{"id":389612,"date":"2026-07-07T12:00:12","date_gmt":"2026-07-07T06:30:12","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=389612"},"modified":"2026-07-07T11:47:08","modified_gmt":"2026-07-07T06:17:08","slug":"dhc-earning-husband-can-claim-loss-of-dependency-for-wife-death","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/07\/07\/dhc-earning-husband-can-claim-loss-of-dependency-for-wife-death\/","title":{"rendered":"Delhi HC: Earning husband entitled to &#8216;loss of dependency&#8217; compensation for death of earning wife; dependency not confined to financial dependence"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Delhi High Court:<\/span> In an appeal challenging the quantum of compensation awarded by the Motor Accident Claims Tribunal (MACT), a Single Judge Bench of <span style=\"font-weight: bold;\">Anish Dayal, J.<\/span>, held that an earning husband is entitled to claim compensation under the head of loss of dependency for the death of his earning wife and that there is no legal basis to confine such a claim to loss of estate merely because the husband is financially independent. Rejecting the insurer&#8217;s contention that an earning spouse cannot be treated as a dependant, the Court held that dependency must be understood in a broader sense, encompassing the deceased spouse&#8217;s contribution to the corpus of the household through both pecuniary earnings and non-pecuniary services. Finding the MACT&#8217;s assessment to be consistent with the principles laid down in <span style=\"font-style: italic;\">National Insurance Co. Ltd.<\/span> v. <span style=\"font-style: italic;\">Pranay Sethi<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002833905\" target=\"_blank\">(2017) 16 SCC 680<\/a>, and <span style=\"font-style: italic;\">Sarla Verma<\/span> v. <span style=\"font-style: italic;\">DTC<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0000043469\" target=\"_blank\">(2009) 6 SCC 121<\/a>, the Court upheld the award and dismissed the insurer&#8217;s appeal.<\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">On 26 January 2022, the respondent was travelling with his wife, their daughter, mother-in-law and niece on National Highway-58 when a truck bearing registration No. UP-15-AT-0876, allegedly driven rashly and negligently at high speed, entered the highway and collided with their car. The accident resulted in the deaths of the respondent&#8217;s wife, daughter, mother-in-law and niece. An FIR was registered on 27 January 2022 under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561577\" target=\"_blank\">279<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561650\" target=\"_blank\">338<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561610\" target=\"_blank\">304-A<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561765\" target=\"_blank\">427<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">Penal Code, 1860<\/a>, followed by investigation and filing of a charge-sheet. Separate claim petitions were instituted in respect of the deceased daughter and niece, while the respondent filed a claim seeking compensation for the death of his wife.<\/p>\n<p style=\"margin-bottom: 3%;\">The MACT held that the accident occurred due to the rash and negligent driving of the offending truck and fastened liability upon the insurer of the vehicle. The only issue challenged before the Delhi High Court was the quantum of compensation. Relying on the deceased&#8217;s income tax return for the Financial Year 2020-2021, the MACT assessed her annual income at &#8377;5,06,230, added 40 per cent towards future prospects, applied a multiplier of 16 and deducted one-half towards personal expenses, awarding &#8377;56,69,776 towards loss of dependency. Compensation under the conventional heads of loss of consortium, loss of estate and funeral expenses was also granted, taking the total compensation to &#8377;57,54,476 with interest at 9 per cent per annum. Aggrieved by the quantum of compensation, the insurer preferred the present appeal. During the pendency of the appeal, the Delhi High Court directed the insurer to deposit the entire awarded amount with interest and subsequently permitted release of 30 per cent of the compensation to the claimant, subject to the terms and conditions contained in the MACT award.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"color: #ee0000; font-weight: bold;\">Also Read:<\/span> <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/06\/26\/just-compensation-when-conventional-head-is-omitted-supreme-court-grants-filial-consortium\/\" target=\"_blank\">Just Compensation When Conventional Head Is Omitted: Supreme Court Grants Filial Consortium | SCC Times<\/a><\/p>\n<p style=\"font-weight: bold;\">Issue<\/p>\n<p style=\"margin-bottom: 3%;\">Whether &#8220;<span style=\"font-style: italic;\">dependency of husband<\/span>&#8221;, in the context of contribution made by a <span style=\"font-style: italic;\">wife<\/span>, in the form of services, income, or contribution to the household, ought to be taken into account while calculating the total compensation.<\/p>\n<p style=\"font-weight: bold;\">Analysis<\/p>\n<p style=\"margin-bottom: 3%;\">The Delhi High Court held that there is no statutory bar preventing an earning husband from claiming compensation for the death of his wife under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001569568\" target=\"_blank\">166<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726964\" target=\"_blank\">Motor Vehicles Act, 1988<\/a>, and that the only issue was whether he was entitled to compensation under the head of loss of dependency.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that the notion that an earning husband can never be dependent upon his earning wife stems from an outdated societal assumption that the husband alone is the breadwinner. Emphasising that motor accident compensation is rooted in the law of torts, the Court held that the claim cannot be examined through the prism of patriarchal social structures. It observed that where the deceased is an earning member of the family, whether husband or wife, such income ordinarily constitutes a contribution to the family corpus, and denying compensation merely because the surviving spouse is also earning would introduce unwarranted subjectivity.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court extensively examined the evolution of the law relating to dependency, particularly the Supreme Court&#8217;s decisions in <span style=\"font-style: italic;\">Arun Kumar Agrawal<\/span> v. <span style=\"font-style: italic;\">National Insurance Co. Ltd.<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0000045377\" target=\"_blank\">(2010) 9 SCC 218<\/a>, <span style=\"font-style: italic;\">Jitendra Khimshankar Trivedi<\/span> v. <span style=\"font-style: italic;\">Kasam Daud Kumbhar<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0000051165\" target=\"_blank\">(2015) 4 SCC 237<\/a>, <span style=\"font-style: italic;\">Rajendra Singh<\/span> v. <span style=\"font-style: italic;\">National Insurance Company Ltd.<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000678972\" target=\"_blank\">(2020) 7 SCC 256<\/a>, <span style=\"font-style: italic;\">Kirti<\/span> v. <span style=\"font-style: italic;\">Oriental Insurance Co. Ltd.<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000751967\" target=\"_blank\">(2021) 2 SCC 166<\/a>, <span style=\"font-style: italic;\">Sunita<\/span> v. <span style=\"font-style: italic;\">Vinod Singh<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9002587282\" target=\"_blank\">2025 SCC OnLine SC 586<\/a>, and <span style=\"font-style: italic;\">Malakappa<\/span> v. <span style=\"font-style: italic;\">Iffco Tokio General Insurance Co. Ltd.<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9002644769\" target=\"_blank\">2025 SCC OnLine SC 979<\/a>, which recognised the economic value of both earning and non-earning spouses&#8217; contributions to the family. It also analysed the earlier Delhi High Court decisions in <span style=\"font-style: italic;\">Keith Rowe<\/span> v. <span style=\"font-style: italic;\">Prashant Sagar<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000703399\" target=\"_blank\">2010 SCC OnLine Del 4686<\/a>, clarifying that the principles governing loss of estate apply only in exceptional cases where the claimant falls outside the realm of dependency. The Court held that spouses, parents and children constitute the category of dependants in law, irrespective of whether they are themselves earning, and their claims are to be determined under the head of loss of dependency by applying the standard formula prescribed in <span style=\"font-style: italic;\">National Insurance Co. Ltd.<\/span> v. <span style=\"font-style: italic;\">Pranay Sethi<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002833905\" target=\"_blank\">(2017) 16 SCC 680<\/a>, and <span style=\"font-style: italic;\">Sarla Verma<\/span> v. <span style=\"font-style: italic;\">DTC<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0000043469\" target=\"_blank\">(2009) 6 SCC 121<\/a>. The concept of loss of estate, continues to survive but is confined to claims by legal representatives other than parents, spouse or children.<\/p>\n<p style=\"margin-bottom: 3%;\">Applying these principles to the present case, the Court noted that the insurance company had neither specifically disputed the husband&#8217;s dependency before the Tribunal nor led any evidence to rebut his testimony regarding the deceased&#8217;s financial contribution towards the family&#8217;s joint expenses, including repayment of the home loan and other liabilities. Consequently, the Court rejected the insurer&#8217;s contention that an earning husband was disentitled to compensation under the head of loss of dependency and held that the claimant&#8217;s entitlement had to be assessed in accordance with the settled principles governing dependency claims.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further held that where an earning wife dies leaving behind an earning husband, there is no basis for accepting the insurer&#8217;s contention that compensation should be confined to the head of loss of estate. The Court observed that the concept of dependency operates in a broader sense and extends to the loss of the deceased spouse&#8217;s contribution to the corpus of the household, whether through pecuniary earnings or non-pecuniary services. Since the deceased was an earning member whose income contributed to the family, the Tribunal had rightly assessed compensation under the head of loss of dependency by taking her annual income, adding 40 per cent towards future prospects and deducting one-half towards personal and living expenses.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further held that, in the peculiar facts of the case, the deduction of one-half towards personal expenses was appropriate, considering that there were 2 earning members and that the surviving husband would effectively have benefited from approximately 50 per cent of the deceased wife&#8217;s contribution to the household corpus. Although another view of deducting one-third was possible, particularly as the deceased daughter and mother-in-law also died in the same accident, the Tribunal&#8217;s conservative approach warranted no interference.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court also observed that the practical distinction between the approaches of loss of dependency and loss of estate primarily lies in the deduction towards personal expenses and may not substantially alter the final computation.
