Finding their testimonies reliable and undisturbed, the Court noted that the recovery of the Gandasa at the appellant’s pointing out and his bloodstained clothes, corroborated by the independent recovery witness PW 4, further supported the prosecution case, as blood was detected on both articles during FSL examination. The Court also found no contradiction between the ocular and medical evidence and held that the evidence sufficiently established the appellant’s culpability. Finding no perversity or illegality in the trial court’s findings, the Court upheld the conviction.

On the question of the appropriate sentence, the Court relied upon Mumtaz v. State of U.P., (2016) 11 SCC 786, wherein the Supreme Court considered the interplay of the JJ Act, 1986 and the JJ Act, 2000 and the procedure to be adopted when a claim of juvenility is raised during pendency of a criminal appeal and thus the Court found that where a juvenile is found guilty of the offence alleged to have been committed, he simply cannot go unpunished, but what punishment should be awarded, must be left to the Juvenile Justice Board constituted under the Act. The Court noted that as the offence was committed on 2 February 1999, when the JJ Act, 1986 was in force, and by virtue of both the subsequent enactments and the law by the Supreme Court, only the punishments/orders permissible under the law governing juvenile ought to be awarded.

The Court upheld the appellant’s conviction but set aside the sentence and remitted the matter to the Juvenile Justice Board concerned for passing appropriate orders in accordance with law within 4 weeks of receiving the certified copy of the judgment.
