{"id":391216,"date":"2026-07-23T12:00:23","date_gmt":"2026-07-23T06:30:23","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=391216"},"modified":"2026-07-23T11:44:47","modified_gmt":"2026-07-23T06:14:47","slug":"punjab-haryana-hc-quashes-cheating-fir-after-mediation-settlement","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/07\/23\/punjab-haryana-hc-quashes-cheating-fir-after-mediation-settlement\/","title":{"rendered":"&#8220;No useful purpose&#8221; in continuing trial after settlement: Punjab &amp; Haryana High Court quashes FIR in cheating case"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Punjab &amp; Haryana High Court:<\/span> While considering a petition filed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804270\" target=\"_blank\">528<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">Nagarik Suraksha Sanhita, 2023<\/a> (BNSS) for quashing of FIR registered for the offence of cheating under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803676\" target=\"_blank\">318(4)<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803677\" target=\"_blank\">319<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\">Nyaya Sanhita, 2023<\/a> (BNS), a Single Judge Bench of Manisha Batra, J., quashed the FIR considering the settlement agreement placed on record by the Mediation and Conciliation Centre and directed the parties to abide by the same.<\/p>\n<p style=\"margin-bottom: 3%; font-weight: bold;\">Also read: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2025\/11\/11\/compromise-cannot-wipe-out-criminal-liability-cheating-public-trust-ph-hc\/\" target=\"_blank\">Compromise cannot wipe out criminal liability in cheating affecting public trust: Punjab and Haryana High Court denies anticipatory bail<\/a><\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">In the present case, the said petition was originally filed seeking quashment of the aforementioned FIR, however, the parties submitted that there were chances of an amicable settlement between them.<\/p>\n<p style=\"margin-bottom: 3%;\">Accordingly, the matter was referred to the Mediation and Conciliation Centre of the Court pursuant to which a report was submitted to the Court stating that the parties amicably settled their dispute.<\/p>\n<p style=\"margin-bottom: 3%;\">Thus, the petitioner submitted that since the dispute stood amicably settled between the parties, the present petition deserved to be allowed.<\/p>\n<p style=\"font-weight: bold;\">Analysis and Decision<\/p>\n<p style=\"margin-bottom: 3%;\">The Court stated that no useful purpose would be served to continue with the proceedings before the trial court in the instant FIR.
