The Court held that parents cannot, through a mutual settlement, deprive a child of the love, affection and companionship of either parent, emphasising that the child’s welfare remains paramount and that consent-based custody arrangements may be modified whenever the child’s best interests so require.

Background

The appellant-mother and the respondent-father married on 18 February 2010 and had a son on 19 July 2011. Following matrimonial disputes, the mother initiated proceedings under Section 12, Protection of Women from Domestic Violence Act, 2005, while the father filed proceedings under Section 125, Criminal Procedure Code, 1973 (CrPC). During the domestic violence proceedings, the parties entered into a settlement dated 30 May 2017, under which the child’s custody was to remain with the mother and the father was permitted to meet the child on the second Saturday of every month for 3 hours at the Children Room in the court premises. A supplementary settlement dated 5 September 2017 provided that this visitation arrangement would continue only until the decree of divorce by mutual consent, pursuant to which the marriage was dissolved.

The father subsequently instituted proceedings under Section 12, Guardians and Wards Act, 1890, seeking visitation rights. By order dated 7 August 2025, the Family Court granted him visitation on the first and third Saturdays of every month from 3 p.m. to 5 p.m. at the Children Room, Family Court, North-West, Rohini, Delhi. It also directed the mother to inform the father and his counsel in advance if an exigency prevented her from bringing the child, in which case visitation would be shifted to the immediately following Saturday.

Aggrieved by this order, the mother appealed before the Delhi High Court, challenging the visitation arrangement.

Issues

The principal issue was whether the Family Court’s order granting the father visitation rights on the first and third Saturdays of every month warranted interference, particularly in view of the earlier settlements between the parties.

The matter also raised the broader question of whether parents can, through a mutual settlement in matrimonial proceedings, agree to restrict or terminate one parent’s access to a child, and whether such an arrangement can bind the courts when the child’s welfare requires continued contact with both parents.

Analysis and Decision

The Court expressed displeasure with the settlement arrangements between the parties, observing that parents cannot mutually agree to deprive a child of the presence of either parent. Such agreements may adversely affect the child’s growth and development and cannot be encouraged when they operate to the child’s detriment. The Court directed that, in any mediation settlement between husband and wife, a mutual agreement by which one party decides to abdicate his or her responsibility as a father or mother cannot be accepted. “The doors of a parent cannot be shut to the detriment of a child, and the courts, in exercise of its parens patriae jurisdiction, cannot encourage such kinds of settlement agreements which operate to the prejudice of the child.”

The Court emphasised that although custody may be granted to either parent, a child cannot be completely deprived of the other parent’s presence, love and affection. It cautioned that a child must not become a victim of parental acrimony and that courts should be wary of a parent portraying the other as entirely blameworthy to justify a claim to exclusive custody.

Observing that a 15-year-old child requires a father’s guidance and a mother’s love and affection, the Court reiterated that these are fundamental to the child’s well-being and that a child must not be made a “football” between the parents to their own detriment.

“A contention by one of the spouses that the other spouse is a complete villain and that spouse alone is entitled to the custody of the child should not ordinarily be accepted and courts must be wary of such a stand taken by one of the parties.”

Relying on Rosy Jacob v. Jacob A. Chakramakkal, (1973) 1 SCC 840, the Court reiterated that custody orders are temporary in nature and may be varied whenever the child’s welfare demands it, even if such orders are based on consent. As a child’s needs and circumstances evolve, an arrangement that was appropriate at one stage may no longer serve the child’s best interests. Accordingly, consent-based arrangements cannot restrict the court’s continuing authority to modify custody and visitation orders in the interest of the child’s welfare.

The Court further relied on Yashita Sahu v. State of Rajasthan, (2020) 3 SCC 67, wherein the Supreme Court recognised a child’s basic human right to the love, affection, company and protection of both parents. Parental conflict alone does not justify depriving a child of either parent’s care. Even where custody is granted to one parent, the other should ordinarily be granted sufficient visitation rights to maintain social, physical and psychological contact with the child. A parent should be denied visitation or contact only in exceptional circumstances, with reasons assigned by the court.

In view of these principles, the Court held that the Family Court’s order granting the father’s visitation rights could not be faulted. Accordingly, the Court dismissed the appeal along with the pending applications.

[X v. Y, CNR No. DLHC010231382026, decided on 7-10-2026]

Advocates who appeared in this case :

For the Appellant: Mr. Dalip Kumar Santoshi, Advocate, with the appellant appearing in person.

For the Respondent: Mr. Sauraj Yadav and Mr. Bhaskar Yadav, Advocates.

Observing that a 15-year-old child requires a father’s guidance and a mother’s love and affection, the Court reiterated that these are fundamental to the child’s well-being and that a child must not be made a “football”
