On 22 July 2026, the Supreme Court Bar Association (SCBA) issued a resolution condemning the brutal lathi charge on students and members of the legal fraternity. The SCBA President, Dr. Vikas Singh, Senior Advocate, also wrote a letter to Prime Minister Narendra Modi and Union Home Minister Amit Shah requesting a judicial enquiry and immediate action on the unprovoked police lathi charge during the ongoing peaceful student demonstration at Jantar Mantar and Sansad Marg.<\/p>\n

SCBA Resolution:<\/span><\/p>\n

In a resolution dated 22 July 2026, the SCBA condemned the brutal lathi charge on students and members of the legal fraternity, which resulted in serious injuries. The resolution stated that the use of excessive and disproportionate force against peaceful students and members of the Bar was deeply disturbing and wholly unacceptable in a democratic society.<\/p>\n

The SCBA called upon the authorities concerned to conduct an immediate, impartial, and time-bound inquiry into the incident, identify those responsible for the excessive use of force, and take appropriate action in accordance with law.<\/p>\n

It further urged the authorities to ensure proper medical treatment for all injured students and members of the legal fraternity and to take necessary measures to prevent recurrence of such incidents.<\/p>\n

The SCBA expressed its solidarity with all those injured and reiterated its commitment to protecting constitutional rights, human dignity, and the rule of law.<\/p>\n

SCBA President’s Letter:<\/span><\/p>\n

In his letter, he expressed concern that the unlawful and disproportionate police violence inflicted on peaceful student assemblies and the State’s failure in conducting national exams fairly strike at the core of constitutional democracy. He stated that during the recent peaceful demonstrations seeking accountability for NEET-UG Exam leaks and highlighting urgent concerns regarding employment, the police resorted to an unprovoked and excessive use of force. Multiple independent news organizations and ground reports documented severe injuries, statutory non-compliance, and police high-handedness.<\/p>\n

He mentioned:<\/p>\n

    \n
  1. \n

    Severe physical injuries and head strikes:<\/span> A media outlet recorded that over 100 protesters were injured and rushed to Ram Manohar Lohia and Lady Hardinge Hospitals, with four admitted to the ICU. Victims, including young students, reported being repeatedly struck directly on the head with lathis while bleeding or standing peacefully holding copies of the Constitution<\/a>.<\/p>\n<\/li>\n

  2. \n

    Participation of unidentified civilians in assault:<\/span> Ground reporting and video evidence confirm that plain-clothed individuals armed with lathis physically assaulted demonstrators alongside police without displaying badges or authorization.<\/p>\n<\/li>\n

  3. \n

    Violence against minors and female demonstrators:<\/span> Media reports verified that male police officers lathi-charged female protesters and minors, including a 16-year-old student who sustained injuries.<\/p>\n<\/li>\n

  4. \n

    Assault on and obstruction of independent journalists:<\/span> On-duty media personnel displaying credentials and independent video journalists were tear-gassed, physically shoved, threatened, and prevented from filming.<\/p>\n<\/li>\n

  5. \n

    Widespread concealment of identification:<\/span> Independent journalists observed numerous uniformed officers operating without mandatory name badges.<\/p>\n<\/li>\n

  6. \n

    Indiscriminate deployment of tear gas & heavy riot control:<\/span> Media sources documented relentless tear-gas shelling near Central Secretariat metro station and against static hunger-striking students, creating stampede-like conditions.<\/p>\n<\/li>\n

  7. \n

    Forcible dispersal of peaceful hunger strike:<\/span> Law enforcement dismantled the protest stage at Jantar Mantar, clearing non-violent hunger strikers and detaining organizers.<\/p>\n<\/li>\n

  8. \n

    Targeting of non-protesting medical teams and brutality on injured patients:<\/span> Eyewitness testimony and ground footage establish that police intentionally attacked medical doctors and healthcare personnel who were neither protesting nor chanting any slogans but purely administering first aid. When medical personnel clarified their duty, officers hostilely dismissed them and proceeded to assault them. Shockingly, the medical team recounted how officers stepped directly onto and struck unconscious patients lying on the ground with existing fractures, while also kicking female victims in the abdomen, treating helpless injured individuals with complete disregard for human life and basic medical emergency protocols.<\/p>\n<\/li>\n

  9. \n

    Self-inflicted and disproportionate narratives of Police injuries:<\/span> While claims have been circulated that between 50 and 118 police personnel sustained injuries during the demonstration, there is a complete absence of verifiable evidence to substantiate these assertions. Not a single video showed any police officer being struck by protesters. On the contrary, detailed ground investigations and unedited footage consistently revealed that the injuries allegedly suffered by law enforcement personnel arose primarily from self-induced stampedes, tactical mismanagement, and chaotic forward charges initiated by the police themselves while attempting to break through their own heavy barricades and forcibly disperse a peaceful assembly.<\/p>\n<\/li>\n<\/ol>\n

    He further mentioned that, illustrating the completely unguided nature of the police action, several advocates who were supporting the students were also assaulted. Amongst the many, the son of Senior Advocate Sanjay Hegde, a practicing lawyer and member of the SCBA, was beaten and manhandled amidst the peaceful crowd.<\/p>\n

    Dr. Singh remarked that it was deeply troubling that protest tactics once championed as the essence of democratic accountability were today met with brutal physical suppression by that very governance framework.<\/p>\n

    “When officers of the court, medical professionals providing humanitarian aid, and journalists documenting public events are subjected to direct physical violence alongside peaceful citizens, it highlights a terrifying collapse of executive restraint and a complete breakdown of constitutional order.”<\/span><\/p>\n

    He also contended that these actions of law enforcement constituted a direct violation of statutory mandates under the Nagarik Suraksha Sanhita, 2023<\/a> (BNSS), and binding judicial directives of the Supreme Court and the Delhi High Court. Section 148<\/a> BNSS<\/a> governs dispersal of “unlawful” assemblies by civil force and prohibits force as a first resort, whereas Section 149(3)<\/a> BNSS<\/a> codifies the Rule of Minimum Force.<\/p>\n

    On all the aforesaid counts, he submitted that the police brutality during the ‘Chalo Sansad’ demonstration amounted to constitutional violations as excessive force violated Article 21 (bodily integrity) and Article 19(1)(b) (peaceful assembly). He also stated that India stands at 157th out of 180 countries in the RSF 2026 World Press Freedom Index and that intimidating journalists undermines democratic oversight under Article 19(1)(a).<\/p>\n

    He added that the Supreme Court has consistently held that police force must be minimal, preventive, and never punitive, and that violence against citizens “peacefully” exercising their rights under Articles 19(1)(a) and 19(1)(b) is unconstitutional.<\/p>\n

    “The law of the land is absolutely clear that while limited force may sometimes be necessary, any excess, especially force beyond what is absolutely required, amounts to human rights violations.”<\/span><\/p>\n

    Furthermore, Dr. Singh contended that, prima facie, as gathered from the video footage available, the administrative rules and the Delhi Police Manual were also breached, as lathi charge, when legally authorized, must be strictly below the waist, and that the officers on public-order duty must display visible nameplates. Both mandates were violated.<\/p>\n

    He remarked that all national and state examination bodies have repeatedly failed to preserve the sanctity of public recruitment and entrance tests, directly infringing equal opportunity under Article 14 and the right to livelihood under Article 21. The peaceful assembly arose from this undeniable pattern of institutional failure.<\/p>\n

    “High-performing students invest years of disciplined preparation to excel yet find themselves trapped in a recurring cycle of paper leaks, prolonged litigation, administrative deferrals, and institutional indifference.”<\/span><\/p>\n

    He explained how, for countless families, this journey is built on profound sacrifice, such as selling or mortgaging lands and other assets, only to sustain a child’s dream of securing a dignified future.<\/p>\n

    “Student suicides in India have risen at an alarming pace, often linked to academic pressure, career uncertainty, and repeated disruptions in competitive examinations, a stark reminder of the human cost of systemic failure. Thousands of aspirants have now crossed the upper age limit due to these delays, suffering from insomnia, depression, and acute anxiety. Hundreds have tragically lost their lives following paper leaks, underscoring the urgent need for accountability and structural reform.”<\/span><\/p>\n

    He cited that from 2017 to 2024, repeated breaches across national and state examinations have affected millions of candidates, including the AIIMS MBBS exam (2017, 3 lakh candidates), SSC MTS (2017) and SSC CGL (2018, 16 lakh and 2 lakh candidates), the CBSE Class 10 & 12 papers (2018, 20 lakh students), JEE Mains and Army CEE (2021, 9 lakh applicants), NEET-UG (2024 and 2026, 16 lakh and 23 lakh aspirants), UGC NET and CSIR (2024, 11 lakh scholars), and the East Central Railway recruitment exam (2025, 2 lakh candidates). At the state level as well, widespread leaks marred major recruitment processes, including Rajasthan’s Teacher Eligibility Test (26 lakh candidates), Uttar Pradesh’s Police Constable exam (48 lakh candidates), and repeated breaches in Gujarat, Telangana, Uttarakhand, Bihar, and Maharashtra, collectively reflecting a nationwide collapse of examination integrity.<\/p>\n

    He claimed that despite the Public Examinations (Prevention of Unfair Means) Act, 2024<\/a>, being in force since June 2024, paper leaks have only increased. For this, he blamed loopholes in the statute such as no time-bound probe or trial, no standard investigation procedure, no check on past offenders or money laundering, no property confiscation, and no use of deception tests to find the actual culprits. Furthermore, the executive bodies, instead of fortifying security architecture or dismantling organized criminal syndicates, repeatedly resorted to arbitrary actions such as the recent blanket ban on digital communication tools such as Telegram, which acted as an implicit admission of administrative helplessness.<\/p>\n

    “When no authority accepts accountability for lost years, squandered opportunities, and lives derailed at the mercy of those in power, young citizens are left with no recourse but to lose hope entirely or to peacefully take to the streets to demand basic institutional integrity.”<\/span><\/p>\n

    To uphold constitutional governance, reinforce the rule of law, and restore public confidence in state institutions, he urged PM Modi and Home Minister Amit Shah to address the following:<\/p>\n

      \n
    1. \n

      Judicial Enquiry by a credible Supreme Court Judge:<\/span> Constitute a time-bound Judicial Commission headed by a ‘credible’ sitting or retired Supreme Court Judge under the Commissions of Inquiry Act, 1952<\/a> to examine the unprovoked police violence, investigate paper-leak networks, and determine institutional liabilities for the compounded issues at hand.<\/p>\n<\/li>\n

    2. \n

      Suspension of the Police Commissioner:<\/span> Order the immediate suspension of the Commissioner of Police in Delhi to facilitate a fair and impartial enquiry.<\/p>\n<\/li>\n

    3. \n

      Action against persons responsible for unprovoked lathi-charge:<\/span> Direct immediate registration of FIRs under relevant provisions of the Nyaya Sanhita, 2023, and initiate action against field officers and other government personnel who violated statutory procedures and police manuals.<\/p>\n<\/li>\n

    4. \n

      Fixation of administrative accountability for the Ministry of Education:<\/span> Ensure clear administrative responsibility is fixed on the Ministry of Education for chronic lapses in safeguarding the security and sanctity of national competitive examinations and initiate appropriate corrective and disciplinary measures for bringing back the trust of students in the examination process.<\/p>\n<\/li>\n<\/ol>\n

      “At all times, we must be conscious of the fact that the youth of our nation represent its future and core foundation. Yet, they are being pushed into deep despair by an administrative failure that jeopardizes their most critical years. Education is the primary pathway to dignified employment; when the impartiality of this gateway is shattered, the promise of meritocracy collapses.”<\/span><\/p>\n

      He further remarked that,<\/p>\n

      “The strength of a constitutional democracy is measured by its commitment to accountability and the Rule of Law. Swift, decisive executive action is required to ensure that state institutions remain subservient to the Constitution.”<\/span><\/p>\n
