Indian Banks Association<\/span>, while welcoming the ruling as a reaffirmation of the independence and institutional role of the legal profession.<\/p>\n<p style=\"font-weight: bold;\">Key Highlights:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>The BCI welcomed the Supreme Court&#8217;s judgment in <span style=\"font-style: italic;\">Ajay Vijh v. Indian Banks Association<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/u3n1Otq6\" target=\"_blank\">2026 SCC OnLine SC 1295<\/a> dated 7 July 2026, delivered by a Bench comprising Justice P. S. Narasimha and Justice Alok Aradhe, observing that the ruling strengthens the position of advocates as independent stakeholders in the administration of justice.<\/p>\n<\/li>\n<li>\n<p>The Supreme Court has, through the judgment, recognised that the <span style=\"font-weight: bold;\">independence of the legal profession<\/span> is as vital to the preservation of the rule of law and democracy as the independence of the judiciary itself.<\/p>\n<\/li>\n<li>\n<p>The Court reaffirmed that advocates are officers of the Court and indispensable stakeholders in the administration of justice, protection of constitutional freedoms and maintenance of the justice delivery system.<\/p>\n<\/li>\n<li>\n<p>The BCI particularly welcomed the Court&#8217;s declaration that issues relating to the professional conduct, competence, negligence or misconduct of advocates fall within the exclusive disciplinary jurisdiction of the statutory bodies constituted under the <span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002806286\" target=\"_blank\">Advocates Act, 1961<\/a><\/span>.<\/p>\n<\/li>\n<li>\n<p>The Court has directed BCI to <span style=\"font-weight: bold;\">constitute a committee<\/span> to undertake a comprehensive performance audit of disciplinary mechanisms administered by the BCI and State Bar Councils.<\/p>\n<\/li>\n<li>\n<p>The audit will examine matters such as:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Institution and disposal of disciplinary complaints;<\/p>\n<\/li>\n<li>\n<p>Pendency and timelines;<\/p>\n<\/li>\n<li>\n<p>Regional variations;<\/p>\n<\/li>\n<li>\n<p>Procedural practices;<\/p>\n<\/li>\n<li>\n<p>Infrastructure and staffing; and<\/p>\n<\/li>\n<li>\n<p>Transparency and effectiveness of disciplinary proceedings.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The BCI also welcomed the Court&#8217;s emphasis on <span style=\"font-weight: bold;\">Continuing Legal Education<\/span> and professional development for advocates after enrolment.<\/p>\n<\/li>\n<li>\n<p>The Court has proposed the establishment of a <span style=\"font-weight: bold;\">National Legal Academy<\/span> for advocates, established on the lines of the National Judicial Academy, and directed the BCI to constitute a team of senior advocates, junior advocates and experts to examine and develop the proposal.<\/p>\n<\/li>\n<li>\n<p>According to the BCI, the proposed Academy could serve as a national institution for:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Continuing professional development<\/p>\n<\/li>\n<li>\n<p>Ethical and advocacy training<\/p>\n<\/li>\n<li>\n<p>Technological capacity building<\/p>\n<\/li>\n<li>\n<p>Specialised legal education<\/p>\n<\/li>\n<li>\n<p>Mentorship initiatives<\/p>\n<\/li>\n<li>\n<p>Preservation of the profession&#8217;s values and traditions<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The Court further observed that reducing judicial pendency cannot be the responsibility of the judiciary alone and emphasised the Bar&#8217;s role as an equal institutional partner in the administration of justice.<\/p>\n<\/li>\n<li>\n<p>In response to the judgment, the BCI has announced that it will convene a meeting to constitute <span style=\"font-weight: bold;\">committees<\/span> and expert groups for implementation of the Court&#8217;s directions, including preparing a framework for the proposed National Legal Academy.<\/p>\n<\/li>\n<li>\n<p>The BCI will also work on developing a structured national model for <span style=\"font-weight: bold;\">Continuing Legal Education<\/span>, professional development, mentoring and specialised training of advocates.<\/p>\n<\/li>\n<li>\n<p>The Council has stated that it has already initiated the process of identifying suitable land, buildings and allied infrastructure for the establishment of the proposed Academy.<\/p>\n<\/li>\n<li>\n<p>The BCI has also proposed identifying technological, administrative and institutional reforms necessary for modernising the regulatory and educational framework governing the legal profession.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">The BCI stated that the judgment marks the beginning of a <span style=\"font-weight: bold;\">new institutional chapter<\/span> for the legal profession and described it as a call to responsibility, renewal and collective action.<\/p>\n<\/li>\n<\/ol>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Read more:<\/span> <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/07\/10\/sc-professional-misconduct-within-bci-disciplinary-jurisdiction\/\" target=\"_blank\">https:\/\/www.scconline.com\/blog\/post\/2026\/07\/10\/sc-professional-misconduct-within-bci-disciplinary-jurisdiction\/<\/a><\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Also Read:<\/span> <a href=\"https:\/\/www.scconline.com\/blog\/post\/2025\/12\/16\/bci-announced-integration-drafting-legislation-plain-language-paper-21\/\" target=\"_blank\">BCI Reforms Legal Education: Legislative and Plain Language Drafting Now Part of LL.B.
