The Gujarat High Court Arbitration Centre (Domestic & International) (GHAC)<\/strong>, in collaboration with the Gujarat High Court<\/strong>, is holding the GHAC Arbitration Week 2026<\/strong>, a three-day programme dedicated to strengthening Gujarat\u2019s institutional arbitration ecosystem and promoting the State as a leading destination for efficient, credible and institutionally driven dispute resolution.<\/p>\n

The opening ceremony was held on 3 September 2026, ahead of the main three-day programme running from 4 September to 6 September 2026 at the prestigious GIFT City Club, Gandhinagar, on the theme \u201cBuilding Gujarat\u2019s Institutional Arbitration Ecosystem\u201d<\/em><\/strong>. The event is envisaged as a significant platform for dialogue, professional engagement and knowledge exchange among the judiciary, legal profession, business and industry community, arbitrators and arbitral institutions.<\/p>\n

On Day 2 of the event, Mr. Vijaya Kumar Rajah SC,<\/strong> Former Judge, Court of Appeal, Supreme Court, Singapore, Former Attorney General of Singapore, Vice President ICC International Court of Arbitration, delivered a guest speaker address.<\/p>\n

Beginning his address with appreciation for Ahmedabad’s infrastructure, Mr. Rajah commented that the government and community of Gujarat seemed to have the ability to dream big and execute those dreams. This ambition makes the goal of making GHAC a preferred arbitration centre eminently achievable.<\/p>\n

 <\/p>\n

Global Landscape:<\/strong><\/p>\n

He stated that globally, the last 25 years have seen a fundamental rewriting of the international landscape. From only four recognised global dispute resolution hubs for the longest time, namely, Paris, London, Geneva, and New York, to several new additions of Asian dispute hubs like Singapore and Hong Kong. While the West achieved this naturally, the latter hubs had to execute their visions with immense nurturing and country-wide sustained efforts.<\/p>\n

\u201cTo build a credible arbitration ecosystem requires generational effort. It’s not going to happen in the next five to ten years. But the building blocks for these systems can be put in place now.\u201d<\/em><\/strong><\/p>\n

Mr. Rajah added that globally there had been two changes:<\/p>\n

    \n
  1. Disputes between Asian parties:<\/strong> Asian parties will likely resolve their disputes in Hong Kong, Singapore, or Dubai instead of Western seats. Creation of different ecosystems and a multipolar dispute resolution system was occurring, wherein parties and users decide to use governing laws that they think are neutral, make commercial sense, and go to seats where they can have consistency and predictability.<\/li>\n
  2. Seat and Governing Laws: <\/strong>Previously, arbitral seats and governing laws were being decided by big law firms or Magic Circle firms in Western countries like the UK or the USA, but there has been a rise of law firms in Asian countries like India, Korea, China, Singapore, etc. \u201cThe changes that will take place in the next two decades, by sheer force of gravitational pull of commerce, will come from China and India.\u201d<\/em><\/strong><\/li>\n<\/ol>\n

    Indian Landscape:<\/strong><\/p>\n

    Regarding India, he said that while India had issues similar to other jurisdictions, it was crucial to keep pace with the international ecosystem. Adding that India had the advantage of a demographic dividend, i.e., it produces many outstanding legal professionals, he urged young professionals to be heard and seen in the international fora. However, he argued that many established domestic professionals did not need to partake in international arbitration for lesser compensation.<\/p>\n

     <\/p>\n

    Reflecting on some articles written by Indian law students, he remarked that they were as good as articles published in international journals. He highlighted that Indian young professionals did not lack talent or bandwidth, but exposure, as he could not track down any law students whose articles he had read.<\/p>\n

     <\/p>\n

    He emphasised: \u201cYour most important asset is your people, and it is important that they receive the right exposure and the right education.\u201d<\/em><\/strong><\/p>\n

     <\/p>\n

    He argued that though India had faced issues, it had grown immensely in arbitration post 2012. There had been a remarkable change in mindset and legal precedents, but the path had been a \u201cjagged trajectory\u201d<\/em><\/strong>. He stated that though there were judicial decisions which could be criticised, it was important to undertake an interpretative analysis of the law in extreme circumstances.<\/p>\n

     <\/p>\n

    Furthermore, Mr. Rajah stated that the Indian arbitration community was well aware of its shortcomings, but there was a need for a community-wide, country-wide approach to solve them. These problems cause reputational damage to India; for example, the 2024 Government Order[1]<\/a> stated that state-owned entities should go to courts for disputes, rather than arbitration for disputes valued over Rs. 10 Crores. He argued that the government needed to be consistent in its stance; it cannot seek to become an arbitration hub or create arbitration centres while also saying that government companies were uncomfortable with it, and arbitration does not work for them.<\/p>\n

    \u00a0<\/em><\/strong><\/p>\n

    \u201cThe motivation to change that system is not going to come from within.\u201d<\/em><\/strong><\/p>\n

     <\/p>\n

    Thus, he opined that India had made considerable growth, but it was not enough.<\/p>\n

    How to build, maintain, and sustain a credible arbitration ecosystem:<\/strong><\/p>\n

    On arbitration ecosystems, he mentioned that the global competition was not just between arbitration centres, but also among several international commercial courts that were offering a range of services for resolving disputes.<\/p>\n

     <\/p>\n

    In this atmosphere, it was crucial to understand the importance of making Gujarat, or India, a credible arbitration hub. To illustrate his point, Mr. Rajah reflected on Singapore\u2019s journey. He remarked that Singapore\u2019s key assets were its integrity, innovativeness, and responsiveness to change, as it had limited ability to manoeuvre because its relevance was heavily tied to its utility for the regional and global community. Thus, Singapore’s focus on constant improvement was its key driving force.<\/p>\n

     <\/p>\n

    India, on the other hand, he remarked, solves its issues, but on its own timeline and in its own manner, which was not always appealing to foreigners. To be an attractive destination for foreign investments, India needed a credible arbitration ecosystem. Accordingly, Mr. Rajah demarcated the three factors of a credible arbitration ecosystem:<\/p>\n

      \n
    1. Education:<\/strong> He stated that students, professionals, and judges should continue learning, especially specialized education, to partake in international arbitration. He stated that, \u201cThe judges need more specialist education because you cannot come into international arbitration cold and solve problems without understanding the reservoir of knowledge, thinking, and history that has gone into particular and peculiar problems.\u201d<\/em><\/strong><\/li>\n
    2. Belief in its own mechanism:<\/strong> India and its corporations needed to trust its arbitration system. For this, he argued that the inefficiencies needed to be addressed and suggested publishing key performance indicators (KPIs), like average time taken for adjudication of Section 34 applications and keeping track of such KPIs.<\/li>\n<\/ol>\n

      1. The Bar and legal professionals: <\/strong>Apart from maintaining sustained education, Mr. Rajah recommended holding arbitrators accountable, as lawyers were regulated at a domestic level but not in international arbitration. He stated that despite resistance from Western seats, the global south countries were in favour of reassessing rules of accountability and procedures in arbitration.<\/li>\n<\/ol>\n

         <\/p>\n

        Although Asian countries like India, China, Japan and Korea were booming and growing economies, he opined that they lacked in terms of regulating and overseeing international interactions. Arguing that Asian countries often adopt the rules made by Western countries, he emphasised the need to remodel the international arbitration landscape, make the rules more sensible to the context, cut down costs, and improve efficiency. <\/em><\/strong>Thus, India and GHAC had to distinguish itself from other arbitration centres by setting standards for accountability and ethics of both counsel and arbitrators.<\/p>\n

         <\/p>\n

         <\/p>\n

        In his opinion, there are five essential components in the arbitration ecosystem: the government and regulators, the judiciary, the arbitral community, including both counsel and arbitrators, the users, and educational infrastructure. For these five components to succeed in making GHAC a preferred arbitration hub, there were some key steps:<\/p>\n

          \n
        1. Distinguish your arbitration centre from other arbitration centres.<\/li>\n
        2. Become the first name, i.e., the preferred place for domestic arbitration.<\/li>\n
        3. Build capacity by equipping young professionals, experienced practitioners, and judges with the best practices and arbitration culture.<\/li>\n<\/ol>\n

          Mirage or probability? <\/strong><\/p>\n

          Concluding by answering the question that he set out for the GHAC\u2019s success, Mr. Rajah stated that the leadership, people, and ambition were impressive. He remarked that the people he had interacted with were serious and ambitious, with capacious minds that would rank them among global thought leaders. According to him, such an environment would probably make GHAC a successful arbitration institute and hub, not a mirage.<\/p>\n\n
