{"id":396866,"date":"2026-09-22T17:00:25","date_gmt":"2026-09-22T11:30:25","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=396866"},"modified":"2026-10-06T19:44:43","modified_gmt":"2026-10-06T14:14:43","slug":"delhi-hc-notifies-designation-of-senior-advocate-rules-2026","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/09\/22\/delhi-hc-notifies-designation-of-senior-advocate-rules-2026\/","title":{"rendered":"What changes under Delhi High Court&#8217;s 2026 senior advocate designation rules?"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 3 September 2026, the Delhi High Court notified the <span style=\"font-weight: bold;\">High Court of Delhi Designation of Senior Advocate Rules, 2026<\/span>, replacing the framework notified in 2024 for designation of advocates as Senior Advocates.<\/p>\n<p style=\"margin-bottom: 3%;\">The new framework lays down the eligibility criteria, application process and decision-making procedure for designation of advocates as Senior Advocates and came into effect on 3 September 2026.<\/p>\n<p style=\"font-weight: bold;\">Key Takeaways:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>The rules have been framed by the Delhi High Court under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543807\" target=\"_blank\">16(2)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002806286\" target=\"_blank\">Advocates Act, 1961<\/a> and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543876\" target=\"_blank\">7<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002852200\" target=\"_blank\">Delhi High Court Act, 1966<\/a>.<\/p>\n<\/li>\n<li>\n<p>The rules apply across the entire jurisdiction of the Delhi High Court.<\/p>\n<\/li>\n<li>\n<p>Rule 3 provides for a <span style=\"font-weight: bold;\">Permanent Secretariat<\/span>, headed by an officer of the rank of Registrar, who will manage the process of designation and maintain relevant information relating to applicants.<\/p>\n<\/li>\n<li>\n<p>The Permanent Secretariat is required to initiate the process for designation of Senior Advocates at least once every year by inviting applications from advocates.<\/p>\n<\/li>\n<li>\n<p>The notice inviting applications is to be published on the official website of the High Court, with intimation also to the Delhi High Court Bar Association.<\/p>\n<\/li>\n<li>\n<p>Applicants must be given at least <span style=\"font-weight: bold;\">21 days to submit their applications<\/span>.<\/p>\n<\/li>\n<li>\n<p>To be eligible for designation as a <span style=\"font-weight: bold;\">Senior Advocate<\/span>, an applicant must:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>have practiced for at least <span style=\"font-weight: bold;\">10 years as an advocate<\/span>;<\/p>\n<\/li>\n<li>\n<p>be enrolled with a <span style=\"font-weight: bold;\">Bar Council<\/span>;<\/p>\n<\/li>\n<li>\n<p>be primarily practicing before the <span style=\"font-weight: bold;\">High Court, district courts, trial courts or specialised tribunals<\/span>; and<\/p>\n<\/li>\n<li>\n<p>have attained <span style=\"font-weight: bold;\">40 years of age<\/span>, unless the Full Court relaxes the age requirement.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The minimum standing requirement for practising advocates will not apply to <span style=\"font-weight: bold;\">former Delhi Higher Judicial Service officers who have at least 10 years of cumulative experience as Delhi Higher Judicial Service officers and\/or practice at the Bar<\/span>.<\/p>\n<\/li>\n<li>\n<p>Any form of <span style=\"font-weight: bold;\">canvassing for designation<\/span> will disqualify a candidate from being designated as a Senior Advocate.<\/p>\n<\/li>\n<li>\n<p>Advocates may be considered for designation either:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>suo motu by the Full Court; or<\/p>\n<\/li>\n<li>\n<p>on an application submitted by the advocate.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>After receiving applications, the Permanent Secretariat will publish the names of the applicants on the High Court&#8217;s website and invite <span style=\"font-weight: bold;\">suggestions from other stakeholders within four weeks<\/span>.<\/p>\n<\/li>\n<li>\n<p>Retired Delhi Higher Judicial Service officers, as well as officers who have voluntarily retired after completing 10 years of service in the Delhi Higher Judicial Service, may submit a request for designation as Senior Advocate at any time, along with the prescribed consent-cum-personal information sheet. However, such a request will not be considered where the applicant has accepted or consented to accept a full-time assignment, or for as long as the applicant holds such assignment.<\/p>\n<\/li>\n<li>\n<p>After the Permanent Secretariat compiles the relevant information, eligible applications are placed before the Full Court.<\/p>\n<\/li>\n<li>\n<p>While considering designation, the Full Court may take into account qualities including:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>fairness while conducting cases before courts;<\/p>\n<\/li>\n<li>\n<p>respectful behaviour towards judges and members of the Bar;<\/p>\n<\/li>\n<li>\n<p>maintenance of courtroom decorum;<\/p>\n<\/li>\n<li>\n<p>acting first as an officer of the Court and thereafter as a representative of the client;<\/p>\n<\/li>\n<li>\n<p>adherence to high standards of professional etiquette and ethics;<\/p>\n<\/li>\n<li>\n<p>mentoring of junior advocates;<\/p>\n<\/li>\n<li>\n<p>undertaking <span style=\"font-weight: bold;\">pro bono work<\/span>; and<\/p>\n<\/li>\n<li>\n<p>respect within the legal fraternity<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The rules seek to promote an inclusive designation process by encouraging equal opportunity across <span style=\"font-weight: bold;\">different sections of the Bar<\/span> and supporting <span style=\"font-weight: bold;\">first-generation advocates<\/span>.<\/p>\n<\/li>\n<li>\n<p>The rules expressly provide that the Full Court is not required to record reasons for its decision on designation.<\/p>\n<\/li>\n<li>\n<p>The Full Court will endeavour to decide designation matters by <span style=\"font-weight: bold;\">consensus<\/span>, failing which the matter may be decided by voting, with the Full Court determining whether voting should be by <span style=\"font-weight: bold;\">secret ballot<\/span>; where voting takes place, a <span style=\"font-weight: bold;\">two-thirds majority of the Judges who have voted<\/span> is required.<\/p>\n<\/li>\n<li>\n<p>Upon approval by the Full Court, the <span style=\"font-weight: bold;\">Chief Justice will formally designate the advocate as a Senior Advocate<\/span> under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543807\" target=\"_blank\">16(2)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002806286\" target=\"_blank\">Advocates Act, 1961<\/a>.<\/p>\n<\/li>\n<li>\n<p>The designation will be notified to the Supreme Court, Bar Council of India, Bar Council of Delhi, all High Courts, Principal District and Sessions Judges, and relevant tribunals.<\/p>\n<\/li>\n<li>\n<p>The Full Court&#8217;s final decision on designation will be communicated individually to each applicant.<\/p>\n<\/li>\n<li>\n<p>If an application is rejected, the concerned advocate will remain ineligible for reconsideration for a period of two years from the date of the decision.<\/p>\n<\/li>\n<li>\n<p>The <span style=\"font-weight: bold;\">Full Court retains the power to recall a Senior Advocate designation<\/span> if the advocate is found guilty of conduct that renders continuation of the designation inappropriate, after providing an opportunity of hearing.<\/p>\n<\/li>\n<li>\n<p>Rule 13 repeals the <span style=\"font-weight: bold;\">High Court of Delhi Designation of Senior Advocate Rules<\/span> notified on 14 March 2024, while preserving actions already taken under those rules.<\/p>\n<\/li>\n<li>\n<p>The notification also introduces detailed application formats for:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Advocates seeking designation as Senior Advocate; and<\/p>\n<\/li>\n<li>\n<p>Retired judicial officers from the Delhi Higher Judicial Service.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The forms require disclosure of, among other things:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>years of practice;<\/p>\n<\/li>\n<li>\n<p>judgments argued;<\/p>\n<\/li>\n<li>\n<p>pro bono work;<\/p>\n<\/li>\n<li>\n<p>publications and teaching experience;<\/p>\n<\/li>\n<li>\n<p>annual income for the previous three years;<\/p>\n<\/li>\n<li>\n<p>prior applications for senior designation;<\/p>\n<\/li>\n<li>\n<p>FIRs or litigation involving the applicant; and<\/p>\n<\/li>\n<li>\n<p
