Venkatramani, Attorney General for India; and Justice Manmohan, Judge, Supreme Court of India.

The ceremony also witnessed the announcement and signing of an MoU with the Singapore Corporate Counsel Association, reflecting an important step towards collaboration in GCAI’s internship programme and the broader India—Singapore legal partnership.

India and Singapore are “extraordinarily natural partners”: Dr. Sanjeev Gemawat

Welcoming the distinguished guests and participants, Dr. Sanjeev Gemawat described the India—Singapore Legal Bridge as an initiative founded on the recognition that India and Singapore, despite being very different nations, are extraordinarily natural partners.

According to him, India brings scale, talent, enterprise, technology, manufacturing capacity and significant growth opportunities, while Singapore brings connectivity, capital, institutional excellence, global credibility and the ability to connect businesses and markets. The coming together of these complementary strengths, he observed, creates an opportunity greater than the sum of the two parts.

Dr. Gemawat emphasised that the most exciting chapter of the India—Singapore relationship lies ahead. The next phase of the partnership, he noted, will increasingly be shaped by technology, artificial intelligence, digital commerce, financial services, energy transition, infrastructure, logistics and regional supply chains. Singapore, he said, is a natural gateway for India into Asia and the wider Asia-Pacific region, while India provides Singapore with a gateway into South Asia and one of the world’s largest and most dynamic growth markets.

The relationship, therefore, should increasingly be viewed not merely as a bilateral partnership but as an important regional growth corridor.

Law is central to the growth story

Addressing the role of law in this expanding economic relationship, Dr. Gemawat posed a fundamental question: What does law have to do with this growth story? His answer was unequivocal -“everything”.

Businesses, he observed, do not invest merely because opportunities exist. They invest when opportunities are accompanied by confidence, and confidence depends upon credibility. Clear laws, credible institutions, regulatory certainty, respect for contracts and effective mechanisms for resolving disputes are therefore increasingly becoming factors of economic competitiveness.

Businesses today ask practical questions about whether they can invest with confidence, enforce their contracts, obtain urgent protection, resolve disputes efficiently and enforce the resulting outcomes. These, he stressed, are no longer merely legal questions; they are questions of trade, investment and economic growth.

It is in this context that the convergence of the legal ecosystems of India and Singapore assumes significance. Such convergence, Dr. Gemawat clarified, does not mean uniformity. Neither country needs to become a copy of the other. Rather, convergence means greater compatibility, cooperation and mutual understanding, reducing friction for businesses operating across jurisdictions and enabling legal institutions, lawyers and general counsel to better understand each other’s legal and commercial realities.

The objective, he said, is ultimately to make law an enabler of commerce rather than merely a responder to disputes.

Dispute resolution as commercial infrastructure

Dr. Gemawat further observed that every major commercial corridor requires a credible dispute-resolution architecture. Businesses assess dispute resolution not merely through legal concepts but through practical considerations: how long the process will take, what it will cost, whether emergency relief can be obtained, whether parallel proceedings can be managed and whether outcomes can be effectively enforced.

The future of dispute resolution, he said, cannot simply be framed as a choice between litigation, arbitration and mediation. Businesses may require litigation in some circumstances, arbitration in others, mediation in others and, increasingly, carefully designed combinations of all three.

Dispute-resolution clauses, therefore, can no longer be treated as boilerplate provisions. They are commercial infrastructure, determining what happens when a business relationship comes under stress.

India and Singapore possess complementary strengths in this regard. Singapore has developed a trusted international dispute-resolution ecosystem, while India brings highly skilled legal professionals and a rapidly expanding commercial and institutional arbitration ecosystem. The future, Dr. Gemawat stressed, should therefore not be seen in terms of competition between jurisdictions but in terms of collaboration and complementarity.

With the economic centre of gravity increasingly shifting towards Asia, trade becoming increasingly intra-Asian, investment flowing within the region and supply chains becoming more regional, dispute resolution must increasingly reflect the realities of Asian commerce. India and Singapore, he said, can together play an important role in shaping that future.

GCAI’s larger ambition: a trusted India—Singapore legal and business corridor

Speaking about GCAI, Dr. Gemawat said that the Association was founded on a simple belief: the voice of a business lawyer must be part of the conversation about the future of the country.

General counsel, he noted, occupy a unique position at the intersection of law and business. They understand legal risks as well as commercial realities and are often able to identify risks before they become disputes and regulatory uncertainty before it affects investment.

GCAI seeks to bring together the judiciary, government, industry, regulators, lawyers, arbitrators, academicians and innovators, with the objective of strengthening legal institutions, facilitating investment and trade, advancing dispute resolution, encouraging legal innovation and building global collaboration.

The India—Singapore Legal Bridge, he said, was not intended to be merely another conference. It was conceived as a forum to listen, learn and identify practical ideas on strengthening business confidence between the two countries, making cross-border dispute resolution faster, more efficient and predictable, and using technology and artificial intelligence to build future-ready legal systems.

The larger ambition, he said, was to develop a trusted India—Singapore legal and business corridor, one in which businesses can invest with confidence, contracts are respected, disputes are resolved efficiently, institutions collaborate and law becomes a bridge between opportunity and confidence.

Concluding his remarks, Dr. Gemawat said that the next great opportunity for India and Singapore was not merely to increase trade between the two countries, but to help build a new architecture of trust for businesses across the region, a bridge not merely between two legal communities, but between law and commerce, investment and confidence, and the future of the two nations and Asia.

Akhil Prasad outlines GCAI’s initiatives and announces MoU with Singapore Corporate Counsel Association

Country Counsel India at Boeing, Akhil Prasad reflected upon the purpose behind the creation of GCAI and identified three groups that, in his remarks, required greater attention: general counsel, foreign firms and students. He particularly emphasised that students should remain at the centre of institutional efforts, describing them as the future in which greater investment of time and resources was necessary.

He outlined two important GCAI initiatives.

The first, Nyaya Nirmaan, is aimed at facilitating dialogue on the need for legal change and the improvement of the legal system. The initiative has included major discussions in India and London, followed by the programme in Singapore, with a further Nyaya Nirmaan discussion planned in India. The purpose of these deliberations, he explained, is to identify major areas requiring change.

The second initiative, YUKTI, which he explained means intellect in Hindi, focuses on strengthening the capabilities and opportunities of the future generation. Referring to a four-week internship programme organised in January, he spoke of the participation of nearly 70 speakers across 45 locations in India and the support extended by prominent members of government and the legal community.

Akhil Prasad expressed particular satisfaction that the dialogue and GCAI’s initiatives were expanding beyond India. Following meetings and discussions in Singapore, the Singapore Corporate Counsel Association agreed to sign an MoU to support the internship programme, marking what he described as an important first step in the partnership.

India—Singapore relations enter an increasingly productive phase: Deputy High Commissioner

Addressing the gathering, Sudhi Choudhary, Deputy High Commissioner, High Commission of India in Singapore highlighted the deep historical connections between India and Singapore and the continued strength of their diplomatic relationship.

She noted the warm relations between the political leadership of the two countries and referred to high-level visits in recent years, including Prime Minister Narendra Modi’s visit to Singapore in September 2024, President Tharman Shanmugaratnam’s visit to India in January 2025 and Prime Minister Lawrence Wong’s visit to India in September 2025.

The two countries, she noted, have nearly 30 regular dialogue mechanisms, bilateral mechanisms and exercises.

August 2026 had been a particularly productive month for bilateral relations. She referred to the fourth round of the India—Singapore Ministerial Roundtable, which brought together senior ministers from both countries for discussions under six identified priority pillars, including advanced manufacturing, connectivity, digitalisation, healthcare and medicine, skill development and sustainability.

Describing the Ministerial Roundtable as a unique and unprecedented format, she said that it reflected both the strength and trajectory of the India—Singapore relationship.

She also referred to the India—Singapore Comprehensive Economic Cooperation Agreement (CECA), signed in 2005, and stated that trade between the two countries had grown multiple times and stood at about USD 35 billion. Collaboration was also being developed in future-oriented areas such as skills development, the green economy, digital connectivity, semiconductors, food security and green and digital shipping corridors.

As bilateral ties continue to expand, India and Singapore are also working towards elevating cooperation in law and dispute resolution. She referred to the MoU on cooperation in law and dispute resolution signed in March 2024 and the inaugural meeting of the Joint Consultative Committee under the MoU in August 2025.

Against this background, she expressed the hope that the deliberations at the India—Singapore Legal Bridge would generate ideas and suggestions that would further strengthen the bond between the two countries.

Attorney General calls for new legal frameworks for the “global common good”

R. Venkatramani, Attorney General for India, congratulated the participants on what he described as the first exercise in bridge-making and said that many more distances remained to be travelled.

Moving to the larger issues before the gathering, the Attorney General reflected upon the historical role of contract law in supporting capital formation. While legal frameworks had historically enabled the growth and movement of capital, he suggested that the present age of technological innovation and new forms of investment required a broader and more fundamental reconsideration of existing legal structures.

He called for attention to the idea of the “global common good”, observing that innovations today represent new forms of investment and that legal frameworks must increasingly understand the interconnected nature of financial, economic and technological investments.

The Attorney General suggested that the India—Singapore Legal Bridge could explore the possibility, scope and extent of what he described as global common good cooperation legislation. He also raised the question of whether the concept of one-window clearance could be extended into the legal sphere through the idea of a “one-window legal clearance”.

While acknowledging the value of existing legal forms and incremental reform, Mr. Venkatramani called for new frameworks capable of addressing new realities. Singapore’s progress in dispute resolution, he observed, demonstrated the possibilities of innovation, but more such centres and initiatives would be required across the world.

The relationship between India and Singapore, he emphasised, should not be understood merely as a competition between jurisdictions. It was a different kind of collaboration, although competition could also exist in terms of delivering the best outcomes from available resources.

The Attorney General further called for a forward-looking approach to the transformation of Indian dispute-resolution mechanisms. Incremental changes were important, but he said that he was looking for something “radically different”. India must learn from developments elsewhere without becoming complacent or believing that it had reached the end of its journey.

Referring again to the global common good, he suggested that law and a new understanding of the rule of law could play an important role in addressing geopolitical challenges and the movement of ideas, innovation, resources and people in an unequal world.

If India and Singapore could play an important part in conceptualising the global common good and developing legal frameworks in aid of it, the India—Singapore Bridge, he said, could acquire enduring life, value and appeal.

The Attorney General also cautioned against both uncritical criticism and attachment to outdated traditions. India, he said, should not be subjected to habitual “India-bashing”, but equally, it could not cling to the past.

Describing the Legal Bridge as an important initiation, he wished it visibility and enduring value and offered his support in contributing to its larger purpose.

Justice Manmohan: The Legal Bridge stands on strong economic and legislative pillars

Justice Manmohan, Judge, Supreme Court of India, described the India—Singapore Legal Bridge as a compelling idea and identified two principal pillars on which it stands.

The first is its economic foundation. Referring to the volume of trade between India and Singapore, the CECA executed in 2005, subsequent revisions and continuing high-level inter-ministerial engagement, Justice Manmohan observed that these developments had significantly promoted trade. He noted that over the past two decades, exports from India had increased three times and exports from Singapore had increased ten times.

The second pillar is the common legislative foundation shared by the two countries. He identified three important common features: the arbitration laws of both countries are based on the UNCITRAL Model Law, both are signatories to the New York Convention, and both follow the common law tradition.

With trade increasing, disputes are bound to arise, he observed. Since the CECA does not contain an investor-State dispute-resolution mechanism and India has not ratified ICSID, international commercial arbitration is likely to remain an important forum for resolving disputes, with institutions such as SIAC, ICC and other forums continuing to attract substantial work.

Justice Manmohan, however, emphasised that the narrative regarding Indian arbitration is changing.

“India has a credible seat of arbitration”

Justice Manmohan referred to key legislative and judicial developments in India, particularly the 2015 amendments to the arbitration framework. He noted that Parliament had narrowed and defined the concept of public policy, while judicial decisions, including Ssangyong Engg. & Construction Co. Ltd. v. NHAI ,(2019) 15 SCC 131, clarified the legal position in light of those amendments.

He identified three developments that, in his view, had made a significant impact: the narrowing and definition of public policy, the statutory timeline for the conclusion of arbitrations and the requirement of a pre-deposit in appropriate circumstances when an award is challenged.

On this basis, Justice Manmohan stated that India today has a credible seat of arbitration. The relevant parameters, he said, include the ability to get arbitration off the ground quickly, the availability of effective interim measures and the enforceability of awards.

On the commencement of arbitration, he referred to the judicial approach of taking a prima facie view and leaving substantive matters to the arbitral tribunal, referring to decisions including Cox & Kings1, Vidya Drolia2 and the judgment concerning the interplay between the Stamp Act and the Arbitration Act3.

With respect to interim measures, he referred to the flexibility available under Section 9 of the Arbitration and Conciliation Act, 1996 and to developments recognising the availability of relief even after arbitration and the enforceability of an Emergency Arbitrator’s award in Amazon.Com NV Investment Holdings LLC v. Future Retail Ltd., (2022) 1 SCC 209.

On enforcement, he acknowledged that challenges remained but observed that the requirement of money being deposited up front could reduce the incentive to prolong litigation and encourage earlier settlements. He noted that matters were moving quickly in the Delhi High Court and Bombay in this regard.

Future-ready legal systems require evolution and a change of mindset

Justice Manmohan emphasised that legal systems and procedures would have to evolve to address emerging realities.

Referring to cross-border disputes and overlapping jurisdictions, he discussed the possibility of greater judicial coordination and referred to the concept of a networking judge and the use of mirror orders in cross-border matters.

Such developments, he observed, represented the kind of evolution in law and procedure that would increasingly be required in a changing global environment.

Artificial intelligence presented another major challenge. Technology was evolving at extraordinary speed, making it difficult for legislators to create frameworks that could remain responsive to rapidly changing dynamics. AI, Justice Manmohan observed, was already capable of increasingly sophisticated forms of prediction, and courts would have to address the significant challenges arising from such technological developments.

Unique synergy and the need to strengthen the Indian Bar’s participation

Justice Manmohan described India and Singapore as possessing a unique synergy.

Singapore’s ability to implement legal and institutional changes quickly reflected the circumstances of a smaller nation, while India’s scale, democratic structure and legislative processes naturally created different challenges. Neither country, he emphasised, could be a photocopy of the other. Differences in approach and institutional challenges would remain, but both countries must ultimately work towards a common goal.

Justice Manmohan also highlighted the depth of talent in the Indian legal profession, noting that law was increasingly attracting exceptionally talented young people. The challenge was to ensure that this talent was effectively utilised.

He expressed a concern regarding the participation of Indian lawyers in international arbitration. Referring to India’s significant contribution to SIAC arbitrations, he observed that Indian practitioners should have greater opportunities to participate on arbitral tribunals. This, he clarified, was not a criticism but a concern for fairness and for ensuring that the talent of the Indian Bar was fully utilised and developed in accordance with international standards.

The Legal Bridge, Justice Manmohan concluded, rests on very strong pillars and has a strong foundation. One lane of the bridge, he said, was already fully constructed and attracting substantial traffic. He expressed confidence that the second lane would also grow stronger in the years ahead.

India’s robust economic and trade relationship with Singapore provided a strong foundation, while the Indian Bar could benefit from greater exposure to the best arbitration practices. Singapore’s Bar and arbitration centres, he said, were centres of excellence from which India could learn.

Ultimately, a mutually beneficial partnership would depend upon developing highly capable legal professionals who could resolve commercial disputes effectively. The commercial world, he observed, will seek dispute resolution wherever good services are available at appropriate pricing.

The inauguration of the GCAI India—Singapore Legal Bridge thus marked the beginning of an initiative built upon economic strength, common legal foundations and a shared recognition that the future of commerce will require greater institutional cooperation, innovation and trust. Its larger ambition, as reflected throughout the inaugural addresses, is to create a bridge between two legal ecosystems and to enable law itself to become an instrument of confidence, collaboration and opportunity in the evolving Asian and global commercial landscape.

1. Cox & Kings Ltd. v. SAP India (P) Ltd., (2024) 4 SCC 1

2. Vidya Drolia v. Durga Trading Corpn., (2021) 2 SCC 1

3. N.N.
