Even though he was born in a family of legal professionals, Justice Bhuyan has carved an illustrious path for himself in the field of law and justice. Let&#8217;s delve into his remarkable journey that led him to become the Judge of the Supreme Court of India.<\/p>\n<p style=\"text-align: center; font-weight: bold; font-size: 14.0pt; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">Early Life and Education<\/p>\n<p style=\"margin-bottom: 3%;\">Justice Ujjal Bhuyan was born on 2 August 1964, in Guwahati, to Suchendra Nath Bhuyan, who was a highly esteemed Senior Advocate and former Advocate General of Assam.<a id=\"fnref2\" href=\"#fn2\" title=\"2. Justice Ujjal Bhuyan, Supreme Court of India.\"><sup>2<\/sup><\/a> He completed his schooling at Don Bosco High School, Guwahati before pursuing his higher education at Cotton College, Guwahati.<a id=\"fnref3\" href=\"#fn3\" title=\"3. HONOURABLE THE CHIEF JUSTICE UJJAL BHUYAN, High Court for State of Telangana.\"><sup>3<\/sup><\/a><\/p>\n<p style=\"margin-bottom: 3%;\">Justice Bhuyan obtained a degree in Arts from Kirori Mal College, Delhi. He pursued his LL.B. degree from Government Law College, Guwahati and later earned his LL.M. degree from Gauhati University.<a id=\"fnref4\" href=\"#fn4\" title=\"4. He practiced law at the Principal Seat of the Gauhati High Court in Guwahati and appeared before its Benches in Agartala, Shillong, Kohima, and Itanagar. His expertise extended to other forums, including the Central Administrative Tribunal in Guwahati, the Assam Board of Revenue, the Labour Court in Guwahati, various Civil Courts, and the State Consumer Forum in Arunachal Pradesh.<a id=\"fnref6\" href=\"#fn6\" title=\"6. HONOURABLE THE CHIEF JUSTICE UJJAL BHUYAN, High Court for State of Telangana.\"><sup>6<\/sup><\/a><\/p>\n<p style=\"margin-bottom: 3%;\">Justice Bhuyan&#8217;s remarkable legal acumen led him to hold several prominent positions, such as- the Standing Counsel of the Income Tax Department and later Senior Standing Counsel of the Income Tax Department, the Additional Government Advocate of Meghalaya in the Principal Seat of the Gauhati High Court from April 2002 to October 2006, the Special Counsel of the Forest Department, Government of Arunachal Pradesh, from December 2005 to April 2009 and the Standing Counsel of the Gauhati High Court.<a id=\"fnref7\" href=\"#fn7\" title=\"7. Hon'ble Mr. Justice Ujjal Bhuyan, The Gauhati High Court.\"><sup>7<\/sup><\/a> Justice Bhuyan served as the Standing Counsel of the Income Tax Department for a period of 16 years.<a id=\"fnref8\" href=\"#fn8\" title=\"8. In conversation with Justice Ujjal Bhuyan on his journey from Bar to Bench, SCC Times.\"><sup>8<\/sup><\/a> The Gauhati High Court designated Justice Bhuyan as a Senior Advocate on 6 September 2010. He was appointed as the Additional Advocate General of Assam on 21 July 2011.<a id=\"fnref9\" href=\"#fn9\" title=\"9. Supra.\"><sup>9<\/sup><\/a><\/p>\n<p style=\"margin-bottom: 3%;\">Throughout his career, Justice Ujjal Bhuyan actively participated in various legal associations. He was a valued member of the Gauhati High Court Bar Association, Lawyers Association in Guwahati, Bar Association of India, All India Federation of Tax Practitioners, and Indian Law Institute, Assam Chapter. Justice Bhuyan also has been closely associated with the Judicial Academy, Assam, and the National Law University, Guwahati.<a id=\"fnref10\" href=\"#fn10\" title=\"10. His commendable performance led to his confirmation as a Permanent Judge of Gauhati High Court on 20 March 2013. During his tenure as Judge, Justice Bhuyan also served as the Executive Chairman of the Mizoram State Legal Services Authority.<a id=\"fnref11\" href=\"#fn11\" title=\"11. Supra\"><sup>11<\/sup><\/a><\/p>\n<p style=\"margin-bottom: 3%;\">Justice Bhuyan was transferred to the High Court of Bombay and took the oath as a Judge on 3 October 2019.<a id=\"fnref12\" href=\"#fn12\" title=\"12. He was entrusted with the responsibility of being the Executive Chairman of the Telangana State Legal Services Authority.<a id=\"fnref13\" href=\"#fn13\" title=\"13. Collegium recommends elevation of Telangana, Kerala Chief Justices Ujjal Bhuyan and S Venkatanarayana Bhatti as Supreme Court judges, SCC Times\"><sup>15<\/sup><\/a> and on 14 July 2023, Justice Ujjal Bhuyan was sworn in as the Judge of Supreme Court of India.<a id=\"fnref16\" href=\"#fn16\" title=\"16. Justice Ujjal Bhuyan and Justice S. Collegium recommends elevation of Telangana, Kerala Chief Justices Ujjal Bhuyan and S Venkatanarayana Bhatti as Supreme Court judges, SCC Times.\"><sup>17<\/sup><\/a><\/span><\/p>\n<\/li>\n<\/ul>\n<p style=\"text-align: center; font-weight: bold; font-size: 14.0pt; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">Important Judgments<\/p>\n<p style=\"margin-bottom: 3%;\">While considering this petition seeking restraining of upcoming film titled &#8220;Ghooskhor Pandat&#8221; in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Atul Mishra<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/cH2348Jb\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">2026 SCC OnLine SC 321<\/span><\/a><\/span>, which, as per the petitioner, creates<\/span> <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/02\/26\/free-speech-vilify-communities-sc-ghooskhor-pandat-case\/\" target=\"_blank\">offensive stereotyping against an identifiable community and violates their right to dignity<\/a> under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574949\" target=\"_blank\">21<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a>, the Division Bench of B.V. The respondent had further assured that the withdrawn title shall not be used in any manner whatsoever.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">In a separate opinion, <span style=\"font-weight: bold;\">Ujjal Bhuyan, J*.<\/span>, stated that this petition involved fundamental questions on fraternity and free speech and stated that it is constitutionally impermissible for anybody, be it the State or non-state actors, through any medium, such as, speeches, memes, cartoons, visual arts etc. to vilify and denigrate any community. <span style=\"font-weight: bold;\">&#8220;It will be violative of the Constitution to target any particular community on the basis of religion, language, caste or region by whosoever he or she may be. This is particularly true for public figures occupying high constitutional once who have taken the solemn oath to uphold the Constitution&#8221;.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">While considering this matter revolving around interface between Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554070\" target=\"_blank\">43-D(5)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002808781\" target=\"_blank\">Unlawful Activities (Prevention) Act, 1967<\/a> (UAPA) and the constitutional guarantee of personal liberty under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574949\" target=\"_blank\">21<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a> and the propriety of <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/05\/20\/sc-verdict-decoded-bail-is-rule-uapa-gulfisha-fatima-concerns\/\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">smaller Benches hollowing out constitutional force of a larger Bench decision<\/span><\/a> without expressly disagreeing with it in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Syed Iftikhar Andrabi<\/span> v. <span style=\"font-style: italic;\">NIA<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/gFC01x3J\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">2026 SCC OnLine SC 881<\/span><\/a><\/span>; the Division Bench of B.V. Nagarathna and Ujjal Bhuyan*, JJ., expressed serious reservations on several aspects of the judgment rendered by a co-equal Bench in <span style=\"font-style: italic;\">Gulfisha Fatima<\/span> v. <span style=\"font-style: italic;\">State (NCT of Delhi)<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/p4SsK2cU\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">2026 SCC OnLine SC 10<\/span><\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court clarified that the often-invoked principle &#8220;bail is the rule and jail is the exception&#8221; flows from the constitutional primacy of personal liberty under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574949\" target=\"_blank\">21<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a> and, therefore, cannot be displaced by legislation. The Court further clarified that three-Judge Bench decision in <span style=\"font-style: italic;\">Union of India<\/span> v. <span style=\"font-style: italic;\">K.A. Najeeb<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/lD631q3N\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">(2021) 3 SCC 713<\/span><\/a>, is binding law entitled to the protection of stare decisis. It cannot be diluted, circumvented, or disregarded by trial courts, High Courts or even by Benches of lower strength of Supreme Court. It was reiterated that K.A. Najeeb was not warning courts against treating incarceration as the sole factor favouring bail. Instead, it was warning against treating the statutory embargo as the sole factor justifying continued detention by ignoring constitutional principles. Therefore, the subsequent reading that K.A. Najeeb does not create an automatic entitlement to bail on account of delay answers a proposition that Najeeb itself never advanced.<\/p>\n<p>In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Om Prakash Chhawnika<\/span> v. <span style=\"font-style: italic;\">State of Jharkhand<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/S68lqeY4\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">2026 SCC OnLine SC 676<\/span><\/a><\/span>, a petition for special leave to appeal, assailing the Jharkhand High Court order, during an <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/04\/25\/sc-courts-cannot-issue-surrender-directions-in-anticipatory-bail-hearing\/\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">anticipatory bail hearing<\/span><\/a>, directing the petitioner to surrender before the court and then seek a regular bail, the Division Bench of J.B. Pardiwala and Ujjal Bhuyan, JJ., held that the High Court order was &#8220;wholly without jurisdiction&#8221; and stated that,<\/p>\n<p style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">&#8220;If the Court wants to reject the anticipatory bail, it may do so but the Court has no jurisdiction to say that the petitioner should now surrender.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">While considering this appeal by Canara Bank (the appellant) challenging the decision of National Consumer Dispute Redressal Commission (NCDRC) directing the appellant to pay 10 per cent of the loss incurred to the respondent due to <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/04\/17\/delayed-cheque-presentation-without-reason-deficiency-in-service-sc\/\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">delayed cheque presentation<\/span><\/a> by the appellant for clearing or collection within the validity period; the Division Bench of B.V. Nagarathna and <span style=\"font-weight: bold;\">Ujjal Bhuyan*<\/span>, JJ., in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Canara Bank<\/span> v. <span style=\"font-style: italic;\">Kavita Chowdhary<\/span><\/span>, <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/Nj64N7AS\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">2026 SCC OnLine SC 591<\/span><\/a><\/span>, held that a bank receiving cheques for collection, acts as an agent of the customer and is under an obligation to exercise due diligence in presenting the instruments within the prescribed validity period. Failure to do so results in the instrument becoming stale and in the absence of any reasonable explanation, would result in negligence in the discharge of banking duties which would constitute deficiency in rendering service within the meaning of the consumer protection law.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Abhaykumar Anandkumar Bhambore<\/span> v. <span style=\"font-style: italic;\">Ortho Relief Hospital and Research Centre<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/21NK08Y4\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">2026 SCC OnLine SC 736<\/span><\/a><\/span>, a special leave petition assailing the Bombay High Court order wherein Petitioner 1 was held liable under Section 138, <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/04\/28\/sc-dismisses-plea-against-directors-s138-ni-act-liability-during-liquidation\/\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">Negotiable Instruments Act, 1881 (NI Act), even though the company was under liquidation<\/span><\/a>, the Division Bench of B.V. Nagarathna and Ujjal Bhuyan, JJ., refused to interfere with the High Court order and dismissed the SLP.<\/p>\n<p style=\"margin-bottom: 3%;\">While considering the matter in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Dinesh Kalway<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/V92CjvK7\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">2026 SCC OnLine SC 675<\/span><\/a><\/span>, wherein the appellant was aggrieved with rectification of Form No. SVLDRS-3 by the designated committee, thereby revising the amount payable as tax, which was done without any notice to the appellant; the Division Bench of B.V. Nagarathna and Ujjal Bhuyan, JJ., found that the <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/04\/28\/sc-quashes-tax-demand-natural-justice-breach\/\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">impugned enhancement in tax demand was made without issuance<\/span><\/a> of any show-cause notice (SCN) and furthermore, the appellant was not heard in the matter. The Court thus held that this action by the designated committee was an instance of violation of principles of natural justice.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">R.S. Kadian<\/span> v. <span style=\"font-style: italic;\">Ajay Kumar Bhalla<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/NXc86ang\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">2025 SCC OnLine SC 984<\/span><\/a><\/span>, a civil special leave petition by a former Commandant with the Border Security Force (BSF) who was <a href=\"https:\/\/www.scconline.com\/blog\/post\/2025\/04\/29\/promotion-denied-based-on-adverse-confidential-reports-which-were-never-conveyed-to-employee-sc\/\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">denied promotion to the post of Deputy Inspector General (DIG) from the date his juniors were promoted<\/span><\/a>, the three-Judge Bench of Surya Kant, Dipankar Datta, and Ujjal Bhuyan, JJ. allowed the appeals, directing the respondents to consider his case afresh. State of Maharashtra<\/span>, <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/O7Ox6ohG\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">(2025) 3 SCC 565<\/span><\/a><\/span>, a criminal appeal against the Bombay High Court&#8217;s decision, whereby the Trial Court&#8217;s decision convicting the accused under <a href=\"http:\/\/www.scconline.com\/DocumentLink\/36kB36D7\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">Section 302<\/span><\/a> IPC and sentenced to undergo rigorous imprisonment for life and pay a fine of Rs. 1,000\/-, was affirmed, the Division Bench Abhay S. Oka and <span style=\"font-weight: bold;\">Ujjal Bhuyan*<\/span>, JJ. allowed the appeal holding that the evidence on the basis of which the prosecution sought conviction of the accused i.e. <a href=\"https:\/\/www.scconline.com\/blog\/post\/2025\/02\/07\/extra-judicial-confession-lacked-credibility-sc-acquits-murder-convict\/\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">extra-judicial confession made before the witnesses, lacked credibility<\/span><\/a>. The Court also added that the evidence suffered from material contradiction. Thus, the Court quashed the High Court&#8217;s decision affirming the Trial Court&#8217;s view.<\/p>\n<p style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">&#8220;A free and voluntary confession is deserving of the highest credit because it is presumed to flow from the highest sense of guilt.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold; font-style: italic;\">Somdatt Builders -NCC &#8211; NEC(JV) v. National Highways Authority of India<\/span>, <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/v37J1Rnv\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">2025 SCC OnLine SC 170<\/span><\/a><\/span>, a civil appeal against the Delhi High Court&#8217;s decision allowing the respondent- National Highways Authority of India&#8217;s (&#8216;NHAI&#8217;) appeal under <a href=\"http:\/\/www.scconline.com\/DocumentLink\/0Vi7sQsH\" target=\"_blank\"><span class=\"Hyperlink\"><span style=\"color: #467886;\">Section 37<\/span>,<\/span><\/a> <a href=\"http:\/\/www.scconline.com\/DocumentLink\/QWdt5a4f\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">Arbitration and Conciliation Act, 1996<\/span><\/a> (&#8216;the 1996 Act&#8217;) and setting aside the Single Judge&#8217;s view, the Division Bench of Abhay S. Oka and <span style=\"font-weight: bold;\">Ujjal Bhuyan*<\/span>, JJ. allowed the appeal and set aside the impugned decision. The Bench restored the Arbitral Tribunal&#8217;s award holding that the Arbitral Tribunal had interpreted Clause 51 in a reasonable manner based on the evidence on record and this interpretation was affirmed by the Single Judge exercising jurisdiction under Section <a href=\"http:\/\/www.scconline.com\/DocumentLink\/QWdt5a4f\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">34<\/span><\/a> of the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/QWdt5a4f\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">1996 Act<\/span><\/a>. The Bench held that the Division Bench of the High Court was not at all justified in setting aside the arbitral award exercising extremely limited jurisdiction under <a href=\"http:\/\/www.scconline.com\/DocumentLink\/0Vi7sQsH\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">Section 37<\/span><\/a> of the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/QWdt5a4f\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">1996 Act<\/span><\/a> by merely using expressions like &#8216;opposed to the public policy of India&#8217;, &#8216;patent illegality&#8217; and &#8216;shocking the conscience of the court&#8217;. The Court reiterated that it is necessary to remind the Courts that a great deal of restraint is required to be shown while examining the validity of an arbitral award when such an award has been upheld, wholly or substantially, under <a href=\"http:\/\/www.scconline.com\/DocumentLink\/QWdt5a4f\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">Section 34<\/span><\/a> of the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/QWdt5a4f\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">1996 Act<\/span><\/a>. <a href=\"https:\/\/www.scconline.com\/blog\/post\/2025\/01\/30\/sc-reiterates-narrow-scope-of-appellate-court-power-under-s-37-of-ac-act\/\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">Frequent interference with arbitral awards would defeat the very purpose of the 1996 Act<\/span><\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold; font-style: italic;\">Arvind Kejriwal v. CBI<\/span>, <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/Q0Bn2cAj\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">2024 SCC OnLine SC 2550<\/span><\/a><\/span>, a set of two criminal appeals by Delhi Chief Minister Arvind Kejriwal seeking bail in the Central Bureau of Investigation&#8217;s (&#8216;CBI&#8217;) case in the Delhi Excise Liquor Policy matter and challenging the legality of his arrest by the CBI, the Division Bench of Surya Kant and<span style=\"font-weight: bold;\"> Ujjal Bhuyan*<\/span>, JJ<span style=\"font-weight: bold;\">.<\/span> granted him bail. While separate judgments were penned by Justice Bhuyan and Kant, however, there was a concurrent opinion that Kejriwal was entitled to be released on bail, subject to the terms and conditions. Justice Surya Kant dismissed the appeal challenging the legality of his arrest, holding that arrest by CBI was justified and that there was no procedural infirmity. Justice Bhuyan in his separate judgment differed on this and said that <a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/09\/13\/supreme-court-grants-bail-delhi-cm-arvind-kejriwal-cbi-case-delhi-excise-liquor-policy\/\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">Kejriwal&#8217;s arrest by the CBI was perhaps only to frustrate the bail granted to Kejriwal in the ED case<\/span><\/a>. He stated that, when CBI did not feel the necessity to arrest him for 22 long months, he failed to understand the great hurry and urgency on the part of the CBI to arrest Kejriwal when he was on the cusp of release in the ED case.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold; font-style: italic;\">Bijender Singh v. Union of India<\/span>, <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/Tmc8309G\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">2025 SCC OnLine SC 895<\/span><\/a><\/span>, a civil appeal filed by the appellant challenging the orders of the Armed Forces Tribunal which had denied him disability pension holding that his disability was less than 20% and not attributable to military service, the Division Bench of Abhay S. Oka and <span style=\"font-weight: bold;\">Ujjal Bhuyan*<\/span>, JJ. set aside the Tribunal&#8217;s order, holding it unsustainable in law. The Court emphasized that if no disability was noted at the time of entry into service, it should be presumed that the disability was due to military service, and the burden of proving otherwise rests on the employer. The Court also reiterated that a disability leading to invaliding out of service should be assumed to be above 20% and attract a 50% disability pension. Consequently, the Court directed the respondents to grant the appellant disability pension at 50% with arrears and interest.<\/p>\n<p style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">&#8220;The morale of the armed forces requires absolute and undiluted protection. If any injury leads to loss of service without any recompense, this morale would be severely undermined.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold; font-style: italic;\">Ram Singh v. State of Uttar Pradesh<\/span>, <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/398f5986\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">(2024) 4 SCC 208<\/span><\/a><\/span>, a criminal appeal filed by accused challenging his conviction under <a href=\"http:\/\/www.scconline.com\/DocumentLink\/hF8R4TLX\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">Section 301<\/span><\/a> read with <a href=\"http:\/\/www.scconline.com\/DocumentLink\/hF8R4TLX\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">302<\/span><\/a> IPC, the Division Bench of Abhay S. State of W.B.<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/6cLR7C10\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">(2023) 1 HCC (Cal) 626<\/span><\/a>, whereby the High Court issued a slew of advisories to the male and female adolescents regarding the respect of a woman, protection of self-worth, dignity and privacy, and right to autonomy of the female&#8217;s body, and advised the female adolescent, <a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/08\/20\/supreme-court-sets-aside-calcutta-hc-verdict-advising-girls-to-control-sexual-urge\/\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #467886;\">identifying the duty or obligation to control sexual urge\/urges as in the eyes of society she is the looser when she gives in to enjoying the sexual pleasure of hardly two minutes<\/span><\/a>, the Division Bench of Abhay S Oka and Ujjal Bhuyan, JJ. set aside the impugned decision. The Court observed that the High Court was called upon to adjudicate only on the merits of the appeal and nothing else. Thus, the Court opined that such an enactment could no longer continue to find a place in our statute book and thus, was accordingly declared as unconstitutional.<\/p>\n<p style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">&#8220;Constitutional morality impacts upon any law which deprives the LGBT individuals of their entitlement to a full and equal citizenship. LGBT individuals living under threats of conformity grounded in cultural morality have been denied basic human existence. The sine qua non for exercising powers under Section 5(1) was found to be that attaching authorities must have &#8220;reasons to believe&#8221;, recorded in writing, as the basis for inferring that the person is in possession of proceeds of crime, which are likely to be concealed.
