Mohana, JJ.<\/span>, held that the concerns raised by the petitioner were already substantially addressed through the existing institutional, procedural and technological framework. Emphasising that &#8220;access to constitutional remedies ought not to be held hostage to the clock&#8221;, the Court observed that the e-filing system, virtual hearing infrastructure, dedicated mechanisms for urgent listing, designated Vacation Officers and the long-standing practice of convening Benches beyond notified court hours sufficiently ensure timely access to constitutional remedies in cases involving exceptional urgency.<\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">The present public interest writ petition was filed before the Court seeking the establishment of a permanent institutional mechanism to ensure round-the-clock access to Constitutional Courts in cases involving imminent threats to life, personal liberty and other fundamental rights. The petitioner contended that while remedies under Articles <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001575141\" target=\"_blank\">32<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574969\" target=\"_blank\">226<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a> remain constitutionally available at all times, the absence of a uniform system for hearing urgent matters beyond regular court hours, weekends, public holidays and court vacations often renders such remedies ineffective in situations requiring immediate judicial intervention.<\/p>\n<p style=\"margin-bottom: 3%;\">Highlighting instances such as illegal detention, imminent demolition, deportation proceedings and custodial violence, the petitioner argued that affected persons are frequently left without timely access to Constitutional Courts. It was therefore prayed that the Court issue appropriate directions to institutionalise emergency Constitutional Benches or designated duty Judges, facilitate urgent electronic filing, and frame guidelines under Article 142 to ensure continuous and meaningful access to constitutional remedies until suitable rules are formulated by the competent authorities.<\/p>\n<p style=\"font-weight: bold;\">Analysis<\/p>\n<p style=\"margin-bottom: 3%;\">The Supreme Court observed that the concern raised by the petitioner that access to constitutional remedies should not be held hostage to the clock was one with which it was in &#8220;complete agreement&#8221;. However, the Court held that the safeguards sought by the petitioner were already substantially embedded in the existing judicial framework. It noted that the e-filing system and the Integrated Case Management Information System enable litigants to institute proceedings electronically at any time, while the virtual hearing infrastructure ensures that physical access to a courtroom is not a precondition for obtaining judicial relief. The Court further highlighted the existing mechanism for the listing of urgent matters, including dedicated procedures for cases involving personal liberty, the provision for mentioning exceptionally urgent matters before the Chief Justice of India through the Registry, and the appointment of designated Vacation Officers to facilitate hearings after court hours, on weekends and during holidays.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that, under Circular dated 29 November 2025, urgent matters involving personal liberty are accorded priority in listing and, subject to removal of office objections, are ordinarily listed for hearing within the next two working days.<\/p>\n<p style=\"margin-bottom: 3%;\">It also underscored that Constitutional Courts have consistently convened beyond notified working hours whenever the exigencies of justice demanded, including in matters involving imminent threats to life and personal liberty, and that the offices of the Chief Justice of India and the Chief Justices of the High Courts remain open to receive urgent representations requiring immediate judicial attention.<\/p>\n<p style=\"margin-bottom: 3%;\">Holding that judicial administration must strike a balance between ensuring immediate access to justice and maintaining an orderly system of roster allocation and case management, the Court concluded that the existing institutional, procedural and technological framework adequately addresses the grievance raised in the petition.
