Chhattisgarh High Court:<\/span> In a writ petition under Article 226<\/a> of the Constitution<\/a> seeking compensation on account of death due to electrocution, a Single Judge Bench of Amitendra Kishore Prasad<\/span>, J., held that the death having occurred due to electrocution while operating a domestic tullu pump within the residential premises did not fall within the scope and coverage of the Circular dated 10 September 2018 (Circular) governing the grant of compensation in specified cases of electrical accidents. Holding that the petitioner was not entitled to compensation under the Circular, the Court dismissed the writ petition. However, observing that the rejection order on the compensation application had not been communicated to the applicant, the Court directed the respondent authorities to ensure that every order passed on an application is duly communicated to the concerned applicant without delay.<\/p>\n

Background<\/p>\n

The dispute arose from the petitioner’s claim seeking compensation on account of the untimely death of his wife due to electrocution. The petitioner contended that his wife died on 2 November 2024 due to electrocution and that although the final report submitted by the police authorities concerned recorded that the deceased died due to electrocution while operating a tullu pump, the electrocution occurred primarily on account of the negligence of the Chhattisgarh State Power Distribution Company Limited (Distribution Company).<\/p>\n

It was, therefore, argued that since the death was caused by such negligence, the petitioner was legally entitled to payment of appropriate compensation from the respondent authorities.<\/p>\n

However, the respondent authorities contended that the petitioner’s wife died within the domestic premises while operating a tullu pump and therefore, the case did not fall within the ambit of the compensation scheme envisaged under the Circular dated 10 September 2018. It was further submitted that the petitioner’s application seeking compensation had already been duly considered and rejected by order dated 10 October 2025.<\/p>\n

Accordingly, it was contended that the petitioner was not entitled to any compensation under the Circular.<\/p>\n

Analysis<\/p>\n

The Court, after hearing counsel for the parties at length and upon perusal of the material available on record, particularly the final report submitted by the police authorities concerned as well as the Circular dated 10 September 2018, found that the death occurred due to electrocution while operating a domestic tullu pump within the residential premises. The Court observed that such an incident does not fall within the scope and coverage of the Circular, which governs the grant of compensation in specified cases of electrical accidents.<\/p>\n

In view of the express provisions contained in the Circular, the Court was of the considered opinion that the petitioner was not entitled to the relief of compensation as claimed in the writ petition. Consequently, the Court held that the writ petition, being devoid of merit, deserved to be and was accordingly dismissed.<\/p>\n

However, the Court emphasised that although the respondent authorities contended that the petitioner’s application for compensation was rejected by order dated 10 October 2025, there is nothing on record to indicate that the said order was ever communicated to the petitioner. The Court observed that no endorsement or other material has been placed before the Court to establish that a copy of the rejection order was served upon or dispatched to the petitioner.<\/p>\n

The Court noted that such a lapse on the part of the authorities is a matter of serious concern, as every applicant is entitled to be informed of the fate of his application within a reasonable time. The Court highlighted that the failure to communicate the decision deprives the affected person of the opportunity to avail himself of appropriate legal remedies available under law.<\/p>\n

The Court remarked that it expects the competent officers of the Distribution Company to personally ensure that every order passed on an application is duly communicated to the applicant concerned without delay.<\/p>\n

Decision<\/p>\n

Accordingly, the Court directed the respondent authorities to exercise due care and ensure that such lapses are not repeated in the future, failing which the Court shall be constrained to take appropriate action in accordance with law.<\/p>\n
