and, in some cases, unavailable. Nevertheless, the System is not foolproof. Irregularities and a lack of transparency have been observed regarding the appointment and assignment of cases to Legal Aid Defense Counsel.15

Nevertheless, legal extortion in the garb of victimhood is likely to distort the constitutional guarantees and aspirations. The demand to resurrect assigned counsel lacks proper reasoning and seems to stem from personal interests. Suffering arising out of social and economic disabilities ought not to be a source of livelihood for some people. Doing away with LADCS will be the last nail in the coffin of a robust, justice-oriented criminal justice system. The State, assuming the role of a steward, ought to balance the conflicting interests in society rather than to give way to the constitutionally incompatible fiat.

Dismantling the entire LADCS model and replacing it with assigned counsel may not satisfy the yearning for an imperishable and modern criminal justice system, as past records show. This factionalism needs a nuanced approach rather than a dichotomous resolution.

Structuring the System to work alongside the assigned counsel will allow us to preserve the sanctity of legal aid. Nevertheless, the proposed structure should not render the assigned counsel an “overflow” dumping ground.<a id="fnref16" href="#fn16" title="16. J.L.
