{"id":390185,"date":"2026-07-13T15:00:20","date_gmt":"2026-07-13T09:30:20","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=390185"},"modified":"2026-07-13T15:05:13","modified_gmt":"2026-07-13T09:35:13","slug":"restoration-of-dv-complaint-maintenance-settlement-saket-court","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/07\/13\/restoration-of-dv-complaint-maintenance-settlement-saket-court\/","title":{"rendered":"A Settlement\u2019s Liberty Clause Does Not Give Unlimited Licence to Revive the Same DV Complaint before the Same Court on the Same Grounds: Saket District Court"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Saket District Court:<\/span> In an application for restoring a domestic violence complaint on the ground of breach of settlement and alleged non-compliance, <span style=\"color: #0e101a;\">the Bench of Ms Shikha Chahal, Judicial Magistrate First Class (Mahila Court)<\/span>, held that the non-compliance, though serious, did not constitute a fresh ground for reopening and restoring a complaint on substantially the same allegations, defeating the finality of the earlier judicial orders and resulting in repetitive litigation.<\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">The complainant submitted that the complaint under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002829238\" target=\"_blank\">Protection of Women from Domestic Violence Act, 2005<\/a> (DV Act), remained pending for several years before the parties arrived at a settlement before the Mediation Centre, Saket Courts on 6 August 2022. In terms of the settlement, the complaint was disposed of as settled vide order dated 21 January 2023.<\/p>\n<p style=\"margin-bottom: 3%;\">Subsequently, alleging non-compliance with the settlement terms by the respondents, the aggrieved complainant moved an application seeking restoration of the complaint under DV Act. The matter was again referred to mediation, resulting in a second settlement dated 19 January 2024, whereafter the aggrieved withdrew the restoration application, which was disposed of on 29 January 2024.<\/p>\n<p style=\"margin-bottom: 3%;\">The aggrieved thereafter filed the present restoration application, contending that the respondents had again failed to comply with the settlement terms, particularly regarding maintenance and other agreed obligations, and had instituted various legal proceedings against her.<\/p>\n<p style=\"margin-bottom: 3%;\">The respondents opposed the restoration application, contending that it was not maintainable since an earlier application seeking the same relief had already been dismissed on merits on 10 June 2025, and the said order had attained finality.<\/p>\n<p style=\"margin-bottom: 3%;\">According to the respondents, the present application sought to revive the complaint on substantially the same allegations and was therefore barred by the principle of finality of litigation.<\/p>\n<p style=\"margin-bottom: 3%;\">They further alleged that the aggrieved had withheld material facts, including her own alleged breaches of the mediation settlement dated 19 January 2024, disentitling her to any discretionary relief. The respondents also maintained that the legal proceedings instituted by them, including the divorce petition, were independent statutory remedies and could not, by themselves, be characterised as harassment or domestic violence.<\/p>\n<p style=\"margin-bottom: 3%;\">As regards the alleged non-payment of maintenance, it was argued that such grievances ought to be pursued through the appropriate enforcement proceedings rather than by seeking restoration of the disposed of complaint. Respondent 1 further stated that any default in payment was attributable to financial hardship and unemployment rather than wilful disobedience, while expressing willingness to comply with lawful directions subject to his financial capacity.<\/p>\n<p style=\"margin-bottom: 3%;\">On these grounds, the respondents submitted that the present application constituted a third attempt to restore the complaint after successive settlements and prior adjudication and, therefore, deserved dismissal.<\/p>\n<p style=\"font-weight: bold;\">Analysis and findings<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that the parties had voluntarily entered into detailed mediation settlements on 6 August 2022 and 19 January 2024, whereby they agreed to resume cohabitation, reside together in the matrimonial home, and the respondent-husband agreed to provide financial support, including payment of a fixed monthly amount towards the aggrieved complainant&#8217;s personal expenses.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that the present application did not allege that either of the settlements had been procured by fraud, coercion or misrepresentation. Rather, the grievance of the aggrieved pertained to the respondents&#8217; alleged non-compliance with their monetary and residential obligations under the settlements.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court held that such alleged non-compliance, though serious, was capable of enforcement before the competent courts dealing with maintenance, residence or other connected matrimonial and criminal proceedings. The Court further held that such non-compliance, by itself, did not constitute a fresh ground for reopening and restoring a complaint that had already been disposed of pursuant to settlement and in respect of which an earlier restoration application had been dismissed on merits.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further observed that permitting restoration on substantially the same allegations would defeat the finality of the earlier judicial orders and result in repetitive litigation.
