A review of M.N. Rao: The Renaissance Man of Law<\/span> by Prof. Amita Dhanda, examining Justice M.N. Rao’s multifaceted contributions to Indian law, judicial philosophy, constitutionalism, and public life.<\/p>\n

This richly textured biography, aptly titled Renaissance Man of Law<\/span>, traces the lived experience of Justice M.N. Rao and seeks to explain his many-sided engagement with law. The term “Renaissance” is associated with a period that ushered in profound changes in art, literature, and politics, and Professor Amita Dhanda uses this metaphor to frame Justice Rao’s career as both wide-ranging and deeply rooted in social, economic, and cultural realities. Much like Renaissance art’s turn towards lived experience, Justice Rao’s jurisprudence, as presented in the book, insists that law must look beyond the optics of legality and meaningfully engage with societal realities. This orientation is vividly illustrated in the author’s account of Justice Rao’s assessment of a poor farmhand standing trial for murdering his landlord:<\/p>\n

The overzealousness of the prosecution, the interest of influential locals in the prosecution and the active involvement of the relatively young wife of the deceased got the Judge suspicious. On observing the orchestration and concoction happening around him, the judge was compelled to surmise that the poor farm hand was being falsely implicated in an offence he had evidently not committed. The accused was thus acquitted because the case against him was incredibly strong.<\/p>\n

As with any artwork, the biography combines “broad brush strokes” with “minute detailing” to create a comprehensive portrait of Justice Rao’s engagement with law. The broad brush strokes take the form of chapters organised around his different roles: Practising Lawyer, District Judge, Law Secretary to the Government of Andhra Pradesh, Judge of the High Court of Andhra Pradesh, Senior Advocate at the Supreme Court of India, Chairman of the National Backward Classes Commission, among many others. The minute detailing emerges through Prof. Dhanda’s careful analysis of his career from the vantage point of a seasoned academic. In effect, the reader encounters both an extraordinary figure’s engagement with law and an equally compelling academic commentary on that engagement. Amongst other areas, the book traverses administrative law, constitutional law, statutory interpretation, disability law, and the relationship between Bar and Bench; in my view, this dual movement between practice and reflection is the book’s most important contribution.<\/p>\n

The biography also adopts an expansive conception of law that reaches beyond the corridors of formal power. By documenting Justice Rao’s roles as philanthropist and public intellectual, Prof Dhanda enables the reader to appreciate his holistic approach to law and legal practice in both formal and informal settings. She pieces together his lectures and writings and organises them to foreground themes such as judicial activism, religion, caste discrimination and affirmative action offering the reader a structured entry point into Justice Rao’s outlook on contested issues. The following excerpt is illustrative of the same:<\/p>\n

In substance, Justice Rao does not see the need for the license of judicial activism for judges to do what they are anyway meant to do i.e. to ensure that the legislature and executive act in accordance with the Constitution<\/a>. If this is what is labeled judicial activism, then it is a quibble on terms, not substance. The form of judicial activism that Rao objects to is of a different order. It is that which appropriates the role of other branches of state by effectively rewriting the Constitution<\/a> or legislation, without explicitly acknowledging this shift, and thereby allowing the personal opinions of the Judge to metamorphose into legal principles and constitutional values. ‘(I)n the name of judicial activism, the theory of separation of powers is overthrown and the judiciary is undermining the authority of the legislature and the executive by encroaching upon the spheres reserved for them’<\/p>\n

In the Preface, Prof. Dhanda notes her initial regret at having “missed” the chance to write Justice Rao’s biography when she discovered that he had already published an autobiography, i.e.<\/span>, Glimpses from the Recital of My Life<\/span>. Rather than abandon the project, she reconceptualises it in artistic terms as a “portrait” that complements his “self-portrait”. Prof. Dhanda observes:<\/p>\n

The fact that one man occupies different spaces in the realm of law at different points in his life is not common. It is the uncommonness of this occurrence that has led me to revisit Justice M.N. Rao’s work and inquire how the expertise acquired in the execution of one role influenced the performance of the other.<\/p>\n

It is this richness of lived experience, retold by an accomplished academic with a rare ability to communicate complex legal nuances in accessible prose that makes Renaissance Man<\/span> of Law<\/span> a distinctive and valuable reading.<\/p>\n

Overall, this is a must-read for students of law, practitioners, and readers interested in the nature and functioning of law in the Indian context.<\/p>\n<\/div>\n\n
