While acknowledging that the common law is not the only legal system capable of upholding the rule of law, he emphasised that Singapore&#8217;s consistent adherence to legal certainty and predictable judicial outcomes has been instrumental in establishing international confidence.<\/p>\n<p style=\"margin-bottom: 3%;\">Unlike many countries, Singapore possesses virtually no natural resources. It has no oil, rubber or mineral wealth to drive its economy. Instead, its growth has depended upon providing reliable services to regional and international businesses. According to Lawrence, commercial certainty has therefore become Singapore&#8217;s greatest asset. Businesses are willing to accept commercial risks associated with markets and investments, but they require confidence that legal disputes will be resolved fairly, efficiently and predictably. It is this commitment to the rule of law, he explained, that ultimately enabled Singapore to develop into a trusted international arbitration centre.<\/p>\n<p style=\"font-weight: bold; font-size: 18pt;\">Common law and Confucian values coexist in Singapore&#8217;s dispute resolution framework<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">&#8220;Singapore is able to embrace both traditions, we understand the adversarial process, but we also appreciate the value of achieving harmony through consensual processes such as mediation.&#8221;<\/span> &mdash; Lawrence Teh<\/p>\n<p style=\"margin-bottom: 3%;\">The discussion then turned to mediation and whether Singapore&#8217;s prominence in both arbitration and mediation reflects a contradiction.<\/p>\n<p style=\"margin-bottom: 3%;\">Referring to observations made by a Malaysian judge at an earlier conference, Aigoul noted that while the adversarial system was introduced into Southeast Asia during the colonial period, many Asian societies have historically preferred consensual methods of dispute resolution.<\/p>\n<p style=\"margin-bottom: 3%;\">Responding to this, Lawrence explained that Singapore has been shaped by two distinct legal and philosophical traditions. Two centuries of common law have naturally embedded adversarial litigation and arbitration within the country&#8217;s legal culture. At the same time, Singapore&#8217;s place within East Asia means that it has also been deeply influenced by Confucian philosophy, which values harmony, community and consensus over conflict.<\/p>\n<p style=\"margin-bottom: 3%; text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2026\/07\/image-58.png\" alt=\"\" width=\"600\" height=\"700\" class=\"aligncenter size-full wp-image-389306\" \/><\/p>\n<p style=\"margin-bottom: 3%;\">According to Lawrence, these two traditions are not mutually exclusive. Singapore has been able to embrace both adversarial dispute resolution and consensual processes such as mediation. This unique combination has contributed significantly to Singapore&#8217;s attractiveness as both an arbitration and mediation hub, particularly following the adoption of the Singapore Convention on Mediation.<\/p>\n<p style=\"font-weight: bold; font-size: 18pt;\">Arbitration existed long before the New York Convention<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">&#8220;The New York Convention really was a catalyst for world trade because it gave financiers the confidence to fund international projects through the certainty of recognition and enforcement of arbitral awards.&#8221;<\/span> &mdash; Lawrence Teh<\/p>\n<p style=\"margin-bottom: 3%;\">Drawing upon Professor Gary Born&#8217;s earlier keynote on the history of arbitration, the moderator invited Teh to comment on arbitration&#8217;s evolution in Asia and whether the centre of gravity is shifting eastwards.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Also read:<\/span> <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/07\/02\/gary-born-international-arbitration-past-present-future-eurasian-arbitration-week-2026\/\" target=\"_blank\">Gary Born on the past, present and future of International Arbitration at IAC Eurasia Arbitration Week 2026<\/a><\/p>\n<p style=\"margin-bottom: 3%;\">Lawrence Teh observed that arbitration long predates the 1958 New York Convention. Historically, disputes within trading communities were commonly resolved by respected merchants, elders or experienced members of the community whose decisions were voluntarily accepted by the parties. Arbitration therefore emerged organically as a mechanism based on trust rather than legal compulsion.<\/p>\n<p style=\"margin-bottom: 3%;\">The New York Convention, however, fundamentally changed the landscape of international dispute resolution. By creating a globally recognised framework for the recognition and enforcement of arbitral awards, it provided businesses, financiers and investors with confidence that contractual rights could be enforced across jurisdictions. This certainty, Lawrence noted, played a crucial role in facilitating international trade and cross-border investment.<\/p>\n<p style=\"margin-bottom: 3%;\">He further explained that many doctrines associated with modern international arbitration, including kompetenz-kompetenz and the contemporary relationship between national courts and arbitral tribunals. have largely developed within the post-New York Convention era rather than throughout arbitration&#8217;s much longer historical evolution.<\/p>\n<p style=\"font-weight: bold; font-size: 18pt;\">Singapore&#8217;s arbitration journey was the result of deliberate economic policy<\/p>\n<p style=\"margin-bottom: 3%;\">When asked about the future of arbitration in Asia, Lawrence Teh reflected on Singapore&#8217;s own experience following the 1997 Asian Financial Crisis.<\/p>\n<p style=\"margin-bottom: 3%;\">He recalled that the crisis prompted significant introspection within Singapore regarding the country&#8217;s long-term economic strategy. One of the principal conclusions reached by policymakers was that Singapore should focus on providing sophisticated professional services, including legal services, as a major contributor to national economic growth.<\/p>\n<p style=\"margin-bottom: 3%;\">Drawing inspiration from the United Kingdom&#8217;s success in generating substantial invisible earnings through English law, courts and arbitration, Singapore invested heavily in building an internationally competitive arbitration ecosystem.<\/p>\n<p style=\"margin-bottom: 3%;\">In its early years, Singapore&#8217;s ambition was to become the preferred arbitral seat for disputes arising within approximately a seven-hour flight radius, extending from Northeast Asia through the Gulf region and down to Australia.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Also read:<\/span> <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/07\/02\/international-arbitration-in-eurasia-iac-eaw-2026\/\" target=\"_blank\">&#8220;AIFC Court and IAC is our shortcut to the rule of law&#8221;: Panel on arbitration, legal traditions and institutional development at IAC Eurasia Arbitration Week 2026<\/a><\/p>\n<p style=\"margin-bottom: 3%;\">To realise this vision, the Government invested consistently in legislative reform, institutional development and infrastructure. This included strengthening the Singapore International Arbitration Centre (SIAC), supporting the Singapore Chamber of Maritime Arbitration (SCMA), establishing Maxwell Chambers as a dedicated hearing facility, and creating an arbitration-friendly legal framework that continued to evolve alongside international best practices.<\/p>\n<p style=\"margin-bottom: 3%;\">According to Lawrence, Singapore&#8217;s success did not arise by accident but was the product of long-term planning, continuous legislative refinement and sustained governmental support.<\/p>\n<p style=\"margin-bottom: 3%; text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2026\/07\/image-57.png\" alt=\"\" width=\"700\" height=\"600\" class=\"aligncenter size-full wp-image-389307\" \/><\/p>\n<p style=\"font-weight: bold; font-size: 18pt;\">Kazakhstan should build upon its own strengths<\/p>\n<p style=\"margin-bottom: 3%;\">While discussing whether Kazakhstan should emulate Singapore&#8217;s model, Lawrence cautioned against simply replicating another jurisdiction&#8217;s approach.<\/p>\n<p style=\"margin-bottom: 3%;\">Instead, he encouraged Kazakhstan to identify its own comparative advantages by examining its history, geography and economic future.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">&#8220;Don&#8217;t follow Singapore in its exact steps. Ask instead: What is Kazakhstan? What is Central Asia? What is your future, and how do you plan for it?&#8221;<\/span> &mdash; Lawrence Teh<\/p>\n<p style=\"margin-bottom: 3%;\">He observed that every leading arbitral seat has developed differently. London&#8217;s position reflects centuries of commercial trading history. Paris grew alongside the International Chamber of Commerce and France&#8217;s civil law tradition. Geneva followed its own distinct path, while Hong Kong combined its common law heritage with its strategic role as East Asia&#8217;s commercial gateway.<\/p>\n<p style=\"margin-bottom: 3%;\">Kazakhstan, he suggested, should similarly develop an arbitration strategy rooted in its own circumstances. Given its historic role along the Silk Road and its strategic location between Europe, the Caucasus, Central Asia and China, Kazakhstan possesses the potential to become an important legal bridge connecting multiple regions.<\/p>\n<p style=\"font-weight: bold; font-size: 18pt;\">Audience discusses Singapore&#8217;s rise over Hong Kong<\/p>\n<p style=\"margin-bottom: 3%;\">Responding to an audience question on how Singapore emerged from relative obscurity to become one of the world&#8217;s leading arbitral seats, Lawrence Teh reflected on the transformation he had personally witnessed during more than three decades of practice.<\/p>\n<p style=\"margin-bottom: 3%;\">He recalled that when he entered the profession, Hong Kong was widely regarded as the obvious choice for arbitration in Asia.<\/p>\n<p style=\"margin-bottom: 3%;\">One factor contributing to Singapore&#8217;s rise, he suggested, was that the country was perceived as politically neutral and too small to pose a geopolitical threat to any party.<\/p>\n<p style=\"margin-bottom: 3%;\">Equally important was the Government&#8217;s willingness to modernise arbitration legislation whenever developments in international practice revealed opportunities for improvement. Combined with investment in world-class institutions and hearing facilities, Singapore gradually developed a comprehensive arbitration ecosystem capable of attracting parties from around the world.<\/p>\n<p style=\"font-weight: bold; font-size: 18pt;\">Judicial independence and neutrality continue to inspire confidence<\/p>\n<p style=\"margin-bottom: 3%;\">An audience member from India observed that many Indian parties continue choosing Singapore as the seat of arbitration, even where both parties are Indian, and asked what had enabled Singapore to inspire such confidence.<\/p>\n<p style=\"margin-bottom: 3%; text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2026\/07\/image-57.png\" alt=\"\" width=\"700\" height=\"600\" class=\"aligncenter size-full wp-image-389307\" \/><\/p>\n<p style=\"margin-bottom: 3%;\">Lawrence attributed this confidence primarily to Singapore&#8217;s clean governance, transparency, judicial independence and institutional integrity.<\/p>\n<p style=\"margin-bottom: 3%;\">He observed that parties would not voluntarily select a jurisdiction if they believed tribunals lacked independence or if courts interfered unpredictably in arbitral proceedings. Singapore&#8217;s reputation has therefore been built upon decades of maintaining impartial institutions and consistent adherence to the rule of law.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Also read:<\/span> <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/07\/03\/cross-border-ma-disputes-discussed-at-iac-eurasia-arbitration-week-2026\/\" target=\"_blank\">Cross-border M&amp;A disputes require dispute architecture, not just arbitration: Experts discuss at IAC Eurasia Arbitration Week 2026<\/a><\/p>\n<p style=\"margin-bottom: 3%;\">He further noted that India remained SIAC&#8217;s largest source of cases for approximately two decades, accounting for nearly one-fifth of its caseload during that period. More recently, increasing numbers of Chinese parties have also begun selecting Singapore as a neutral arbitral seat, particularly where counterparties prefer arbitration outside mainland China or Hong Kong.<\/p>\n<p style=\"font-weight: bold; font-size: 18pt;\">Judicial support under the UNCITRAL Model Law<\/p>\n<p style=\"margin-bottom: 3%;\">Responding to a question from a doctoral researcher from the China University of Political Science and Law regarding lessons for Chinese arbitral institutions, Lawrence emphasised the importance of judicial support for arbitration.<\/p>\n<p style=\"margin-bottom: 3%;\">Clarifying a commonly misunderstood point, he noted that Singapore had never become the sole highest-ranked arbitral seat but had shared the top position with London in the Queen Mary International Arbitration Survey.<\/p>\n<p style=\"margin-bottom: 3%;\">Turning to judicial intervention, he highlighted Article 5 of the UNCITRAL Model Law, which limits court intervention except where expressly authorised by the legislation.<\/p>\n<p style=\"margin-bottom: 3%;\">Singapore&#8217;s courts, he explained, have consistently adopted a restrained and arbitration-supportive approach, intervening only where necessary. This judicial philosophy has significantly contributed to user confidence in Singapore&#8217;s arbitration framework.<\/p>\n<p style=\"font-weight: bold; font-size: 18pt;\">Cultural understanding will define arbitration&#8217;s next phase<\/p>\n<p style=\"margin-bottom: 3%;\">During the discussion, Lawrence Teh repeatedly returned to what he regarded as one of arbitration&#8217;s emerging challenges, <span style=\"font-style: italic;\">culture<\/span>.<\/p>\n<p style=\"margin-bottom: 3%;\">While &#8220;cultural differences&#8221; is often used as a neutral expression, he suggested that the real issue is frequently one of cultural ignorance.<\/p>\n<p style=\"margin-bottom: 3%;\">International arbitration promises equality of treatment and a full opportunity for every party to present its case. However, if tribunals fail to appreciate the legal, commercial and cultural backgrounds from which parties come, genuine equality becomes difficult to achieve.<\/p>\n<p style=\"margin-bottom: 3%;\">As the world moves towards a multipolar geopolitical order, he argued, arbitration must become increasingly sensitive to cultural diversity if it is to maintain the confidence of international users.<\/p>\n<p style=\"margin-bottom: 3%; text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2026\/07\/image-56.png\" alt=\"\" width=\"600\" height=\"700\" class=\"aligncenter size-full wp-image-389308\" \/><\/p>\n<p style=\"font-weight: bold; font-size: 18pt;\">Central Asia will play an increasingly important role<\/p>\n<p style=\"margin-bottom: 3%;\">Concluding the discussion, Lawrence reflected on his first visit to Central Asia, describing the region as one of the world&#8217;s emerging crossroads.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">&#8220;As Asia&#8217;s economic influence grows, international arbitration will also change. Tribunals will increasingly be expected to understand different legal traditions, cultures and ways of doing business.&#8221;<\/span> &#8212; Lawrence Teh<\/p>\n<p style=\"margin-bottom: 3%;\">Echoing remarks made earlier during the conference concerning the transition towards a multipolar world, he observed that international trade and investment would continue notwithstanding changing geopolitical realities. With increasing economic activity would inevitably come commercial disputes requiring effective mechanisms for resolution.<\/p>\n<p style=\"margin-bottom: 3%;\">Although mediation and international commercial courts would continue to grow, Lawrence maintained that international arbitration would remain the preferred mechanism for resolving cross-border commercial disputes.<\/p>\n<p style=\"margin-bottom: 3%;\">At the same time, he predicted that arbitration itself would continue evolving. As Asia&#8217;s economic influence expands, tribunals will increasingly be expected to understand diverse legal traditions and commercial cultures, making cultural competence an essential component of effective dispute resolution.<\/p>\n<p style=\"margin-bottom: 3%;\">Closing the session, Aigoul remarked that arbitration is shaped not only by governments, legislation, international organisations and arbitral institutions, but equally by individual practitioners. As Asia continues contributing new ideas and perspectives to international dispute resolution, the region will play an increasingly influential role in shaping the future development of
