Allahabad High Court:<\/span> In an anticipatory bail application filed by 2 accused persons in a 2001 kidnapping case, the Single Judge Bench of Rajeev Bharti, J., allowed the application, holding that it would be expedient in the interest of justice that the liberty of the accused be protected. The Court expressed that it was deeply disturbing that the present criminal case revealed a disquieting state of affairs, wherein an FIR registered in 2001 remained pending for over 2 decades without reaching its logical conclusion, thereby reducing the criminal trial to a mere formality.<\/span><\/p>\n

The Court remarked,<\/p>\n

“Justice cannot be permitted to become a casualty of endless adjournments and prolonged institutional inaction. The often-quoted expression that litigants receive nothing but “Taarikh pe Taarikh” is not expected to become the hallmark of the criminal justice delivery system.”<\/span><\/p>\n

Background<\/p>\n

In 2001, the victim, aged about 15 years, was alone at her residence when the complainant was out for work. Upon returning in the evening, the complainant discovered that the victim was missing. Despite making a diligent search, her whereabouts could not be ascertained, but 2 witnesses allegedly informed the complainant that they had seen the present accused, accompanied by a co-accused, persuading and taking the victim away.<\/p>\n

It was further alleged that the accused herein, along with the co-accused, enticed and abducted the victim against her will with the intention of marrying her. Furthermore, while leaving the house, the victim had taken with her gold and silver ornaments along with ₹1,000 cash. On these allegations, the FIR was registered under Sections 363<\/a> and 366<\/a> Penal Code, 1860<\/a> (IPC), and the investigation commenced.<\/p>\n

Based on the charge-sheet, the Magistrate summoned the 2 accused persons to face trial. Aggrieved, the accused persons preferred an application under Section 482<\/a>, Criminal Procedure Code, 1973<\/a>, before this Court seeking quashing of the criminal proceedings. During the pendency of the said application, interim protection was granted in favour of the accused persons. However, when the matter was subsequently listed, none appeared on behalf of the accused to prosecute the case.<\/p>\n

Consequently, the coordinate Bench of this Court dismissed the aforesaid application for want of prosecution, vacated the interim protection earlier granted, and directed that a copy of the order be transmitted to the District and Sessions Judge concerned for ensuring compliance.<\/p>\n

Thereafter, no effective proceedings took place for a considerable period, and the case remained pending. Subsequently, the trial court resumed the proceedings and, by order dated 25 May 2026, issued bailable warrants against the accused persons to secure their presence before the Court. Hence, the present application.<\/p>\n

The accused contended that the case pertained to an old incident, and the victim had voluntarily accompanied him as they were in a consensual relationship. They eventually got married and had 3 children.<\/p>\n

Analysis<\/p>\n

At the outset, the Court remarked that it was deeply disturbing that the present criminal case, arising out of an FIR registered in 2001, remained pending for over 2 decades without reaching its logical conclusion. “Such an extraordinary delay is wholly incompatible with the constitutional guarantee of a fair and speedy trial under Article 21<\/a> of the Constitution<\/a>.”<\/span><\/p>\n

The Court further stated that the record revealed a rather disquieting state of affairs<\/span>. For years together, the proceedings remained dormant without any meaningful progress, reducing the criminal trial to a mere formality. Justice cannot be permitted to become a casualty of endless adjournments and prolonged institutional inaction.<\/span><\/p>\n

“The often-quoted expression that litigants receive nothing but ‘Taarikh pe Taarikh’ is not expected to become the hallmark of the criminal justice delivery system.”<\/span><\/p>\n

Considering the submissions, material available on record, the accused has no previous criminal history, the undertaking of cooperation given by the accused, and the judgment of the Supreme Court in Musheer Alam<\/span> v. State of U.P.<\/span>, 2025 SCC OnLine SC 116<\/span><\/a>, the Court held that it would be expedient in the interest of justice that the liberty of the accused needs to be protected.<\/p>\n

Accordingly, the Court allowed the application and directed the accused persons to surrender before the trial court within 2 weeks from the date of receipt of a certified copy of this order. Upon their surrender, the trial court shall release them on anticipatory bail, subject to their furnishing personal bonds and 2 sureties of the same amount, to the satisfaction of the trial court, with a set of conditions.<\/p>\n
