{"id":389752,"date":"2026-07-08T15:00:27","date_gmt":"2026-07-08T09:30:27","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=389752"},"modified":"2026-07-08T14:26:42","modified_gmt":"2026-07-08T08:56:42","slug":"bihar-government-notifies-code-on-wages-rules-2026","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/07\/08\/bihar-government-notifies-code-on-wages-rules-2026\/","title":{"rendered":"Bihar Notifies Code on Wages (Bihar) Rules, 2026; Replaces Decades-Old Wage Rules"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 30 June 2026, the Bihar Government notified the <span style=\"font-weight: bold;\">Code on Wages (Bihar) Rules, 2026<\/span>, laying down the framework for minimum wages, wage payments, working hours, claims, appeals and compliance under the <span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000209183\" target=\"_blank\">Code on Wages, 2019<\/a><\/span>.<\/p>\n<p style=\"margin-bottom: 3%;\">The Rules came into effect on 1 July 2026.<\/p>\n<p style=\"font-weight: bold;\">Key Highlights<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>The Rules have been framed under Section 67 of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000209183\" target=\"_blank\">Code on Wages, 2019<\/a> and supersede:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Bihar Payment of Wages Rules, 1937, and<\/p>\n<\/li>\n<li>\n<p>Bihar Minimum Wages Rules, 1951.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Rule 3<\/span> prescribes the methodology for fixation of minimum wages. The State Government is required to consider factors such as:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Standard working-class family consisting of the earning worker, spouse and two children;<\/p>\n<\/li>\n<li>\n<p>Net intake of 2,700 calories per day per consumption unit;<\/p>\n<\/li>\n<li>\n<p>66 metres of cloth per year per family;<\/p>\n<\/li>\n<li>\n<p>Housing expenditure at 10% of food and clothing expenditure;<\/p>\n<\/li>\n<li>\n<p>Fuel, electricity, digital communication and miscellaneous expenses at 20% of minimum wages; and<\/p>\n<\/li>\n<li>\n<p>Expenditure on education, medical needs, recreation and contingencies at 25% of minimum wages.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Rule 4<\/span> lays down the norms for fixation of minimum wages, requiring the State Government to consider geographical areas (metropolitan, non-metropolitan and rural), employment-related experience, and the skill level of workers while determining minimum wage rates.<\/p>\n<\/li>\n<li>\n<p>Under Rule 4, occupations are classified into four skill categories:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Unskilled;<\/p>\n<\/li>\n<li>\n<p>Semi-skilled;<\/p>\n<\/li>\n<li>\n<p>Skilled; and<\/p>\n<\/li>\n<li>\n<p>Highly skilled.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Variable Dearness Allowance<\/span> (VDA) will be revised twice every year, under <span style=\"font-weight: bold;\">Rule 5<\/span>, before 1 April and 1 October, based on the Consumer Price Index published by the Labour Bureau.<\/p>\n<\/li>\n<li>\n<p>The Rules expressly prohibit the State Government from fixing minimum wages below the floor wage notified by the Central Government under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000209183\" target=\"_blank\">Code on Wages, 2019<\/a>.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Rules 6 to 9<\/span> prescribe working-hour norms, including:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Maximum of <span style=\"font-weight: bold;\">48<\/span> working hours per week;<\/p>\n<\/li>\n<li>\n<p>Overtime for work beyond prescribed daily or weekly limits;<\/p>\n<\/li>\n<li>\n<p>Mandatory rest intervals;<\/p>\n<\/li>\n<li>\n<p>Flexibility in working hours with employee or negotiating union consent;<\/p>\n<\/li>\n<li>\n<p>Weekly rest-day entitlements; and<\/p>\n<\/li>\n<li>\n<p>A quarterly overtime ceiling of <span style=\"font-weight: bold;\">144<\/span> hours, subject to written consent of the employee.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Rule 10<\/span> prescribes one month as the wage period for the purposes of minimum wage payments.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Rules 11 to 19<\/span> establish a comprehensive framework governing wage deductions, fines, advances and recovery of loans, to regulate recovery of advances, deductions for damage or loss, limits on deductions, and procedural safeguards for employees.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Rule 13<\/span> designates the Deputy Labour Commissioner as the authority for wage-related claims, while <span style=\"font-weight: bold;\">Rule 42(4)<\/span> provides an appellate mechanism before the Labour Commissioner or an officer not below the rank of Joint Labour Commissioner.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Rules 20 to 37<\/span> establish and regulate a State Advisory Board comprising representatives of employers, employees, government departments, labour experts and civil society to advise the State Government on wage-related matters.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Rules 41 and 42<\/span> prescribe the procedure for filing wage claims and appeals and provide the statutory forms for applications, notices and appeals.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Rules 43 and 44<\/span> require employers to comply with prescribed record-keeping obligations<span style=\"font-weight: bold;\">.<\/span><\/p>\n<\/li>\n<li>\n<p>Employers are required to maintain:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Employee Register (Form I);<\/p>\n<\/li>\n<li>\n<p>Register of Wages, Overtime, Advances, Fines and Deductions (Form IV);<\/p>\n<\/li>\n<li>\n<p>Attendance Register-cum-Muster Roll (Form IX);
