Kindly tell our readers about your journey in the legal field. How did your law school years shape your outlook?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">My legal education began in Jabalpur at the Rani Durgavati Vishwavidyalaya Law Faculty. It was a small town, far from the metropolitan law school circuit. Intellectual property was not even an elective when I studied there; it barely registered as a field. What shaped me was not so much what I was taught in the classroom as what I discovered once I began practising. The mandatory one-year training requirement during the initial days meant that I was learning law in real time, from cases and clients rather than from textbooks alone. After enrolling with the Bar Council, I stumbled into the world of intellectual property (IP) and I have never looked back.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">2. What inspired you to found ADP Law Offices, and how did your earlier stints at Saikrishna &amp; Associates, Luthra and Luthra and Anand &amp; Anand shape your vision for this new venture?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">The concept that &#8220;Law firms take more from you than they give&#8221; is completely wrong. That has not been my experience at all. Each firm I worked with shaped me as a professional, as a person, and as a lawyer in distinct and lasting ways. At Anand &amp; Anand, under Mr Pravin Anand, I gained my foundational grounding in IP practice. Luthra and Luthra gave me my first real exposure to the commercial side of legal work. At Saikrishna I learned how to be better lawyer and become a leader building practices and client relations construct matters and legal strategies. All these law firms I worked with made me what I am today as a professional.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">The decision to set up ADP Law Offices was not a grand strategic plan. It was a spur-of-the-moment decision, and if anything, I sometimes think I should have done it ten years earlier as I would have been younger and had more energy. There is something genuinely exhilarating about building something from the ground up. I would encourage every lawyer in a law firm to explore this at some point in their career. You do not fully appreciate the value of building until you have laid the bricks yourself.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">3. Right now, law students go behind Tier 1, but main experience comes from boutique firm where you get to learn it all? What is your opinion on it?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">The conversation around Tier-1 firms is understandable, but I think it is often misframed. The distinction between a Tier-1 firm and a smaller or boutique practice is not fundamentally about the quality of legal work being done. It is about the kind of exposure you will get and, critically, how quickly you will be given meaningful responsibility. Tier-1 firms offer outstanding training in their own way, and I do not diminish that. But there is an enormous amount to be gained from boutique practices, where you are not one of many associates on a matter but are often the person who must make the call.<\/p>\n<p style=\"margin-left: 36pt; margin-bottom: 3%;\">&#8220;The ability to take decisions on your own judgement, on your own shoulders &#8212; that is the defining skill of a good lawyer. The earlier you develop that muscle, the better.&#8221;<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">4. Could you walk us through a few defining moments in your nearly 3-decade long career that influenced your decision to specialise in IP, technology, media, and telecommunications (TMT) and media law?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">This is a hilarious story; I was convinced that I am joining a real estate firm as property word was mentioned. I had no idea of IP as in smaller schools, it was not even an elective. This field was not a thought-out decision but luck or fate plays amazing role in lives as I have never regretted this decision. This field is an immense, vast, constantly growing and evolving field of discipline. It particularly changes with tech interface.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">5. You have advised major global technology companies, including some of the world&#8217;s largest consumer-tech brands. What is it like navigating the legal expectations and pressures of such high-stakes clients?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Working with global companies is simultaneously one of the most demanding and most rewarding aspects of my practice. These clients come with an extensive international experience; they have worked with the best legal minds across jurisdictions, and their expectations of legal work product are correspondingly high. My learning curve has been steep, and I mean that in the best possible way. Working at the high-stake demands kind of positive perspective which requires you to be innovative as opposed to run-of-the-mill advise.<\/p>\n<p style=\"margin-left: 36pt; margin-bottom: 3%;\">&#8220;There is no room for the &#8216;chalta hai&#8217; approach. Working with global companies demands comparative legal analysis and the ability to innovate in how you think about the law.&#8221;<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">6. You have testified before parliamentary committees and have been involved in policy reform, how do you see the role of law firms like ADP in shaping India&#8217;s tech, media, and IP policy landscape? What are the &#8220;needs of the hour&#8221;?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">The role of lawyers in policy is one that can be both criticised and celebrated, sometimes simultaneously and I believe that policy lawyers play an indispensable part as long as objective is broader whether representing clients or the government. There should be effort to be to look at lengths of national interest, smaller business, and aging with larger businesses. Good policy advice is not a mirror of client preference; it is grounded in an understanding of how industries are actually structured, how interdependencies work, and what the downstream consequences of legislative choices will be. One should learn and keep up with the latest thought process even if you and clients do not agree with it. Good policy lawyers understand not just their own client&#8217;s position, but the full landscape of perspectives that will shape the final outcome.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">7. The 2012 Amendments to the Copyright Act are often described as a turning point, especially for authors, composers and performers. From your experience, what were the key forces that pushed India toward such a significant overhaul? Could you share the backstory behind what really led to the 2012 Amendments and how those debates continue to shape copyright policy today?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Two aspects of the 2012 Amendments stand out for me. The first was the political: The Bill passed with a unanimous vote in both Houses of Parliament which is a remarkable feat for any legislation, and a testament to how compelling the underlying argument was. The objective of the amendments was to create a unique and robust system of protection for authors and artists working in the film and music industries, who had long been left behind by the existing framework. The goal was to ensure that creators held a non-waivable, non-assignable right to royalty that no contract could take away. No country had gone as far in enshrining that principle.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">The second aspect was perhaps more novel, and one I am particularly proud of the role that economic analysis played in the parliamentary process. Rather than relying solely on the emotional and moral arguments about fairness to creators (compelling as those were), but a detailed economic analysis was presented to the Standing Committee. That analysis demonstrated that the existing contractual practices in the music and film industries created a monopsony. It has been more than a decade on, the results speak for themselves. India&#8217;s music industry has grown at double-digit rates; by some estimates it is valued at approximately 47 billion dollars. The royalty collection societies are now collecting hundreds of crores annually.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">8. How do you view the role of legal research platforms like SCC OnLine and AI-based tools in transforming how lawyers work today?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Technology has never been a destroyer of legal careers, it has always been a transformer of how legal work gets done. When I began practising, transcribing was done by stenographers. Then laptops arrived, and the profession adapted. AI is another chapter in that same story, and the lawyers who treat it as a threat are missing the opportunity it presents. My view is that AI should be understood as a lever, a way to shorten the learning run way for younger lawyers, to compress the time spent on reading long judgments, and to sharpen the precision with which we can analyse pleadings and the positions parties have taken in complex litigation.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">A junior lawyer who is empowered by AI tools, rather than replaced by them, can do in hours what once took days. That is a profound opportunity. The important caveat is that these tools are still in an active phase of development. They are prone to inaccuracies, and a lawyer who relies on AI-generated outputs without independent verification is taking a significant professional risk. Cross-checking sources, verifying citations, and maintaining critical distance from the output are non-negotiable. But used responsibly, AI will free lawyers from the most mechanical aspects of the work and give them more time for the things that require genuine legal judgment.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">9. Beyond IP and persona-rights, AI raises broader societal risks such as algorithmic bias, opaque decision-making, misinformation, surveillance, and governance failures. Based on your experience on AI policy committees, do you think India is moving toward a codified framework or will doctrine continue to evolve case-by-case?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">The pace of AI development is simply too rapid for any legislative framework to remain fully current. Courts and tribunals will inevitably be called upon to resolve questions that lawmakers did not anticipate and could not have foreseen. That is the nature of transformative technology.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">That said, I am a firm believer that broad legislative frameworks are not merely desirable but essential. Questions of copyrightability and authorship in AI-generated works, liability for autonomous systems, and the future of safe harbour doctrine in the context of agentic AI will all require legislative responses. The case-by-case approach will address immediate disputes, but it cannot substitute for the policy clarity that a comprehensive legislative framework provides.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">10. Dynamic injunctions have become central to tackling fast-moving online infringement, including pre-release &#8220;dynamic+&#8221; injunctions. How effective are they, and what risks do they pose in terms of proportionality, over-blocking, enforceability, in a rapidly changing tech environment?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">The central justification for dynamic injunctions lies in a fundamental reality of online piracy where the defendants are frequently offshore entities, operating beyond the practical reach of domestic enforcement, while their infringing platforms maintain a very real and pervasive presence for users in India. Dynamic injunctions were crafted to address that asymmetry, to block access to rogue websites even when their operators cannot be brought before the court in any conventional sense.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Its underlying foundational aspect was twofold one to block access to offshore rogue websites but now applied to goons and other aspects as well. Second being that this injunction recognises that defendants often change clothes\/colour\/name and location and in order to keep up with them one cannot go back to court always, the court crafted balanced quasi-judicial administrative process where this changes in identity of defendants and modus of defendants can be tracked and brought to the notice of court and injunction can cover these additional or post-facto activities. But it is criticised in some case rightly as judicial overreach and overkill as too much power in the hands of IP owner, as the IP laws are based on premise of access and ultimate balance of competing interest but positives are more than harms in case of dynamic injunction.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">11. How do you assess India&#8217;s current regulatory framework on data protection, and does the Digital Personal Data Protection Act adequately address the risks posed by AI and emerging technologies?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">India&#8217;s journey to a data protection framework began with the Supreme Court&#8217;s landmark 2017 judgment in <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002748027\" target=\"_blank\"><span style=\"font-style: italic;\">K.S. Puttaswamy<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span><\/a><a id=\"fnref3\" href=\"#fn3\" title=\"3. (2017) 10 SCC 1.\"><sup>2<\/sup><\/a>, which recognised privacy as a fundamental right and made clear that any restriction to be based on Parliament made law. The <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001593555\" target=\"_blank\">Digital Personal Data Protection Act, 2023<\/a> (DPDP Act), which eventually emerged from that mandate, is a mixed picture. On one hand, the government has opted for what it describes as a &#8220;light touch&#8221; approach. From a purely textual standpoint, the Act is indeed relatively compact compared to, say, the European General Data Protection Regulation (GDPR). But light touch in the text does not mean light touch in practice, if the operative provisions are substantially delegated to rule-making rather than in the statute itself. Rule-making is not subject to the same degree of parliamentary scrutiny as primary legislation; it can move faster, but it also introduces uncertainty.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">More fundamental concern, however, is the scope of the exemptions that the government has carved out for itself. The <span style=\"font-style: italic;\">Puttaswamy<\/span> judgment was explicit that any restriction on the right to privacy must be proportionate and must be arrived at through clearly defined legislative means. The exemptions that the DPDP Act currently extends to government bodies go well beyond what the constitutional framework permits, in my view. The consequences are adverse impact on investigative journalism, right to information regime, journalistic endeavours have all been weakened as a result. That is a serious concern, and one that the legislature will need to revisit.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">12. If you were not a lawyer, what do you think you would be doing, especially given your interest in media and technology?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">I would have joined the Army, without question. I grew up certain that I would follow my father and join a family tradition stretching back four generations. Beyond that, I have always been drawn to journalism, looking at facts, analysing them down, it is such a wonderful profession in terms of illuminating facts that people do not have time to breakdown.<\/p>\n<\/div>\n<hr\/>\n<p style=\"margin-left: 18pt; text-indent: -18pt;\"><a id=\"fn1\" href=\"#fnref1\">1.<\/a> Founder and Managing Counsel of ADP Law Offices.
