Meghalaya High Court:<\/span> The Single Judge Bench of W. Diengdoh, J. granted bail to the accused in a Protection of Children from Sexual Offences Act, 2012<\/a> () case after considering his prolonged custody of more than one year. The Court granted bail after noting completion of investigation and examination of the survivor under Section 35<\/a> POCSO<\/a>. The Court considered the general principles of bail jurisprudence and imposed strict conditions on bail, including complete prohibition on contact with the survivor.<\/p>\n

The Court observed that the seriousness of the alleged offence could not, by itself, justify indefinite detention without considering the progress of the proceedings. The Court found that there no more scope for further custodial interrogation. The completion of investigation and examination of the survivor substantially reduced the justification for continued custody on investigative grounds.<\/p>\n

Background<\/p>\n

The case arose from the arrest of petitioner’s brother on the allegation of sexual assault against a minor girl and involved offences under Sections 63(a<\/span>)<\/a>, 63(vi<\/span>)<\/a> and 64(2)(m<\/span>)<\/a>, Nyaya Sanhita, 2023<\/a>, read with Sections 3(a<\/span>)<\/a>, 5(l)<\/a> and 6<\/a> POCSO<\/a>.<\/p>\n

The petitioner filed a bail application under Section 483<\/a>, Nagarik Suraksha Sanhita, 2023<\/a>, submitting that his brother had been arrested on 12 May 2025 and had remained in judicial custody for more than one year. It was argued that irrespective of the merits of the case, the bail application was sought on the ground of prolonged incarceration and the slow progress of the trial. According to the petitioner, the trial had not proceeded with reasonable expedition and was still at an early stage of recording prosecution evidence. The petitioner further emphasised that the delay in conclusion of the proceedings was not attributable to him.<\/p>\n

The defence pointed out that the survivor, who was alleged to have been 17 years old at the time of the incident, had already been examined before the trial court as PW-1 on 3 July 2026. The petitioner argued that continued detention of his brother was no longer necessary, particularly because the investigation had already been completed and the charge-sheet had been filed. It was therefore submitted that he could be released on bail subject to appropriate conditions imposed by the Court.<\/p>\n

The State strongly opposed the bail application and submitted that the investigation had disclosed prima facie evidence against the accused concerning the alleged sexual assault. The prosecution characterised the alleged offence as heinous and emphasised the circumstances in which the survivor was allegedly taken to the place of occurrence. According to the State, the accused had allegedly lured the survivor on the pretext of giving her a lift to her residence while she was walking in the area. The prosecution argued that the incident had caused serious trauma and mental agony to the survivor and, therefore, the accused should not be granted the benefit of bail merely on the ground of the passage of time. It was argued that the survivor remained traumatised by the alleged incident and that the petitioner-accused resided in the vicinity of her residence. If released, the accused might threaten, influence or otherwise cause harm to the survivor.<\/p>\n

Decision and Analysis<\/p>\n

The Court considering the submissions of the parties and the seriousness of the allegations, observed that an alleged act of sexual assault against a minor was undoubtedly heinous and constituted a serious affront to the dignity of the survivor, apart from the psychological consequences that may continue to affect the survivor. The Court emphasized that the accused was facing an ongoing criminal trial and that the seriousness of the alleged offence could not, by itself, justify indefinite detention without considering the progress of the proceedings.<\/p>\n

The Court considered the statutory requirement for the expeditious disposal of POCSO cases referring to Section 35, which provides, a POCSO trial should be completed within one year from the date of taking cognizance of the offence. It was held that the Court could not lose sight of this legislative mandate while considering the continued detention of an accused during the pendency of a POCSO trial.<\/p>\n

The Court noted that since the charge-sheet had been filed and the survivor had been examined, there was practically no more scope for further custodial interrogation of the accused person. The Court further considered the general principles of bail jurisprudence. It observed that the relevant question was whether, there was a likelihood of absconding or violating the conditions imposed by the Court, if petitioner was released on bail. The Court therefore balanced the seriousness of the allegations and the concerns expressed by the State. After considering the facts and circumstances, the Court found it appropriate to allow the bail application. The accused was directed to be released on bail subject to the following conditions:<\/p>\n

1. that he shall not abscond or tamper with the evidence or witnesses;<\/p>\n

2. that he shall attend court as and when called for;<\/p>\n

3. that he shall not leave the jurisdiction of Meghalaya, except with due permission of the court concerned;<\/p>\n

4. that he shall not come into contact with the survivor in any manner during the course of trial;<\/p>\n

5. that he shall bind himself on a personal bond of ₹50,000 with one surety of like amount to the satisfaction of the trial court.<\/p>\n

The High Court expressly clarified that any violation of the bail conditions would entitle the prosecution to approach the trial court for cancellation of bail.<\/p>\n
