Sundresh and Prasanna B. Varale, JJ.<\/span>, held that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540679\" target=\"_blank\">77-B<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\">IT Act<\/a> has to be read to ascertain the nature of the offence provided under Section 66 and set aside the High Court order.<\/p>\n<p style=\"margin-bottom: 3%;\">The appeal arose from the High Court&#8217;s order disposing of a writ petition seeking a writ of habeas corpus for the release of the appellant&#8217;s son. The appellant&#8217;s son had been detained at the airport pursuant to a Look Out Circular issued in connection with an FIR registered under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540650\" target=\"_blank\">66<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540671\" target=\"_blank\">72<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540693\" target=\"_blank\">84-C<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\">IT Act<\/a> and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803767\" target=\"_blank\">78(1)(<span style=\"font-style: italic;\">ii<\/span>)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\">Nyaya Sanhita, 2023<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">While disposing of the writ petition, the High Court had observed that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540650\" target=\"_blank\">66<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\">IT Act<\/a> had not been defined as a bailable offence under the Act. The Supreme Court noted that it had issued a limited notice with respect to the legal issue involving Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540650\" target=\"_blank\">66<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\">IT Act<\/a>, which had been treated as a non-bailable offence by the High Court.<\/p>\n<p style=\"margin-bottom: 3%;\">The Supreme Court held that the High Court had not taken into consideration Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540679\" target=\"_blank\">77-B<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\">IT Act<\/a>, which has to be read to ascertain the nature of the offence under Section 66. Accordingly, the Court set aside the High Court&#8217;s observation that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540650\" target=\"_blank\">66<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\">IT Act<\/a> had not been defined as a bailable offence under the Act and disposed of the appeal with the aforesaid clarification.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\"><span style=\"font-style: italic;\">Maharaj Saran<\/span> v. <span style=\"font-style: italic;\">State of Punjab<\/span>, SLP (Crl.)
