The Court found that the unexplained delay of more than 4 years in lodging the FIR, contradictory medical evidence regarding the cause of death, and the incomplete chain of circumstantial evidence created serious doubt, entitling the appellant to the benefit of doubt.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that &#8220;where the core question whether the death was homicidal, accidental or suicidal remains shrouded in doubt, the prosecution&#8217;s case necessarily fails. The conviction of the accused cannot be based on mere presumption of homicide&#8221;.<\/p>\n<p style=\"margin-bottom: 3%;\">Also Read: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/05\/29\/supreme-court-dowry-death-bail-fir-delay-not-ground\/\" target=\"_blank\">Supreme Court Says FIR Delay Alone Cannot Be Ground for Bail in Dowry Death Cases<\/a><\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">The appeal arose out of the conviction of the appellant-husband in a case alleging the dowry death of his wife. As per the prosecution, the deceased was harassed by her husband and in-laws for bringing insufficient dowry and for failing to meet their demand for a motorcycle. After her death on 30 June 1979, the informant lodged the FIR on 18 November 1983, alleging that the accused had caused her death. Upon trial, the husband, father-in-law and mother-in-law were convicted under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561607\" target=\"_blank\">302<\/a> read with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561652\" target=\"_blank\">34<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> and sentenced to life imprisonment, under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561485\" target=\"_blank\">201<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> and sentenced to three years&#8217; rigorous imprisonment, and under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561375\" target=\"_blank\">120-B<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> and sentenced to seven years&#8217; rigorous imprisonment, with the sentences to run concurrently. One co-accused was acquitted.During the pendency of the appeal, the appeal abated against the parents-in-law due to their death, leaving the husband as the sole surviving appellant.<\/p>\n<p style=\"font-weight: bold;\">Analysis and decision<\/p>\n<p style=\"margin-bottom: 3%;\">At the outset, the Court noted the death of the father and mother-in-law of the deceased and that with order dated 22 May 2018, appeal against them have been abated and only the appellant-husband is surviving. The Court noted <span style=\"font-weight: bold;\">a staggering delay of more than 4 years. Delay in lodging the FIR is not automatically fatal to the case if the same is satisfactorily explained.<\/span> The Court observed that an inordinate and unexplained delay casts a grave shadow of doubt on the prosecution versions and raises the risk of embellishment or a concocted story. The Court found the delay to have seriously shaken the credibility of the prosecution&#8217;s case from the very inception.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that the case rested entirely on circumstantial evidence with no independent eyewitness and while the prosecution relied on the opinion of the State Medico Legal Expert to contend that the deceased had been set ablaze using an inflammable substance, the post-mortem doctor supported the defence version that the death could have resulted from electrocution, having found extensive electric burns on the body.<\/p>\n<p style=\"margin-bottom: 3%;\">Examining whether the prosecution had established the homicidal nature of the deceased&#8217;s death, the Court found that the medical evidence was inconclusive. While the State Medico Legal Expert opined that the injuries were inconsistent with electrocution, he also acknowledged the absence of kerosene smell and admitted that some injuries could have been caused by electric burns. Conversely, the post-mortem doctor found no smell of any inflammable substance and noted entry and exit electric burn marks indicative of electrocution. In view of these conflicting medical opinions, the Court noted that the nature of death remained doubtful and that the possibility of accidental death could not be ruled out. The Court reiterated that when it is not cleared that whether the death was homicidal, accidental or suicidal, the prosecution case necessarily fails. <span style=\"font-weight: bold;\">If the evidence leaves room for the possibility of a suicidal or accidental death, the benefit of the doubt inevitably goes to the accused.<\/span> The Court thereafter, rejected the State&#8217;s contention that absence of electricity supply ruled out electrocution, observing that the incident could have occurred before the power outage commenced at 1.45 a.m.<\/p>\n<p style=\"margin-bottom: 3%;\">As regards appellant-Triveni&#8217;s culpability, the Court noted that the defence had specifically pleaded that he was not present at the house at the time of the incident, whereas the prosecution relied heavily on his alleged presence to infer his involvement. In the absence of any eyewitness, the Court found his presence at the scene to be doubtful. The Court observed that even after assuming he was present in the house at the time of the occurrence, no specific role had been attributed to him by any prosecution witness. Mere presence, without an assigned overt act, could not sustain a conviction based on circumstantial evidence. <span style=\"font-weight: bold;\">In the present case conviction cannot sustain as the presence of the appellant at the time of occurrence at the scene of crime has not been proved beyond reasonable doubt and no active role has been assigned to him and the chain of the evidence is not consistent only with the hypothesis of the guilt of the accused.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">Considering an overall view of the delay in lodging the FIR, the conflicting medical opinion, the doubtful presence and role of the appellant, and the prosecution&#8217;s failure to establish a homicidal death, the Court concluded that the finding of the trial court were unsustainable. Extending the benefit of doubt to the appellant, the Court set aside the conviction and sentence, acquitted him of all charges, and cancelled his bail bonds and discharged the sureties.<\/p>\n<p
