Madhya Pradesh High Court:<\/span> In a writ petition filed seeking medical termination of a 17-year-old rape victim’s 10-week-old pregnancy, the Single Judge Bench of Vishal Mishra<\/span>, J., allowed the termination with certain directions. The Court also noted that, in several cases, despite having the authority to initiate the termination process, the authorities were shifting their burden to one another, and thereafter the matters travelled up to this Court, and the procedure was carried out after the Court’s permission. For a minor victim with a pregnancy of less than 24 weeks, there was no need to seek court permission for termination if the victim or her guardian had given written consent.<\/p>\n

The Court remarked,<\/p>\n

“Cases of termination of pregnancy are of an urgent nature and should have been addressed by the authorities themselves at the earliest, but despite the same, time is being wasted in taking permission from the District Court as well as from this Court prior to adopting the procedure.”<\/p>\n

Background<\/p>\n

The petitioner, a minor girl aged about 17 years and one month, was a rape victim who was found to be pregnant during the medical examination. When the victim approached the Medical Board for termination of her pregnancy, the Medical Board’s report stated that the pregnancy could be terminated subject to certain risks, which were explained to the victim and her mother. The victim and her mother gave consent for the termination of her 10-week pregnancy on 4-7-2026 as per the Medical Termination of Pregnancy Act, 1971<\/a> (MTP Act).<\/p>\n

Analysis<\/p>\n

The Court perused Section 3, MTP Act and noted that there were several matters in which the foetus was less than 24 weeks old. The MTP Act clearly provides that termination of pregnancy can be carried out by a registered medical practitioner where the age of the foetus does not exceed 20 weeks, and if it exceeds 20 weeks but is less than 24 weeks, then by 2 registered medical practitioners. In the present case, the Medical Board report stated that the age of the foetus was 10 weeks. Noting this, the Court questioned why the Court’s permission was required to terminate the pregnancy despite there being a specific provision under the MTP Act. The Medical Board could have taken a conscious view, considering the health status and condition of the victim, as well as consent, and adopted the procedure of termination.<\/p>\n

The Court remarked that it was repeatedly coming across such matters where, instead of proceeding with the termination of pregnancy, the authorities were shifting their burden to one another, and thereafter, the matter travelled up to this Court, and after getting a direction\/permission from this Court for termination of pregnancy, the procedure was carried out. Once the authorities themselves are competent to terminate the pregnancy in terms of provisions of Section 3, MTP Act, then such permissions are not required from this Court.<\/p>\n

“Cases of termination of pregnancy are of an urgent nature and should have been addressed by the authorities themselves at the earliest, but despite the same, time is being wasted in taking permission from the District Court as well as from this Court prior to adopting the procedure.”<\/p>\n

The Court added that the MTP Act clearly provides that if a victim, who is less than 18 years of age, gives her consent for terminating her pregnancy in writing or consent is given by the guardian, then the same can be terminated. Under these circumstances, there is no requirement for taking permission from this Court to adopt the procedure if the age of pregnancy does not exceed 24 weeks.<\/p>\n

Under these circumstances, as the victim and her mother have shown their willingness for the termination of pregnancy, the Court permitted the termination of pregnancy of the victim, subject to the following directions:<\/p>\n

1. The procedure of termination of pregnancy shall be carried out in the presence of the expert team of doctors as expeditiously as possible. The expert doctors shall explain the risk of the pregnancy being terminated and other factors to the victim and her family members.<\/p>\n

2. Every care and caution shall be taken by the doctors while terminating the pregnancy. All medical attention and other medical facilities, including the presence of a Paediatrician, a Radiologist, and other required doctors, shall be made available to her.<\/p>\n

3. The post-operative care, up to the extent required, shall be extended to the victim. It will be the duty of the State Government to take care of the child if born alive.<\/p>\n

4. The doctors shall also ensure that a sample from the foetus is protected for DNA examination and, as and when required, will be handed over to the prosecution for use in the criminal case itself.<\/p>\n

5. All necessary care and caution shall be taken by the doctors while carrying out the procedure for the termination of pregnancy.<\/p>\n

6. Considering the finding of the Medical Board, the hospital and its medical team shall ensure sensitive treatment and handling of the victim in connection with all procedures, whether medical or administrative, keeping her emotional and mental health at the forefront.<\/p>\n

Accordingly, the Court directed the Civil Surgeon, Assistant Chief Superintendent of Hospital, District Madla, to explain why, in such cases where the age of the foetus is less than 24 weeks, permission from the Courts is required.<\/p>\n

The Court further directed that a copy of this order be communicated to the Principal Secretary of the Health Department, State of M.P., and the Director of the Health Department, State of M.P., to ensure that the Courts are not flooded with such kind of cases anymore, and they can issue necessary directions to the aforesaid effect. A copy was also directed to be sent to the counsel for the State, Special Judge, Mandla, the Superintendent of Police, Mandla, and the Hospital concerned for further action.<\/p>\n

Thus, the petition was allowed and disposed of.<\/p>\n
