The Court, pursuant to its earlier order dated 5 August 2026, the High Courts and the State Governments/Union Territory (UT) Administrations had been called upon to place their respective positions before the Court concerning enhancement of the retirement age of judicial officers.

State/UT’s Response

On consideration of the responses, the Court found that the High Courts were, by and large, ad idem that the age of superannuation of judicial officers should be enhanced from 60 years to 62 years. At the same time, some High Courts suggested that continuation beyond the existing age of superannuation should not be automatic but should depend upon an assessment of the officer’s performance, fitness or suitability.

The responses of the State Governments and UT Administrations were varied as while some State Governments accepted the recommendations of their respective High Courts for enhancement, others either sought further time or opposed the proposal. The principal objections raised were that enhancement would impose an additional burden on the State exchequer, cause “heartburn amongst other employees in the service of the State”, and affect the legitimate aspirations of younger persons seeking entry into the judicial services.

Analysis

At the outset, the Court noted the Amicus Curiae’s submission that the age of superannuation of judicial officers had last been enhanced in 1992. The 1992 decision had led the Union of India and various States to file Review Petitions, culminating in the Court’s detailed findings in All India Judges’ Association v. Union of India, (1993) 4 SCC 288. The Court had observed that the failure to appreciate the distinction between the judicial service and other services lay at the root of the resistance to the directions concerning judicial service conditions. “The judicial service is not service in the sense of ‘employment’. The Judges are not employees. As members of the judiciary, they exercise the sovereign judicial power of the State. They are holders of public offices in the same way as the members of the council of ministers and the members of the legislature.”

The Court in earlier judgment, rejected the argument that improvement in judicial service conditions would inevitably trigger similar demands from other Government employees and held that there could be no link between the service conditions of Judges and those of members of other services. Further, the Court rejected the contention that increasing the retirement age would place an excessive financial burden upon State exchequers. The Court had also rejected the argument that enhancement of retirement age would adversely affect employment conditions. It noted that there were approximately 10,000 judicial posts across India, and that many retired judicial officers subsequently entered quasi-judicial or administrative tribunals. Therefore, the Court had found no merit in the objections to enhancement of the retiring age.

The Court observed that more than 3 decades had passed since the earlier pronouncements. During that period, the sanctioned strength of the judicial service in most States had increased, while a substantial number of posts continued to remain vacant because of the non-availability of eligible candidates. It emphasised that induction of competent judicial officers was a sine qua non for preservation of an independent judiciary, which itself formed part of the basic structure of the Constitution. “Judicial officers constitute a specialised cadre, distinct and independent from the other categories of employees in the service of the State.”

The Court held that the appointment and conditions of service of judicial officers fall under the direct constitutional control of the respective High Courts, particularly under Articles 233 and 235 of the Constitution [Shamsher Singh v. State of Punjab, (1974) 2 SCC 831]. Thus, this constitutional position, other State employees could not claim parity with members of the judicial service. Consequently, the States’ apprehension regarding “heartburn amongst other categories of employees is wholly unfounded”. The Court likewise rejected the apprehension regarding additional financial burden.

“…an increase in the age of superannuation would enable the State to retain the services of experienced officers, while simultaneously effecting substantial savings on the post-retirement benefits that would otherwise become payable upon their superannuation.”

The Court appreciated that almost all High Courts had agreed to enhance the age of superannuation from 60 to 62 years, and several States had also changed their earlier position in favour of enhancement.

The Court reiterated that the source of recruitment, nature of duties and the constitutional power of appointment and superintendence exercised by the High Courts clearly distinguish judicial officers from other State employees. It held the concerns regarding disruption of other services or civic administration to be “wholly extraneous to the issue at hand”, which is the efficient administration of justice.

The Court rejected the argument that enhancement would impose an additional financial burden upon the States. Since other State employees have no legal parity with judicial officers, the retirement age of the latter cannot be withheld merely because other employees may raise an unjustified demand for similar treatment.

“Were members of the judicial cadre to superannuate at the age of 60 instead of 62, the State would stand burdened with the responsibility of paying the post-retiral dues of such 32 superannuated officers, in addition to the salary of those newly appointed in their place. On the contrary, if experienced members of the judicial cadre are permitted to continue in service till the age of 62, the additional burden of bearing such post-retiral dues would stand correspondingly postponed.”

The Court noted the submission that recruitment exercises in several States had failed to fill the sanctioned strength adequately, resulting in a “yawning gap” between sanctioned and working strength. The Court opined that same reasoning “applies with full force to the judicial service” and supports enhancement of the retirement age. The Court also took note of the fact that the Shetty Commission had made a similar recommendation, though it had not earlier been accepted in All India Judges’ Association (3) v. Union of India, (2002) 4 SCC 247.

The Court acknowledged that maintaining an age differential between the High Court and District Judiciary could constitute a legitimate expectation in the superior judiciary. But, “the crying need of the hour is to ensure that the attrition of the experienced judicial talent be arrested so that the gap between the sanctioned and the working strength in the judicial service is reduced, and access to justice does not remain a mere chimera due to unfilled posts”. In this context, the Court requested the High Courts and States to reconsider enhancement of the superannuation age of the District Judiciary.

The Court observed that most High Courts had agreed to enhancement and appreciated the safeguards suggested by some of them. Continuation beyond 60 could be made subject to assessment of judicial work, thereby ensuring that “deadwood can be removed” and only competent officers of proven integrity continue in service. The Court considered this approach a proper balance as it would “preservation of experienced judicial officers, while removing the clog of deadwood, blocking the entrance of young blood invigorating the system”.

Directions

The Court issued following directions:

The State of Chhattisgarh, Karnataka, Madhya Pradesh, Maharashtra, Sikkim, Tamil Nadu and West Bengal, to amend their service rules to enhance the retirement age of District Judiciary officers from 60 to 62 years. The enhancement be subject to suitability/performance assessment at the age of 60 years by the concerned High Court, preferably within two months.

Pending amendment of the rules, officers who have attained 60 years shall not retire until 62, subject to such assessment.

Judicial officers who retired on or after 31 March 2026 in these States may opt to rejoin judicial service, provided they have not taken subsequent employment or held an office of profit under the Union/State Government. Such reappointment should carry consequential pay, seniority and continuity, subject to suitability/performance assessment and surrender of post-retirement benefits already received.

The remaining States/UTs were directed to reconsider their decisions on enhancement from 60 to 62 years in light of the Court’s earlier order and the present order, and submit compliance within 2 weeks.

Listed the matter for further consideration on 1 October 2026.

Also Read: SCBA expresses concern on lack of women Judges in higher judiciary; Requests CJI, Collegium to consider more women for upcoming judicial appointments

[All India Judges Association v. Union of India, 2026 SCC OnLine SC 1784, decided on 1-9-2026]

Advocates who appeared in this case:

For the Petitioner: Mr. Siddharth Bhatnagar, Sr. Adv., AmicusCuriaeMr. Ankit Yadav, AOR Mr. Aditya Sidhra, Adv.
