He observed that such celebrations provided an opportunity not merely to look back at the journey of an institution but also to reflect upon the values it had upheld and the responsibilities that lay ahead.

Tracing the parallel origins of the State of Keralam and its High Court to the historic moment of 1956, the CJI observed that their journeys over the past seven decades had remained closely intertwined. He highlighted the significant role played by the High Court in the constitutional development of the State, particularly in translating constitutional principles into lived realities, protecting the rights and liberties of citizens and ensuring that public power was exercised within the bounds of law.

Emphasising the deeper significance of institutional longevity, the CJI observed that the High Court had served as a forum where constitutional promises had found practical meaning, complex questions of law had received thoughtful answers and successive generations had reposed their faith in the ideals of justice, fairness and dignity. He stated that this enduring legacy of public trust and constitutional commitment made the occasion truly worthy of celebration.

On a personal note, the CJI recalled that he had been scheduled to visit Keralam in August 2026 for the inauguration of the new court complexes at Thrissur. However, owing to the devastating floods, he had been compelled to participate in the ceremony through video conferencing. While technology had enabled his virtual presence, it could not recreate the warmth of being physically present among the gathering. He expressed particular pleasure that the Platinum Jubilee celebrations had finally brought him to the State.

70 YEARS OF JUSTICE, 200 YEARS OF JOURNEY

Reflecting upon the judicial history of the State, the CJI observed that the history of the High Court of Kerala did not commence with the formation of the State in 1956. Rather, the present High Court had inherited a rich judicial tradition shaped over centuries in the regions comprising present-day Keralam. He traced this evolution from the early courts of Travancore and Cochin to the establishment of the Travancore High Court in 1887 and the Travancore-Cochin High Court in 1949. Each successive institution, he noted, had contributed to the foundations upon which the present High Court was built. The High Court of Kerala thus represented the culmination of a long and evolving judicial tradition carried forward into a new constitutional era.

Highlighting the progressive legacy of the institution, the CJI observed that the High Court had distinguished itself not merely by keeping pace with history but also by frequently remaining ahead of it. He recalled that Justice Anna Chandy became India’s first woman High Court Judge through this institution, while Justice M. Fathima Beevi went on to become the first woman Judge of the Supreme Court of India. At a time when the higher judiciary remained largely dominated by men, the High Court of Kerala had set an example for the rest of the country to follow.

The CJI further highlighted the progressive character of the High Court’s constitutional jurisprudence, particularly its extensive engagement with the principles of environmental protection and its invocation of fundamental rights to safeguard life and personal liberty. He observed that the Court had consistently demonstrated that constitutional promises must find expression in the everyday realities of citizens.

Referring to a landmark development in 1999, the CJI noted that the Kerala High Court had become the first Constitutional Court, not only in India but across the globe, to prohibit smoking in public places. At a time when the dangers of passive smoking had not received the attention they deserved, the Court had recognised that the right to life under Article 21 of the Constitution also encompassed the right to breathe clean, smoke-free air. Describing the decision as an instance of remarkable constitutional foresight, he observed that the Court had used the law not merely to respond to societal developments but to show society the way forward.

The CJI also emphasised that the High Court’s progressive outlook was not confined to its judicial pronouncements but extended to the administration of justice. In this regard, he recalled virtually inaugurating, in January 2026, the fully paperless functioning of the Kalpetta Judicial District in Wayanad, which had become the first district judiciary in the country to achieve this transformation. He described the initiative as a demonstration of the High Court’s commitment to innovation and its ability to lead the transition towards a modern, efficient and digitally empowered judiciary while remaining deeply rooted in its institutional legacy.

FINDING THE PATH AHEAD

Against the backdrop of the High Court’s institutional legacy and forward-looking leadership, the CJI turned to the larger question of the role of High Courts in meeting the evolving demands of constitutional justice.

Observing that constitutional justice in India did not begin and end in New Delhi, the CJI emphasised that its strength rested upon a robust network of 25 Constitutional High Courts across the country, each entrusted with the responsibility of protecting rights and upholding the rule of law. While the Supreme Court was often described as the ultimate guardian of the Constitution, he stressed that the constitutional responsibility of safeguarding rights was shared across the judicial system.

Elaborating upon the unique position of High Courts, the CJI observed that they were constitutional institutions closely connected with the everyday realities of the people. Their understanding of local grievances, regional circumstances and the practical consequences of governmental action placed them in a distinctive position within the judicial architecture. He illustrated this by referring to disputes concerning a fisherman’s livelihood along the Malabar coast, a farmer’s land in Wayanad or the rights of a worker in Kochi, observing that while such disputes might raise significant constitutional questions, their human dimensions were often best appreciated by the institution closest to those affected.

The CJI then underscored the extraordinary constitutional significance of Article 226 of the Constitution, describing its breadth as one of the greatest strengths of India’s judicial architecture. He distinguished the scope of Articles 32 and 226, observing that while Article 32 guaranteed access to the Supreme Court for the enforcement of fundamental rights, Article 226 empowered High Courts to issue appropriate writs and directions not only for the enforcement of fundamental rights but also for the protection of other legal rights.

He further observed that this expansive constitutional jurisdiction enabled High Courts to fashion meaningful remedies in diverse legal, statutory, administrative and contractual disputes. Equally significant was their power to grant timely interim protection. Emphasising the importance of such intervention, the CJI observed that the difference between justice and injustice sometimes lay not in the final judgment but in whether the Court intervened at the stage when such intervention was most urgently required.

The CJI expressed the view that public confidence in High Courts as the natural and effective first forum for constitutional remedies must continue to be strengthened. He clarified that the Supreme Court and High Courts were not competing destinations for justice but constitutional partners discharging complementary responsibilities in furtherance of a common endeavour.

Turning to the changing expectations of litigants, the CJI acknowledged the considerable pressures under which High Courts functioned. He recognised that Judges worked beyond regular court hours, urgent matters were accommodated despite heavy cause lists and considerable effort was devoted to balancing competing demands on judicial time. These efforts, he observed, deserved sincere recognition.

At the same time, he drew attention to the growing tendency of litigants approaching the Supreme Court seeking directions for urgent listing or early hearing of matters pending before High Courts. He noted that the Supreme Court had consistently respected the institutional autonomy of High Courts, including their authority to regulate their own rosters, in recognition of their constitutional status. Nevertheless, the increasing frequency of such requests warranted introspection into whether the responsiveness of judicial processes could be improved.

The CJI raised important questions concerning the identification of urgent matters, transparency and predictability in listing procedures, and the use of technology to prioritise cases where delay could result in irreversible prejudice. He also emphasised the need to ensure that access to timely justice did not depend upon a litigant’s ability to travel to the national capital.

Clarifying that these concerns were not intended as institutional criticism, the CJI described them as matters of collective responsibility. He emphasised that judicial independence and judicial efficiency were not competing virtues. Rather, the timely and effective functioning of courts reinforced public confidence in their independence.

CONCLUSION

Concluding his address, the CJI referred to Keralam’s longstanding commitment to education, social awareness and public participation as the foundations of sustained progress. Drawing an analogy with the State’s pristine backwaters, he observed that numerous streams and waterways, each following its own course, ultimately sustained an interconnected ecosystem. Similarly, constitutional courts must preserve their individual authority while functioning in harmony towards a shared constitutional purpose.

As the High Court entered its eighth decade, the CJI expressed the hope that it would continue to combine the wisdom of its history with the courage to embrace change. He emphasised that the institution must remain accessible to the vulnerable, attentive to the urgency of human suffering and unwavering in its commitment to constitutional values.

The CJI also acknowledged the contribution of Shri P. Balasubramanian Menon, Senior Advocate, whose professional career spanned more than seven decades. Describing him as an exemplar of the enduring ideals of the legal profession, the CJI observed that the true measure of a lawyer lay not merely in the length of one’s career or the distinction of its milestones but in an abiding commitment to the cause of justice. His recognition on the occasion, he noted, served as a reminder that the strength of the legal system rested as much upon the dedication of its practitioners as upon the institutions they served.

The CJI concluded by extending his warmest congratulations to the High Court of Kerala, its serving and former Hon’ble Chief Justices and Hon’ble Judges, members of the Bar, officers, staff and the people of Keralam on the historic milestone. He expressed the hope that the next seventy years would be even more distinguished.

As the High Court
