Sundresh and Prasanna B. Varale, JJ.<\/span>, held that a plea regarding the adequacy of the grounds of arrest cannot be invoked in a subsequent bail application after earlier bail rejections on merits. Distinguishing such a case from complete non-service of the grounds of arrest, the Court set aside the respondent&#8217;s bail while permitting a fresh bail application if the trial is not concluded within 6 months.<\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">The present appeal was filed by the State of Meghalaya challenging the orders of the trial court and the High Court granting bail to the respondent in connection with an FIR registered under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803438\" target=\"_blank\">103(1)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803587\" target=\"_blank\">238(<span style=\"font-style: italic;\">a<\/span>)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803666\" target=\"_blank\">309(6)<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803655\" target=\"_blank\">3(6)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\">Nyaya Sanhita, 2023<\/a> (BNS). Subsequently, by way of a supplementary charge-sheet, the respondent was also charged under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001567304\" target=\"_blank\">25(1)(A)<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001567315\" target=\"_blank\">35<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002775593\" target=\"_blank\">Arms Act, 1959<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">According to the prosecution, after their marriage, the respondent accompanied the deceased to Meghalaya for their honeymoon. During the honeymoon, the deceased was allegedly murdered, and his body was pushed into a gorge with the help of 3 accomplices allegedly hired by the respondent and her alleged romantic partner.<\/p>\n<p style=\"margin-bottom: 3%;\">When the whereabouts of the couple became unknown, the deceased&#8217;s brother lodged a missing person complaint on 26 May 2025. The deceased&#8217;s body was recovered from a deep gorge on 2 June 2025, and a post-mortem examination was conducted on 3 June 2025, following which the FIR came to be registered. The respondent thereafter surrendered before Nandghanj Police Station, Isopur, Uttar Pradesh. She was subsequently arrested by the Meghalaya Police at Kotwali Police Station, Ghazipur, Uttar Pradesh, on 9 June 2025, following which an application for transit remand was moved before the Chief Judicial Magistrate, Ghazipur.<\/p>\n<p style=\"margin-bottom: 3%;\">The prosecution asserted that the grounds of arrest, along with the relevant documents, were supplied to the respondent on 9 June 2025. However, the grounds of arrest mentioned Section 403(1) BNS instead of Section 103(1), which the prosecution described as an apparent typographical error. While remanding the respondent to judicial custody on 11 June 2025, the Judicial Magistrate First Class, Sohra, recorded that the respondent was aware of the reasons and grounds of her arrest and informed her of her right to legal representation.<\/p>\n<p style=\"margin-bottom: 3%;\">After the filing of the charge-sheet on 5 September 2025 and framing of charges on 28 October 2025, the respondent filed 3 successive bail applications before the trial court seeking bail on merits. Those applications were followed by a fourth bail application, not on merits, but on the ground that the mandate regarding communication of the grounds of arrest had not been complied with and that the document supplied as the grounds of arrest was devoid of material particulars. Accepting the respondent&#8217;s contention in light of the decisions of the Supreme Court, the trial court granted bail, which was affirmed by the High Court. Aggrieved thereby, the State preferred the present appeal before the Supreme Court.<\/p>\n<p style=\"margin-bottom: 3%; font-weight: bold;\">Also Read: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/07\/07\/raja-raghuvanshi-murder-case-sonam-raghuvanshi-bail-supreme-court\/\" target=\"_blank\">State Challenges Sonam Raghuvanshi&#8217;s Bail Before Supreme Court in Raja Raghuvanshi Murder Case | SCC Times<\/a><\/p>\n<p style=\"font-weight: bold;\">Primary contentions of the parties<\/p>\n<p style=\"margin-bottom: 3%;\">Assailing the orders granting bail, the State contended that the decision in <span style=\"font-style: italic;\">Mihir Rajesh Shah<\/span> v. <span style=\"font-style: italic;\">State of Maharashtra<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/9eOP6WY2\" target=\"_blank\">(2026) 1 SCC 500<\/a>, was prospective in nature. It was submitted that the respondent had surrendered before the police and had been supplied with the grounds of arrest as well as the relevant documents. The State further relied on the remand order, wherein the Judicial Magistrate had recorded that the respondent was aware of the reasons and grounds of her arrest. It was also contended that the plea of non-compliance with the requirement to communicate the grounds of arrest was raised only in the respondent&#8217;s fourth bail application, after her earlier applications seeking bail on merits had been rejected. Emphasising the seriousness of the allegations, the State submitted that the orders granting bail were liable to be set aside.<\/p>\n<p style=\"margin-bottom: 3%;\">Supporting the impugned orders, the respondent contended that the essence of Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574961\" target=\"_blank\">22(1)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a> was required to be seen. It was submitted that the document served upon her was merely a mechanically printed format, referred to an incorrect penal provision, and did not disclose the actual reasons for her arrest. According to the respondent, the defect went to the root of the arrest and, being a constitutional infirmity, was incapable of being cured or waived. It was further submitted that the prosecution was yet to establish the charges and could not presume the respondent&#8217;s guilt.<\/p>\n<p style=\"margin-bottom: 3%; font-weight: bold;\">Also Read: Also Read: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2025\/03\/06\/delhi-hc-bail-grounds-of-arrest-arrest-memo-legal-news\/\" target=\"_blank\">Grounds of arrest must be served in writing simultaneously with arrest memo; Delhi High Court grants bail in abetment to suicide case | SCC Times<\/a> <\/p>\n<p style=\"font-weight: bold;\">Analysis, Findings and Decision<\/p>\n<p style=\"margin-bottom: 3%;\">At the outset, the Court stated that it was a settled position of law that serving of the grounds of arrest is mandatory. The Court noted that, although such a procedure is not expressly contemplated by law, this Court introduced the requirement in <span style=\"font-style: italic;\">Mihir Rajesh Shah<\/span> to give effect to Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574961\" target=\"_blank\">22(1)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a>. Therefore, for the said reason, the decision was made to apply prospectively. The Court also noted that the respondent in the present case was arrested much prior to the pronouncement of the said case.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that, apart from the respondent being absent and consequently untraceable after the occurrence, the law does not prohibit the investigating agency from re-arresting an accused. The Court held that where an accused is enlarged on bail on account of non-compliance with the requirement of serving the grounds of arrest, such enlargement would not operate as a fetter on the investigating agency from re-arresting the accused for investigation.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further held that the respondent was not entitled to bail either on merits or on the grounds accepted by the trial court and the High Court. The Court distinguished between non-service of the grounds of arrest and non-furnishing of adequate reasons in the grounds of arrest, observing that while the former may vitiate the arrest, in the latter case the Court must examine whether any prejudice was caused to the accused. Applying this distinction, the Court noted that the respondent had admittedly been served with the grounds of arrest and that her grievance was only as to the adequacy of the reasons stated therein. The Court also took note of the fact that the respondent raised this objection only in her fourth bail application before the trial court.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court examined the respondent&#8217;s contention that there can be no waiver of the right guaranteed under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574961\" target=\"_blank\">22(1)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a> and that, therefore, the stage at which the plea regarding the grounds of arrest is raised is immaterial. The Court clarified that while the stage at which such a plea is raised may not matter in an ordinary bail application, an accused who has sought and obtained findings on merits in earlier bail applications cannot subsequently turn around and raise a plea relating to the grounds of arrest.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that the respondent had expressed satisfaction before the Judicial Magistrate regarding the reasons for her arrest and that the relevant documents had also been furnished to her. Therefore, the Court declined to examine whether the case involved the respondent&#8217;s voluntary surrender or her arrest by the appellant followed by production before the Court. The Court held that both the trial court and the High Court had erred in granting bail by relying on the decisions of this Court.<\/p>\n<p style=\"margin-left: 36pt; margin-bottom: 3%; font-weight: bold;\">&#8220;We are conscious of the fact that bail is the rule and jail is the exception. Presumption of innocence enures to every accused. However, we are dealing with a specific case where the earlier orders rejecting the bail applications of the respondent, on merits, have attained finality, and the trial has already begun.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that the present case stood on a different footing as the earlier orders rejecting the respondent&#8217;s bail on merits had attained finality and the trial had already commenced.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court held that the respondent&#8217;s continued release on bail at that stage might hinder the ongoing trial, and thus set aside the bail granted by the High Court and the trial court.
