Addressing the FIDIC Global Infrastructure Conference<\/span>, 2026 on 14 September 2026 in New Delhi on the theme “The Rule of Law and the Architecture of Infrastructure Delivery<\/span>”, Justice Surya Kant, the Chief Justice of India welcomed the delegates from more than 70 countries<\/span>. The CJI highlighted the close relationship between infrastructure development, contractual frameworks and the Rule of Law. He observed that while engineers, contractors and lawyers may view infrastructure projects differently, their ultimate impact is felt directly by the common man. He underscored that infrastructure delivery matters deeply as it directly impacts the lives of millions.<\/span><\/p>\n

\"\"<\/p>\n

The CJI observed that the highest compliment an infrastructure project could receive was silence, as a bridge that attracts no attention was generally one performing its function effectively<\/span>. It only gains sudden voice, usually a very loud and unhappy one, when the structure fails, or when the project is delayed. The CJI emphasised that beyond the visible achievements of infrastructure, its success depended equally on the underlying system of contracts, procurement, regulation, financing and institutions.<\/p>\n

Rule of Law as part of the architecture of infrastructure delivery<\/p>\n

The Chief Justice observed that the Rule of Law extends beyond the ability of courts to correct an error at the end of a project. It also requires processes to be designed in a manner that keeps expectations clear, defines powers properly, allocates risks fairly and provides disagreements with a credible and timely path to resolution.<\/p>\n

He emphasised that infrastructure projects are inherently exposed to uncertainty, including unexpected ground conditions, regulatory changes and circumstances beyond the parties’ control. The critical question, therefore, is whether the contract has placed such uncertainty with the party best equipped to understand and manage it.<\/p>\n

Contracts must create a shared understanding of risk<\/p>\n

Highlighting the importance of contractual risk allocation, the Chief Justice stated that infrastructure projects are preceded by an elaborate contractual structure comprising financing agreements, engineering, procurement and construction contracts, insurance arrangements, government concessions and standard forms.<\/p>\n

He observed that an incorrect allocation of risk could lead contractors to price defensively while governments may end up carrying risks they are not best placed to bear, eventually resulting in arbitration or litigation. A well-drafted contract<\/span>, he said, must therefore do more than record the commercial bargain, it should create a shared understanding of how parties will respond when unforeseen circumstances affect a project.<\/span><\/p>\n

Dispute resolution should begin before the dispute<\/p>\n

Recalling an example from the early years of a major Indian urban infrastructure project, the CJI highlighted importance of resolving disagreements at the site level, within days, before they developed into formal claims. He observed that early intervention, frank communication and swift determination could prevent disputes from becoming entrenched. In his view, dispute resolution should not merely function as an emergency exit for a failed project but should form part of the ordinary governance of a successful one.<\/span><\/p>\n

While affirming the role of courts as the ultimate guarantors of legality and enforceability, he observed that the success of a legal system should not be measured only by its ability to resolve disputes after they arise<\/span>; institutions surrounding infrastructure projects must also be assessed by their ability to prevent disputes from arising in the first place.<\/span><\/p>\n

“From retrospective justice to preventive justice”<\/p>\n

Calling for a shift “from retrospective justice to preventive justice”<\/span>, the CJI stated that contractual and institutional frameworks should enable disagreements to be identified and addressed before they become disputes through communication and dispute-avoidance mechanisms. He observed that the finest compliment to a dispute-resolution mechanism<\/span> is not that it has resolved numerous disputes, but that the project it serves has had little need to use it<\/span>.<\/p>\n

Standardisation can provide a common language for global infrastructure<\/p>\n

Turning to standardisation<\/span>, the CJI noted that infrastructure projects increasingly involve participants across jurisdictions, with capital, engineering expertise, construction capacity and the asset itself often connected to different countries. He emphasised that standardisation could reduce uncertainty by providing a familiar contractual framework<\/span> for matters such as payment, variations, extensions of time, unforeseen conditions and dispute resolution. At the same time, he cautioned that no single contractual form could suit every project or jurisdiction, as local laws, capacities and circumstances would necessarily differ.<\/p>\n

According to him, standardisation should provide a familiar basic contractual structure while leaving sufficient room to accommodate project-specific realities. It could thereby give an Indian contractor, European lender, African government and Asian consultant a shared vocabulary for understanding risk, responsibility and remedy<\/span>, regardless of the location.<\/p>\n

India’s infrastructure expansion requires stronger contractual and dispute frameworks<\/p>\n

Observing that India is undertaking infrastructure development<\/span> at a scale and pace without real precedent in its past<\/span>, the CJI stated that the ambition cannot simply be to build more, but to build faster, more resiliently, more sustainably and more productively<\/span>.<\/p>\n

He stressed that world-class engineering and innovative financing, although necessary, are not sufficient. The infrastructure ecosystem also requires contracts that create confidence rather than confrontation, procurement systems that reward genuine value rather than merely the lowest number, and dispute frameworks capable of resolving disagreements at the pace required by the project.<\/p>\n

Five priorities for infrastructure governance<\/p>\n

The CJI called upon stakeholders from government, industry and the legal profession to give sustained attention to:<\/p>\n

    \n
  1. \n

    clarity of obligations<\/p>\n<\/li>\n

  2. \n

    balanced allocation of risks<\/p>\n<\/li>\n

  3. \n

    sensible standardization<\/p>\n<\/li>\n

  4. \n

    early dispute avoidance, and<\/p>\n<\/li>\n

  5. \n

    swift and independent resolution where disputes cannot be avoided.<\/p>\n<\/li>\n<\/ol>\n

    He emphasised that these principles are not merely legal technicalities confined to the fine print of contracts, but are, in the fullest sense, instruments of good governance.<\/p>\n

    “The real measure of success” is fewer disputes<\/p>\n

    Concluding his address, the CJI reiterated that the Rule of Law is not only about correcting what has gone wrong but also about creating conditions for things to go right.<\/span><\/p>\n

    The CJI observed that the real measure of success is therefore not simply how quickly disputes are resolved, but how well projects are designed so that fewer disputes arise in the first place. He expressed the hope that the participants of the Conference would carry this philosophy to their projects and countries, contributing not merely to better contracts but to institutions worthy of the infrastructure they protect and infrastructure worthy of the people who use it.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
