The applicant contended that his request for two additional days of leave had been approved by the Senior Divisional Commercial Manager/Coaching, Prayagraj, through a WhatsApp response stating “OK”. However, the Tribunal observed that the said response could not, by itself, be treated as conclusive proof of sanction of leave by the competent authority.

Holding that the respondents had demonstrated an independent and bona fide administrative exigency for the transfer, including the requirement of staff at the newly developed entry and booking office at Fatehpur Railway Station and the applicant’s continued posting in the D.R.M. office since 2019, the Tribunal held that the applicant had failed to establish that the transfer was actuated by mala fides or was a substitute for disciplinary punishment. Relying upon the settled principles governing judicial review of transfer orders, including Somesh Tiwari v. Union of India, (2009) 2 SCC 592, the Tribunal found no sufficient ground to interfere with the impugned transfer and relieving orders.

Background

The applicant approached the Tribunal under Section 19 of the Administrative Tribunals Act, 1985, seeking quashing of the transfer order dated 25 July 2025, whereby he was transferred from Prayagraj to Fatehpur, and the consequential relieving order dated 28 July 2025, along with a direction to the respondents to permit him to continue as CCS/CMI, North Central Railway, Prayagraj, with all consequential benefits. The applicant was initially appointed under the respondents on 9 October 2014 and had been working as CCS/CMI, North Central Railway, Prayagraj, since 1 April 2019. He contended that he had been transferred to different places during his service and had always complied with the orders of the respondents. The applicant further submitted that, after availing three days’ LAP from 14 July 2025 to 16 July 2025, he sought an extension of two days’ LAP for 17 July 2025 and 18 July 2025 through WhatsApp on 16 July 2025, which was allegedly approved by the Senior Divisional Commercial Manager/Coaching, Prayagraj, Shri Himanshu Shukla, by replying “OK”. He further stated that he had telephonically informed the Senior Divisional Commercial Manager/Freight, Prayagraj, about the matter on 17 July 2025. Upon reporting for duty on 21 July 2025, he was called to the chamber of the Divisional Commercial Manager/Freight, North Central Railway, Prayagraj, Shri Atul Yadav, through the peon. Aggrieved by the impugned transfer and relieving orders, the applicant filed the present Original Application before the Tribunal.

Analysis

The Tribunal observed that the principal issue for consideration was whether the impugned transfer order dated 25 July 2025 was punitive in nature or was an administrative transfer made in the exigencies of service. The respondents had disclosed specific administrative reasons for transferring the applicant from Prayagraj to Fatehpur, namely, the development of a new entry and booking office at Fatehpur Railway Station, the requirement of staff, availability of a vacant post and the applicant’s continued posting in the D.R.M. office since 2019 beyond the stated normal tenure. The Tribunal noted that the transfer was processed through the Placement Committee and approved by the competent authority.

The Tribunal further observed that the WhatsApp response “OK” relied upon by the applicant could not, by itself, be treated as conclusive proof of sanction of leave by the competent authority, particularly when the respondents had stated that the administrative work of the Commercial Department was under the charge of Shri Atul Yadav, who was the competent authority for sanction of the applicant’s leave and that leave was required to be sanctioned through the HRMS portal, mere submission of a leave request not amounting to sanction. The Tribunal held that the applicant had failed to establish, by specific and cogent material, that the transfer was actuated by mala fides or was a substitute for disciplinary punishment. It further observed that, although the applicant had been suspended on 21 July 2025, before the transfer order of 25 July 2025 and his relieving on 28 July 2025, the charge-sheet was issued only on 31 July 2025and the mere initiation of disciplinary proceedings did not establish the punitive character of the transfer. Relying upon the settled principles governing judicial review of transfer orders, including Somesh Tiwari v. Union of India, the Tribunal held that transfer is ordinarily an incidence of service and that administrative transfers made in administrative exigency or public interest do not warrant interference, unless the transfer is mala fide, arbitrary, contrary to statutory rules, issued by an incompetent authority or punitive in disguise. It added that an allegation of mala fides must rest on specific and cogent facts and not on conjecture or presumption.

The Tribunal rejected the allegation of bias against Shri Atul Yadav, who was also a respondent, holding that the applicant had not shown that the transfer order was passed by an authority lacking competence. It noted that the transfer did not change the disciplinary authority and that safeguards applicable to disciplinary adjudication could not, on such an allegation, be imported into an administrative transfer order. The applicant’s contention that he was deliberately assigned protocol duty for the Amrit Bharat Train inauguration programme at Subedarganj to create a ground for action was a disputed factual assertion unsupported by independent material.

Decision

Accordingly, the Tribunal held that the respondents had demonstrated an independent and bona fide administrative exigency for the applicant’s transfer and that no cogent material had been placed on record to establish that the impugned transfer order was punitive in disguise, arbitrary or passed by an incompetent authority. Finding no sufficient ground to interfere with the transfer order dated 25 July 2025 or the consequential relieving order dated 28 July 2025, the Tribunal dismissed the Original Application. The interim order dated 19 August 2025 was vacated, there was no order as to costs, and all pending Miscellaneous Applications, if any, stood disposed of.

[<span style="font-weight: bold;
