Viswanathan and Arun Palli, JJ., extended extraordinary pensionary benefits under Category &#8220;C&#8221;, CCS (Extraordinary Pension) Rules, 1939 from the date of death to the widow of a General Reserve Engineering Force (GREF) employee who had made the &#8220;supreme sacrifice&#8221; while saving fellow workers and equipment and was posthumously awarded the Shaurya Chakra. Holding that the relief ought not to be confined to 3 years preceding the filing of the writ petition, the Court directed the Union of India to pay a consolidated sum of &#8377;10 lakhs for the period from 13 July 2000 to 12 July 2015.<\/p>\n<p style=\"margin-bottom: 3%; font-weight: bold;\">Also Read: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/06\/02\/disability-pension-army-personnel-medical-opinion-kerala-high-court\/\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">Disability Pension to Army Personnel Cannot be Denied on Medical Opinion Unsupported by Adequate Reasons: Kerala High Court<\/span><\/a><\/p>\n<p style=\"font-weight: bold;\">Factual Matrix<\/p>\n<p style=\"margin-bottom: 3%;\">The appellant was the widow of an officer, who was serving as an Overseer with GREF. The deceased was deployed as In-charge Works for the formation cutting of the Hayliang&#8212;Metangliang&#8212;Chaglohagom road. The road, approximately 57 kilometres long, was considered to have substantial national and strategic importance because of its significance for the management of the Sino-Indian border.<\/p>\n<p style=\"margin-bottom: 3%;\">On 10 July 2000, while supervising dozer operations at a dangerous and rocky location, a large boulder began rolling down from the hilltop along with substantial debris. The deceased immediately noticed the danger and warned the dozer and compressor operators to move to safety. He did not stop after ensuring their safety. He also assisted in moving the equipment away from the danger zone, thereby attempting to protect both the machinery and the workers operating it. While doing so, he was unable to escape the path of the boulder. The impact swept him away and he fell approximately 70 m into the valley, resulting in his death.<\/p>\n<p style=\"margin-bottom: 3%;\">The government subsequently recognised his extraordinary bravery by posthumously conferring the Shaurya Chakra upon him on 19 October 2001.<\/p>\n<p style=\"margin-bottom: 3%;\">The appellant had initially been receiving only an ordinary family pension. On 20 December 2005, she submitted a representation seeking special family pension under the CCS (Extraordinary Pension) Rules, 1939.<\/p>\n<p style=\"margin-bottom: 3%;\">Appellant&#8217;s claim was rejected on 15 January 2006, on the ground that she had already received &#8377;1,84,170 under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002768474\" target=\"_blank\">Workmen&#8217;s Compensation Act, 1923<\/a>, and consequently, according to the authorities, a liberalised pensionary award was not admissible under the applicable pension rules. A subsequent representation dated 9 December 2010 was also rejected on 6 December 2011.<\/p>\n<p style=\"font-weight: bold;\">Procedural History<\/p>\n<p style=\"margin-bottom: 3%;\">The appellant approached the Punjab and Haryana High Court wherein a Single Judge Bench partly allowed the writ petition and held that the appellant was entitled to extraordinary pension by classifying her husband&#8217;s case under Category &#8220;C&#8221; of the applicable scheme. However, the Court directed her to return the compensation received under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002768474\" target=\"_blank\">Workmen&#8217;s Compensation Act, 1923<\/a>, together with 6 per cent annual interest. The Court declined to place the case under Category &#8220;D&#8221; or Category &#8220;E&#8221;.<\/p>\n<p style=\"margin-bottom: 3%;\">Both sides preferred appeal. The appellant sought categorisation of pension under Category &#8220;E&#8221;, while the Union of India challenged the relief granted by the Single Judge.<\/p>\n<p style=\"margin-bottom: 3%;\">The Division Bench ultimately agreed with the Single Judge regarding Category &#8220;C&#8221;. However, on the question of arrears, it restricted the monetary benefit to the period of 3 years preceding the filing of the writ petition, principally because counsel for the appellant had earlier stated that the claim for arrears could be restricted to 3 years.<\/p>\n<p style=\"font-weight: bold;\">Issue for Determination<\/p>\n<p style=\"margin-bottom: 3%;\">The Court accepted the High Court&#8217;s conclusion that the deceased&#8217;s case fell within Category &#8220;C&#8221;. The principal question before the Court was therefore:<\/p>\n<p style=\"margin-bottom: 3%;\">Whether the appellant should receive the benefit of the extraordinary pension from the date of her husband&#8217;s death, rather than having the arrears restricted to 3 years preceding the filing of the writ petition.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court specifically examined whether the appellant&#8217;s earlier statement restricting the arrears to 3 years should prevent the Court from granting relief from the date of death.<\/p>\n<p style=\"font-weight: bold;\">Analysis<\/p>\n<p style=\"margin-bottom: 3%;\">At the outset, the Court took particular note of the circumstances in which the deceased lost his life. He had sacrificed his life while performing his official duties and attempting to protect the lives of fellow workers and the valuable equipment at the worksite. His bravery had subsequently been recognised through the award of the Shaurya Chakra.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that these were not circumstances in which the family or widow should have been required to approach a court merely to obtain the benefit that was otherwise due to them. The Court emphasised that the long delay before the appellant could approach the Court should not stand in the way of doing justice.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court also recorded its appreciation for the response of the Attorney General and the prompt steps taken by the department. By the time of the hearing, &#8377;14,28,200 had been released pursuant to the High Court&#8217;s judgment, and the pension had been processed. A further &#8377;4,12,064 towards arrears of extraordinary pension had also been released.<\/p>\n<p style=\"margin-bottom: 3%;\">The remaining question concerned the period from 13 July 2000 to 12 July 2015, <span style=\"font-style: italic;\">i.e.<\/span>, the period for which pensionary benefits had not already been released. According to the figures placed before the Court by the Attorney General, the pension for the period from the date of death up to 12 July 2015 came to &#8377;6,62,268, which would amount to &#8377;8,32,000 after adding 6 per cent interest.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court also considered the &#8377;1,84,170 received by the appellant under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002768474\" target=\"_blank\">Workmen&#8217;s Compensation Act, 1923<\/a>. The Attorney General submitted that, with interest, the amount to be refunded would be &#8377;2,78,092, resulting in a proposed adjustment of &#8377;4,62,262. The appellant&#8217;s counsel pointed out that the principal amount of &#8377;1,84,170 had already been returned.<\/p>\n<p style=\"font-weight: bold;\">Decision<\/p>\n<p style=\"margin-bottom: 3%;\">Although the appellant&#8217;s counsel had earlier made a statement restricting the claim, the Court held that, in the peculiar facts and circumstances of the case, the relief should not be restricted to 3 years preceding the filing of the writ petition and considered it appropriate to extend the benefit from the date of death.<\/p>\n<p style=\"margin-bottom: 3%;\">Instead of undertaking a further calculation and adjustment of the various amounts and interest components, the Court, exercising its powers under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574873\" target=\"_blank\">142<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution of India<\/a> to do complete justice in the circumstances, fixed a consolidated amount of &#8377;10,00,000 for the period from 13 July 2000 to 12 July 2015.<\/p>\n<p style=\"margin-bottom: 3%;\">Ed Note: <span style=\"font-style: italic;\">W<span style=\"font-size: 10.0pt;\">hile the incident occurred on 10 July 2000, the order records the date of death as 12 July 2000, suggesting he succumbed to his injuries two days after the fall. The Court&#8217;s consolidated payment period accordingly runs from 13 July 2000, the day following his recorded date of death. The order does not clarify this two-day gap.
