Arbitration and Conciliation Act, 1996<\/a> — Ss. 11(6)<\/a>, 16<\/a> & 34<\/a> and S. 11(6-A)<\/a>:<\/span> Appointment of arbitrator under S. 11(6), whether amounts to final determination regarding validity and existence of arbitration agreement, or, is an issue that is left open that can be decided by Arbitral Tribunal under S. 16 or Court having power to decide S. 34 application, determined, [Eminent Colonizers (P) Ltd. v. Rajasthan Housing Board, (2026) 5 SCC 422<\/a>]<\/p>\n<\/div>\n

\n

Arbitration and Conciliation Act, 1996<\/a> — Ss. 29-A<\/a>, 34<\/a> and 36<\/a> — Award passed after the mandate of the arbitrator has expired — Consideration of, as non est:<\/span> S. 29-A<\/a> does not, in terms, bar an application for extension of the mandate of an arbitrator in the event of the delivery of an award and there is no such prescription anywhere in the section. In the first place, if an award is made after expiry of the mandate, then such an award is non est. Thus, such an award would be unenforceable under S. 36, and such an award need not be challenged under S. 34. However, a unilateral act or the indiscretion of the arbitrator in making such an award will have no bearing on the power and jurisdiction vested in the Court under S. 29-A, [C. Velusamy v. K.
