{"id":393080,"date":"2026-08-12T10:30:32","date_gmt":"2026-08-12T05:00:32","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=393080"},"modified":"2026-08-12T10:34:33","modified_gmt":"2026-08-12T05:04:33","slug":"clear-aibe-in-2-years-for-continued-practice-allahabad-hc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/08\/12\/clear-aibe-in-2-years-for-continued-practice-allahabad-hc\/","title":{"rendered":"Clear AIBE Within 2 Years or lose right to practice: Allahabad HC clarifies rules for 2009-2010 onwards law graduates"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Disclaimer:<\/span> <span style=\"font-style: italic;\">This has been reported after the availability of the order of the Court and not on media reports so as to give an accurate report to our readers.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Allahabad High Court:<\/span> In a criminal miscellaneous bail application, the Single Judge Bench of Arun Kumar Singh Deshwal, J., considered whether an advocate who had graduated after the academic session 2009-10 but had not qualified the All India Bar Examination (AIBE) despite expiry of two years could appear before the Court. Though the bail application had already been disposed of, the Court had permitted the counsel to argue the matter as a one-time exception under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543827\" target=\"_blank\">32<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002806286\" target=\"_blank\">Advocates Act, 1961<\/a>, while keeping the larger issue pending for determination. The Court subsequently examined the legal position concerning provisional enrolment, qualification of AIBE, practice before the High Court and verification of Certificate of Practice (COP).<\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">The issue arose when the Court examined whether law graduates of the 2009&#8212;10 academic session who had not cleared the AIBE within two years could continue to appear in court, and sought assistance from various Bar bodies. During the subsequent hearing, a further question also emerged regarding the applicability of Rule 5 <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000041416\" target=\"_blank\">Bar Council of India Certificate and Place of Practice (Verification) Rules, 2015<\/a> on the requirement of a COP after five years. The Bar Council of India clarified that under Rule 9 AIBE Rules, 2010 (AIBE Rules), the AIBE is mandatory for such graduates, who may be provisionally enrolled for two years and allowed to practise during that period, however, failure to clear the exam within this timeframe results in automatic cancellation of enrolment and cessation of the right to practise, though they may continue to attempt the examination until they qualify.<\/p>\n<p style=\"margin-bottom: 3%;\">It is worth noting that, during the pendency of the matter, the counsel whose eligibility had originally prompted the Court&#8217;s inquiry, informed the Court that he had cleared the AIBE on 18 July 2026 and sought a direction requiring the Bar Council of U.P. to promptly issue enrolment numbers to successful candidates.<\/p>\n<p style=\"font-weight: bold;\">Analysis<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that the legal profession plays a critical role in protecting and promoting civil and constitutional rights. <span style=\"font-weight: bold;\">The Bar and Bench are two wheels of a chariot of justice and one cannot function without other.<\/span> The <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002806286\" target=\"_blank\">Advocates Act, 1961<\/a>, therefore, establishes the Bar Council of India and State Bar Councils and empowers them, along with the High Courts, to regulate admission to the profession, prescribe professional standards and frame conditions governing the right to practise. Thus, although a law graduate fulfilling Section 24 requirements may be admitted on the State roll, such admission remains subject to the Advocates Act and the Rules framed by the BCI, State Bar Councils and High Courts. Upon fulfilling the prescribed conditions, Section 30 confers the right to practise before courts, Tribunals and other authorities where advocates are entitled to practice.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that under Rule 9 of the AIBE Rules, 2010, law graduates of the academic session 2009-10 onwards, even if enrolled under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543816\" target=\"_blank\">24<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002806286\" target=\"_blank\">Advocates Act, 1961<\/a>, cannot practise unless they qualify the AIBE. However, pursuant to representations from various Bar Councils, the BCI by resolution dated 12 April 2013 permitted such graduates to be provisionally enrolled for two years, subject to qualifying the AIBE within that period, failing which they would cease to practise until they qualified. The BCI subsequently clarified on 31 January 2017 that such advocates, though barred from practice after expiry of two years if they failed to qualify the AIBE, could continue to appear for the examination without any limit on attempts until they qualified. Under Rule 11 AIBE Rules, successful candidates are issued a COP by the BCI, entitling them to practise for its validity period of five years.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court referred to <span style=\"font-style: italic;\">Bar Council of India<\/span> v. <span style=\"font-style: italic;\">Bonnie Foi Law College<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/8uJ3kjz9\" target=\"_blank\">(2023) 7 SCC 756<\/a>, wherein the Supreme Court upheld BCI&#8217;s power to frame rules regulating enrolment, including pre-enrolment training and examination, expressly overruling its earlier decision in <span style=\"font-style: italic;\">V. Sudeer v. Bar Council of India<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0000027278\" target=\"_blank\">(1999) 3 SCC 176<\/a>. The Court further noted that the Supreme Court in Bonnie Foi&#8217;s case had also observed that an enrolled advocate who takes up non-legal employment for a substantial length of time, such as five years, would be deemed a new enrollee and required to clear the AIBE afresh to regain the qualification. The Court remarked that the Bar Council of India &#8220;appears to have ignored&#8221; this direction, and accordingly directed that a copy of the order be sent to the Chairman, Bar Council of India, for consideration of this specific observation.<\/p>\n<p style=\"margin-bottom: 3%;\">Relying on the BCI&#8217;s resolution dated 12-04-2013 permitting provisional enrolment and practice for two years, the Court held that the BCI being the final authority on permitting provisional advocates to practise, it could not take a contrary view merely because Rule 9 AIBE Rules, 2010 had not been formally amended. The Court also noted the Supreme Court&#8217;s observation that advocates returning to practice after a substantial break in non-legal employment for substantial length of time, would be required to reappear in the AIBE.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that the Allahabad High Court, exercising powers under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543829\" target=\"_blank\">34<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002806286\" target=\"_blank\">Advocates Act, 1961<\/a> read with Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574968\" target=\"_blank\">225<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a>, framed Rules 3 and 3-A of Chapter XXIV Allahabad High Court Rules, 1952, requiring advocates practising before the High Court to be on its advocate roll for filing Vakalatnama or memo of appearance. Referring to Jamshed Ansari v. High Court of Judicature at Allahabad, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/7LO8VyOw\" target=\"_blank\">(2016) 10 SCC 554<\/a>, the Court noted that the Supreme Court had upheld the validity of these Rules, holding that the right to practise under Section 24 is subject to rules framed by the High Court under Section 34 as well as by the BCI under Section 49 Advocates Act.<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p style=\"font-weight: bold;\">Whether law students graduated during academic session 2009-10 or thereafter and enrolled as an advocate would be entitled to continue practice without qualifying AIBE<\/p>\n<p style=\"margin-bottom: 3%;\">The Court held that advocates who obtained a law degree during the academic session 2009-10 or thereafter are entitled to practise on the basis of a provisional enrolment certificate issued by the Bar Council of U.P. for two years. However, if they fail to qualify the AIBE within two years, they would not be entitled to practise in any court, Tribunal or other authority. For practice before the High Court, they must also have a provisional advocate roll of the High Court; however, those without such roll may appear for two years along with advocates who are on the advocate roll of High Court, Allahabad or Lucknow.<\/p>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Whether an enrolled advocate who does not verify the Certificate of Practice after expiry of five years from the date of its issuance would be entitled to practise in any court of law<\/p>\n<p style=\"margin-bottom: 3%;\">The Court held that even after expiry of five years from the date of issuance of the Certificate of Practice, an advocate would be entitled to continue practising without a verified or renewed Certificate of Practice until the Bar Council of U.P. publishes the list of non-practising advocates under Rule 20.4 of the Rules, 2015.<\/p>\n<\/li>\n<\/ol>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Also Read:<\/span> <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/08\/06\/madras-hc-seeks-bar-council-response-criminal-cases-against-advocates\/\" target=\"_blank\">30 to 40 Cases a Day: Madras HC Seeks Response from Bar Councils on Increasing Criminal Cases Against Practising Advocates<\/a><\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that the expression &#8220;court&#8221; under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001801091\" target=\"_blank\">2(1)(a)<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001801166\" target=\"_blank\">Sakshya Adhiniyam, 2023<\/a> includes not only civil and criminal courts and Tribunals, but also revenue courts, as they are legally authorised to take evidence, consequently, an advocate who graduated during the academic session 2009-10 or thereafter and fails to qualify the AIBE within 2 years of provisional enrolment would not be entitled to practise before civil, criminal or revenue courts, or Tribunals. The Court further observed that if such an advocate appears before any court or Tribunal, the Presiding Officer may refuse to hear them or honour their Vakalatnama, and such advocate may also be liable for prosecution under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543844\" target=\"_blank\">45<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002806286\" target=\"_blank\">Advocates Act, 1961<\/a>.<\/p>\n<p style=\"font-weight: bold;\">Decision<\/p>\n<p style=\"margin-bottom: 3%;\">The Court directed the Advocate Roll Section of the High Court to strike off or suspend the names of advocates having provisional enrolment under the AIBE Rules, 2010 who failed to qualify the AIBE within two years, after publication of notice, unless they subsequently qualify the examination. The Chairman and Secretary of the Bar Council of U.P. were directed to issue enrolment numbers to advocates who qualify the AIBE within four weeks from receipt of their result cards.<\/p>\n<p style=\"margin-bottom: 3%;\">The Director General of Police, U.P. was further directed to ensure completion of police verification of law graduates intending to enroll as advocates within two weeks from receipt of the verification form from the Bar Council of U.P. Copies of the order were directed to be sent to the Chief Secretary, U.P., Bar Council of U.P., Director General of Police and Chairman, Bar Council of India.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Yogendra v.
