US Customs and Border Protection (CBP) has assessed a further $2.1 billion in commercial trade penalties this fiscal year. Behind these numbers is a significant policy shift: Washington now treats the evasion of import duties as a crime against government revenue, on par with tax fraud, rather than a regulatory infraction to be settled with a fine. Two changes in 2026 make this official. In a parallel development, the US Securities and Exchange Commission (SEC) announced on 5 August 2026, the creation of a new Financial Reporting and Accounting Unit, dedicated to pursuing accounting and financial reporting fraud, underscoring that the formalisation of fraud enforcement is now a cross-agency priority across the US Government.

Two changes in 2026 make this official. First, in March, the Department of Justice (DOJ) issued a department-wide Corporate Enforcement and Voluntary Self-Disclosure Policy (CEP), setting uniform rules for how companies can cooperate with investigators and receive leniency. Second, in August, it published enforcement priorities for the National Fraud Enforcement Division (the Fraud Division), a prosecutorial sub-department (taking effect on 24 August 2026) with authority over criminal frauds, internal revenue, trade fraud, monies owed to or paid by the US, and healthcare fraud. Its five priority themes are: public trust and financial integrity, health care, internal revenue, global trade and commerce, and corporate misconduct.

The March CEP gives companies a clear incentive to come forward. A company that self-reports wrongdoing, cooperates fully, and remediates the problem can avoid criminal charges entirely. The process has been streamlined: Companies now face a single disclosure obligation rather than two overlapping ones, and the rules apply uniformly across all DOJ components. To remain eligible for a declination, a company must report “as soon as reasonably practicable, and in no event later than 120 days” after receiving an internal whistleblower complaint. Cooperating companies also benefit from meaningful fine reductions, those on a “near miss” track receive reductions of 50 per cent to 75 per cent, while others can still secure up to 50 per cent off. Investigations remain bound by the applicable limitation periods (typically 5 to 10 years), and the DOJ must publicly explain the credit it gave a company for cooperating, adding a layer of transparency and accountability to the system.

For Indian businesses specifically, voluntary disclosure to US authorities creates a dilemma. Reporting to the DOJ may also require reporting to Indian regulators such as Securities and Exchange Board of India (SEBI) or Reserve Bank of India and carry its own set of risks. Company Boards may need to make this decision before their own internal investigation is complete, weighing the benefits of US leniency against the risk of triggering regulatory action at home.

Turning to the Fraud Division, the practical effect for foreign companies is significant. Under the new framework, if a company’s goods enter the US with an incorrect customs declaration, and US authorities can show that anyone in the supply chain contributed to that false filing, the entire chain is potentially exposed to criminal prosecution. This includes the foreign manufacturer, trading companies, customs brokers, and even parent companies, not just the US-based importer. The penalties are severe: fines of up to $5,00,000 per false filing, prison sentences of up to 20 years for individuals involved, and seizure of any assets the company holds in the US, including bank accounts, goods in transit, and money owed by US customers.

The Fraud Division is designed to act quickly. Prosecutors deployed across the country can now bring charges in coordination with local US Attorneys’ Offices without centralised approval from Washington. Importantly, the Fraud Division can also prosecute any federal criminal offence uncovered during a fraud investigation without referral to another DOJ component, and its Assistant Attorney General can empanel special grand juries anywhere in the country. The Fraud Division uses data analytics to detect suspicious patterns in import filings, such as sudden changes in declared origin or large mismatches between declared values and market prices. Investigators can obtain search warrants early in an inquiry, sometimes before the company knows it is under scrutiny. For companies outside the US, enforcement relies on mutual legal assistance treaties. India has such a treaty with the US (in force since 2005).

The Fraud Division has also designated forced labour as a criminal priority under its global trade and commerce mandate. If a company certifies that its goods comply with import rules but has reason to believe they were produced using forced labour, that certification can be treated as a criminal false statement. Gaps in supply chain records may be used as evidence that the company chose not to ask questions it should have asked. Companies buying US-facing businesses should also be aware that the buyer could inherit the seller’s liability for past customs fraud if it failed to check for problems during due diligence. Where companies cooperate with an investigation, the typical outcome is a supervised agreement requiring a compliance monitor and a public admission of facts, which may have consequences for government contracts in the company’s home country.

Taken together, the 2026 reforms mean the US now has a permanent, well-resourced enforcement system treating import fraud as seriously as financial crime. Within this structure, the Fraud Division handles fraud involving government funds, while the Criminal Division’s renamed White Collar and Corporate Enforcement section covers private-sector fraud. For companies in India, Vietnam, China, and other countries with growing US export volumes, the message is straightforward: the compliance standards required to export safely to the US have risen, and companies whose internal systems were designed for a regulatory environment may need to reconsider whether those systems are adequate for a criminal enforcement environment.

The information in this piece is dated August 18, 2026

*Partner, Cyril Amarchand Mangaldas.

**Principal Associate, Cyril Amarchand Mangaldas.

[30936,20271
115559,100567,115554,115550,115557,115561,115553,115549,115558,74758,115552,115556,115551,115555,115548,115560
post-397118","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-cam","category-experts_corner","tag-corporate-fraud-enforcement","tag-customs-compliance","tag-customs-duty-evasion","tag-customs-fraud-usa","tag-foreign-companies-us-imports","tag-import-compliance","tag-import-duty-evasion","tag-import-duty-fraud","tag-import-fraud-penalties","tag-trade-compliance","tag-trade-fraud","tag-us-customs-and-border-protection","tag-us-customs-enforcement","tag-us-department-of-justice","tag-us-import-duty-fraud","tag-us-trade-enforcement

US Import Duty Fraud: What Foreign Companies Need to Know | SCC Times

<meta name="description" content="The US is strengthening enforcement against import duty and customs fraud.
