The Court noted that the petitioner had appeared before the trial court, participated in the proceedings, had charges framed in his presence, cross-examined the prosecution witnesses and had his statement recorded under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804074\" target=\"_blank\">351<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a> [Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519590\" target=\"_blank\">313<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">Criminal Procedure Code, 1973<\/a> (CrPC)], without raising any objection regarding denial of pre-cognizance hearing.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Also Read:<\/span> <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/04\/08\/cognizance-under-bnss-del-hc-flags-conflict-refers-issue\/\" target=\"_blank\">Delhi HC Raises Key Question on BNSS Cognizance, Seeks Larger Bench Clarity<\/a><\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">The petitioner challenged order dated 26 April 2025 by which the Special Judge, Prevention of Corruption, CBI West\/Enforcement Directorate (ED), Lucknow took cognizance of offences under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001534450\" target=\"_blank\">3<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001534461\" target=\"_blank\">4<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801311\" target=\"_blank\">PMLA<\/a>, directed compliance with Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519457\" target=\"_blank\">207<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519458\" target=\"_blank\">208<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">CrPC<\/a> and issued summons. He contended that the order was passed without granting him an opportunity of hearing, contrary to the proviso to Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803932\" target=\"_blank\">223(1)<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a>, relying on <span style=\"font-style: italic;\">Parvinder Singh<\/span> v. <span style=\"font-style: italic;\">Enforcement Directorate<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/vHMRmNCy\" target=\"_blank\">2026 SCC OnLine SC 903<\/a> and <span style=\"font-style: italic;\">Kushal Kumar Agarwal<\/span> v. <span style=\"font-style: italic;\">Enforcement Directorate<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/BBpA6830\" target=\"_blank\">2025 SCC OnLine SC 1221<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">The ED opposed the challenge, submitting that the petitioner had appeared before the trial court, participated in framing of charges, cross-examined all prosecution witnesses and had his statement recorded under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804074\" target=\"_blank\">351<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a>, while the trial had reached the stage of final submissions. The petitioner attributed the delay to a change of counsel, stating that his subsequent counsel noticed the alleged defect while preparing for final arguments.<\/p>\n<p style=\"font-weight: bold;\">Analysis<\/p>\n<p style=\"margin-bottom: 3%;\">At the very outset, the Court opined that since the petitioner did not object to being deprived of an opportunity of hearing before cognizance was taken, despite appearing before the trial court, and thereafter participated in the trial where charges were framed, the 2 prosecution witnesses were examined and cross-examined on his behalf, and his statement under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804074\" target=\"_blank\">351<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a> (Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519590\" target=\"_blank\">313<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">CrPC<\/a>) was recorded, the challenge raised only after the matter had been fixed for final submissions could not be entertained.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court found that the petitioner had availed the opportunity of hearing at the subsequent stages of the trial and, in the absence of any prejudice caused to him by the order dated 26 April 2025, the belated challenge to the cognizance order was not maintainable.
