Professional mobility is not merely a career issue. It is an economic imperative for a nation aspiring to become a developed economy.<\/p>\n

India has set itself an ambitious national objective — Viksit Bharat @2047. Achieving that vision will require much more than physical infrastructure, financial capital and technological innovation. It will require institutions capable of supporting one of the world’s largest and most sophisticated economies. Among those institutions, none is more critical — and yet less discussed — than the legal profession.<\/p>\n

Every major economy is ultimately built upon legal infrastructure. Investment requires legal certainty. Commerce requires enforceable contracts. Capital markets require sound regulation. Infrastructure requires robust concession and financing agreements. Innovation requires protection of intellectual property. International trade depends upon regulatory compliance. Disputes require efficient resolution. Law is therefore not merely an instrument of justice. It is an indispensable enabler of economic growth.<\/p>\n

If India seeks to become one of the world’s largest economies, it must also build one of the world’s strongest legal ecosystems. That cannot happen unless India allows its best legal talent to move freely across the entire legal profession.<\/p>\n

Today, it does not.<\/p>\n

The artificial walls within the legal profession<\/p>\n

India’s legal ecosystem has gradually evolved into separate silos — advocates, law firms, corporate legal departments, public-sector legal teams, government legal services, academia, arbitrators and mediators, regulatory lawyers and so on.<\/p>\n

Although every one of these professionals performs legal work, the regulatory framework continues to treat movement between these roles as though lawyers are leaving one profession and entering another. Nowhere is this more visible than when an advocate or law-firm partner joins an organisation as general counsel. The lawyer may continue advising on constitutional issues, mergers and acquisitions, infrastructure projects, international arbitration, securities regulation, insolvency, competition law, technology law and cross-border investments.<\/p>\n

The complexity of the legal work often increases. Yet professionally, the transition may interrupt continuity of Bar membership or create uncertainty regarding professional standing and accumulated experience. That outcome is neither logical nor economically desirable.<\/p>\n

Talent must follow the needs of the economy<\/p>\n

Modern economies succeed because talent flows where it creates the greatest value. Engineers move between industry and research. Scientists move between universities and private laboratories. Economists move between government, academia and financial institutions. Doctors move between hospitals, teaching institutions and research organisations. Such movement strengthens every institution. The legal profession should be no different. A lawyer should be able to move seamlessly: from chambers to a law firm; from a law firm to a multinational corporation; from a corporation to public service; from government to arbitration; from arbitration to academia; and back again.<\/p>\n

Each transition enriches professional judgment. Each transition strengthens the legal ecosystem. Regulation should facilitate that movement — not penalise it.<\/p>\n

India Inc. deserves access to the country’s best lawyers<\/p>\n

Indian companies increasingly compete with the world’s largest corporations. They undertake multi-billion-dollar acquisitions, raise international capital, operate in dozens of jurisdictions, navigate complex sanctions regimes, implement artificial intelligence, manage cybersecurity risks, resolve international disputes, negotiate global supply chains. To manage these responsibilities, corporations require legal leadership of the highest quality.<\/p>\n

Who are the best candidates for such roles? Often, they are Senior Advocates, experienced law-firm partners and highly specialised practitioners. Yet if accepting an in-house role requires surrendering continuity of professional standing or creates uncertainty regarding future recognition of experience, many accomplished lawyers will understandably hesitate. The consequence is not borne by lawyers alone. It is borne by Indian enterprise. India Inc. loses access to legal talent that could strengthen governance, reduce disputes, improve compliance and facilitate investment. That is a loss the economy cannot afford.<\/p>\n

Mobility benefits the entire profession<\/p>\n

Some mistakenly assume that encouraging movement into corporate legal departments weakens the practising Bar. Experience across mature legal jurisdictions demonstrates the opposite. Lawyers who move in-house acquire deep commercial understanding. They understand boardroom decision-making, operational realities, corporate governance, risk management, regulatory strategy, global business. When such lawyers later return to private practice, they become better advisers.<\/p>\n

Conversely, lawyers entering corporate legal departments from private practice bring broad exposure across industries, clients and legal strategies. The exchange strengthens both institutions.<\/p>\n

The legal profession should be viewed as one integrated ecosystem — not competing silos.<\/p>\n

India should learn from global legal markets<\/p>\n

Leading legal jurisdictions have recognised this reality. In the United Kingdom, solicitors routinely move between private practice and in-house roles while remaining members of the profession. In the United States, experienced partners regularly become general counsel and later return to leading law firms or public service. Singapore’s emergence as a global legal hub has been built upon an integrated legal ecosystem in which private practice, arbitration, corporate legal departments and international commerce reinforce one another. Australia follows a similar approach. None of these jurisdictions regards movement into an organisation as abandoning the legal profession.<\/p>\n

India should ask a simple question — “If the world’s leading legal systems encourage movement of talent, why should India discourage it?”<\/p>\n

The present approach also creates an anomaly regarding professional experience. Imagine two lawyers graduating together. One remains continuously in private practice. The other spends 10 years in a leading law firm, 10 years as general counsel of a multinational corporation and later returns to private practice. Has the second lawyer spent 20 years practising law? From any objective perspective, the answer is yes. Those 20 years may include advising Boards, negotiating billion-dollar transactions, conducting investigations, managing international arbitration and supervising some of the country’s largest legal matters. Yet current regulatory structures may fail to recognise that experience as one continuous professional journey.<\/p>\n

Professional experience should be measured by substantive legal work, not by the organisational form in which that work is performed. None of this requires dilution of professional standards. On the contrary, greater mobility should be accompanied by stronger regulation. A lawyer moving into a recognised in-house role should continue to remain subject to professional ethics, disciplinary jurisdiction and continuing legal education. Independent practice, rights of audience and acceptance of external briefs can continue to be regulated separately wherever appropriate. The issue is therefore not whether different forms of legal practice should have different regulatory obligations. The issue is whether lawyers performing genuine legal work should remain part of one continuous profession. The answer should be obvious.<\/p>\n

The debate is often presented as one concerning lawyers. It is much larger than that. India seeks to attract global investment, develop international financial centres, expand cross-border commerce, strengthen arbitration, become a preferred destination for multinational headquarters, create globally competitive enterprises. Every one of these ambitions depends upon sophisticated legal capability.<\/p>\n

Countries compete not only through tax policy, infrastructure and labour costs. They increasingly compete through the quality of their legal institutions. A jurisdiction that allows seamless movement of legal talent between private practice, corporate leadership and public institutions develops deeper expertise, stronger governance and greater investor confidence.<\/p>\n

That is precisely the ecosystem India should aspire to build.<\/p>\n

The way forward<\/p>\n

India’s legal reforms should therefore embrace five foundational principles. First<\/span>, advocates moving into recognised in-house legal roles should retain continuity of professional membership and standing. Second<\/span>, qualifying legal experience acquired in law firms, independent practice, corporate legal departments, public-sector enterprises and other recognised legal roles should form part of one continuous professional career. Third<\/span>, rights of audience and independent client practice may continue to be regulated separately without affecting professional identity. Fourth<\/span>, professional ethics, disciplinary oversight and continuing legal education should apply across all recognised categories of legal professionals. Finally<\/span>, the legal profession should be understood as one integrated ecosystem serving both justice and economic development.<\/p>\n

From professional mobility to national prosperity<\/p>\n

India’s greatest competitive advantage is its people. The country’s legal talent is among the finest in the world. The objective of regulation should be to ensure that this talent flows freely to wherever it can create the greatest value. When an outstanding advocate becomes a general counsel, the legal profession does not lose a lawyer. It gains a stronger corporate legal institution. When an experienced general counsel returns to private practice, the Bar does not gain a newcomer. It regains a lawyer enriched by years of commercial leadership. When legal talent circulates, every institution becomes stronger — the courts benefit, law firms benefit, corporations benefit, investors benefit, the economy benefits, ultimately, the Rule of Law benefits.<\/p>\n

India’s aspiration to become a developed nation requires world-class legal institutions. World-class legal institutions require world-class lawyers. And world-class lawyers must be free to move across the entire legal ecosystem without artificial regulatory barriers.<\/p>\n

The future of India’s legal profession lies not in preserving institutional silos, but in creating an integrated profession where merit, expertise and ethics — not employment status — define professional identity.<\/p>\n

That is not merely good policy for lawyers. It is sound policy for India.<\/p>\n<\/div>\n\n
