The two-day competition is designed to provide students at The Shillong Law College with an opportunity to develop their legal research, memorial drafting, oral advocacy and courtroom skills. The Competition is open to bonafide students pursuing either the three-year LL.B. course or the five-year integrated B.A. LL.B. course at the College.<\/p>\n

About the Competition<\/p>\n

The Intra Moot Court Competition 2026 is being organised by the Moot Court Society, The Shillong Law College, with the objective of fostering legal acumen, drafting capability, advocacy skills and rule of law sensibility among law students.<\/p>\n

The Competition is structured to ensure uniformity, transparency, fairness and procedural certainty. The Rules and Regulations are to be read together with the Moot Proposition and any official clarifications or notifications issued by the Organising Committee.<\/p>\n

The Competition will be conducted over two days, with the Preliminary Rounds and Quarter Final Round scheduled for November 5, 2026, followed by the Semi Final and Final Rounds and the Valedictory Session on November 6, 2026.<\/p>\n

Moot Proposition: Maya v. State of Moh<\/p>\n

The Moot Proposition for the Competition is titled “Maya v. State of Moh” and is based on a constitutional and criminal law dispute involving freedom of speech and expression, public order, criminal liability, arrest and detention, and privacy in relation to electronic devices.<\/p>\n

The proposition concerns Maya, a 28-year-old locally domiciled teacher in the State of Moh, who is described as an active critic of governmental policies and an advocate of governmental accountability. Following her allegations concerning irregularities in a State housing scheme, she addressed a public gathering calling upon citizens to protest corruption through lawful and democratic means. Her speech was subsequently circulated widely on social media.<\/p>\n

The factual controversy escalates following a large public procession on August 19, 2026, during which incidents of violence, damage to public and private property, assaults and vandalism were reported. Although the proposition states that there was no direct evidence connecting Maya with the violence, the authorities alleged that her speeches and social media activities had created an atmosphere conducive to violence.<\/p>\n

Maya was subsequently arrested, and her mobile phone and laptop were seized for examination. The State registered an FIR alleging, among other offences, criminal conspiracy, unlawful assembly, rioting and offences relating to statements and conduct prejudicial to public order under the Bharatiya Nyaya Sanhita, 2023<\/a>.<\/p>\n

Issues for Adjudication<\/p>\n

    Whether the writ petition filed by Maya under Article 226<\/a> of the Constitution<\/a> of Moksha, challenging the FIR, chargesheet, arrest and seizure of electronic devices, is maintainable, especially in light of the availability of alternative remedies under the BNSS, 2023<\/a>.<\/p>\n<\/li>\n

  2. \n

    Whether Maya’s speeches and social media activities are protected under Article 19(1)(a), or whether they amount to incitement to violence and fall under reasonable restrictions under Article 19(2), punishable under Sections 192<\/a>, 196<\/a>, 197<\/a> and 353<\/a> of the BNS<\/a>.<\/p>\n<\/li>\n

    Whether criminal liability for conspiracy, unlawful assembly, rioting and related offences under Sections 61<\/a>, 189<\/a> and 191<\/a> of the BNS<\/a> can be fastened upon Maya solely on the basis of her speeches and online influence, in the absence of direct evidence of participation in violence.<\/p>\n<\/li>\n

    Whether Maya’s arrest, manner of detention, public portrayal as a violence monger or terrorist, and seizure and examination of her mobile phone and laptop violate her rights under Articles 21 and 22 and mandatory procedure under the BNSS and BSA, 2023<\/a>, including the right to privacy.<\/p>\n<\/li>\n<\/ol>\n

    The proposition clarifies that the Constitution of Moksha is pari materia with the Constitution of India<\/a>. The criminal, procedural and evidentiary laws of the State of Moh and the Union of Moksha are likewise pari materia with the corresponding laws in force in India. Participants may rely upon Indian and comparative constitutional jurisprudence.<\/p>\n

    Team Composition and Participation<\/p>\n

    The Competition permits participation by students from both the three-year LL.B. and five-year integrated B.A. LL.B. programmes. Each team is required to comprise three members, consisting of two Speakers or Mooters and one Researcher. The Researcher assists the Speakers but is not permitted to address the Bench during oral rounds.<\/p>\n

    A maximum of 16 teams may participate in the Competition. Registration is to be completed through the designated registration process, with participation subject to the Competition Rules.<\/p>\n

    To preserve fairness and anonymity, teams are allotted unique alphanumeric Team Codes, which serve as their identifiers throughout the Competition. The identity of teams, sections and semesters is not to be disclosed during the Competition.<\/p>\n

    Competition Format<\/p>\n

    The Competition begins with two Preliminary Rounds. Each team will argue once for the Petitioner or Appellant and once for the Respondent against different opponents. Each team receives 15 minutes per Preliminary Round, with up to six minutes ordinarily allocated to each Mooter.<\/p>\n

    The top eight teams based on their cumulative scores will advance to the Quarter Final Round. The Quarter Final is a knockout round, with each team allotted 20 minutes, inclusive of a maximum three-minute rebuttal. The top four teams will then progress to the Semi Finals.<\/p>\n

    The Semi Final and Final Rounds will provide longer opportunities for oral submissions. Each team receives 30 minutes in the Semi Final, inclusive of rebuttal and sur rebuttal, while the Final Round will also be conducted over 30 minutes.<\/p>\n

    Evaluation<\/p>\n

    The Competition places equal emphasis on written and oral advocacy.<\/p>\n

    Memorials are evaluated out of 100 marks, with the evaluation covering knowledge of law and facts, ability to answer questions, style and demeanour in drafting, organisation and flow of arguments, and citation, footnoting and references.<\/p>\n

    Oral submissions are similarly evaluated out of 100 marks, with particular emphasis on knowledge of law and facts, application of law to facts, use of authorities, ability to respond to questions from the Bench, court craft, articulation and organisation of arguments.<\/p>\n

    Schedule<\/p>\n

    The Competition will commence on Friday, November 5, 2026, with registration and the inaugural ceremony, followed by the two Preliminary Rounds and the Quarter Final Round.<\/p>\n

    The second day, Saturday, November 6, 2026, will comprise the Semi Final Round, Final Round, Judge Feedback and Score Finalisation, followed by the Valedictory and Prize Distribution Ceremony.<\/p>\n

    The official schedule is expressly stated to be tentative and subject to change at the discretion of the Organising Committee.<\/p>\n

    The Intra Moot Court Competition 2026 is intended to provide a structured platform for students of The Shillong Law College to engage with contemporary questions of constitutional law and criminal jurisprudence while developing practical skills in legal research, memorial drafting and oral advocacy.<\/p>\n

    With Maya v. State of Moh raising questions involving freedom of speech, public order, criminal liability, arrest, due process and digital privacy, the Competition provides participants with a broad constitutional and criminal law framework within which to develop and test their advocacy before a simulated judicial Bench.<\/p>\n
