{"id":389046,"date":"2026-07-02T10:30:23","date_gmt":"2026-07-02T05:00:23","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=389046"},"modified":"2026-07-02T10:38:32","modified_gmt":"2026-07-02T05:08:32","slug":"del-hc-orders-removal-of-defamatory-posts-targeting-raghav-chadha","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/07\/02\/del-hc-orders-removal-of-defamatory-posts-targeting-raghav-chadha\/","title":{"rendered":"Public Figures Must Tolerate Political Satire, But Not Vulgar AI Deepfakes That Cross the Line Into Defamation; Delhi HC Partly Allows Raghav Chadha\u2019s Defamation Suit"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Delhi High Court:<\/span> An application was filed by plaintiff, Raghav Chadha, a Member of Parliament in the Rajya Sabha representing Punjab, under Order <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001523435\" target=\"_blank\">39 Rules 1<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001523437\" target=\"_blank\">2<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726944\" target=\"_blank\">Civil Procedure Code, 1908<\/a> (CPC) seeking protection against the circulation of artificial intelligence (AI)-generated deepfake videos, morphed images, synthetic media and other manipulated content allegedly created to tarnish his public image. While acknowledging the serious threat posed by AI-enabled misinformation and its potential to undermine an individual&#8217;s dignity and reputation, the Single Judge Bench of Subramonium Prasad, J., held that <span style=\"font-weight: bold;\">&#8220;public figures assuming such positions of power must accept being at the receiving end of the satirical humour as a necessary and inevitable aspect of their profession, though unpleasant&#8221;.<\/span> However, the Court clarified that AI-generated content that is profane, vulgar, malicious, or seriously impairs an individual&#8217;s dignity may justify judicial intervention. Accordingly, the Court on examination of documents placed on record, found Documents 2, 8, 9, 11, 25 and 40 to be explicit, profane and vulgar, thereby exceeding the limits of legitimate political satire and prima facie amounting to be defamatory and directed to remove them within 2 weeks.<\/p>\n<p style=\"margin-bottom: 3%; font-weight: bold;\">Also Read: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/06\/11\/del-hc-issues-summons-in-anjana-om-kashyap-defamation-suit\/\" target=\"_blank\">Anjana Om Kashyap &amp; TV Today Network Files Defamation Suit Against Khan Sir and Others; Delhi HC issues summons<\/a><\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">The plaintiff alleging that unidentified persons had created and circulated AI-generated deepfake videos, morphed images, and manipulated audio-visual content depicting him in a derogatory and defamatory manner. According to the plaintiff, these campaigns gained momentum after his political shift from the Aam Aadmi Party (AAP) to the Bharatiya Janata Party (BJP).<\/p>\n<p style=\"margin-bottom: 3%;\">The plaintiff contended that the impugned content misused his face, voice, mannerisms and public identity to spread misinformation and damage his political reputation. He sought wide-ranging reliefs including permanent injunction restraining the unauthorised misappropriation and exploitation of his personality rights, removal of the offending material from intermediary platforms, disclosure of the identities of the uploaders, and directions to government authorities to block future infringing content.<\/p>\n<p style=\"margin-bottom: 3%;\">However, during the hearing the plaintiff expressly stated that he would not press the claim relating to personality rights and would restrict his case to the issue of defamation.<\/p>\n<p style=\"margin-bottom: 3%; font-weight: bold;\">Also Read: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/04\/25\/no-bail-in-fir-against-pawan-khera-for-accusing-himanta-biswa-wife-by-showing-false-document-gauhati-hc\/\" target=\"_blank\">Not a Simpliciter Defamation Case: Gauhati HC Denies Anticipatory Bail to Congress Leader Pawan Khera in FIR Lodged by Assam CM&#8217;s Wife<\/a><\/p>\n<p style=\"font-weight: bold;\">Issue for Determination<\/p>\n<p style=\"margin-bottom: 3%;\">Whether the plaintiff had established a prima facie case warranting an interim injunction on the ground of defamation?<\/p>\n<p style=\"font-weight: bold;\">Legal Framework<\/p>\n<p>At the outset, the Court stated that <span style=\"font-style: italic;\">&#8220;injunction is a judicial process by which a party is required to do or refrain from doing a particular act. Injunction is a nature of preventive relief to a litigant to prevent future and possible injury&#8221;.<\/span> It reiterated that grant of temporary injunction is a discretionary and may be granted only when the applicant establishes:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>a prima facie case,<\/p>\n<\/li>\n<li>\n<p>the balance of convenience in his favour, and<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">irreparable injury incapable of being compensated by damages.<\/p>\n<\/li>\n<\/ol>\n<p style=\"margin-bottom: 3%;\">The Court relied upon the principle laid down in <span style=\"font-style: italic;\">Bonnard<\/span> v. <span style=\"font-style: italic;\">Perryman<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002371523\" target=\"_blank\">(1891) 2 Ch 269<\/a>, as applied by the Supreme Court in <span style=\"font-style: italic;\">Bloomberg Television Production Services India (P) Ltd.<\/span> v. <span style=\"font-style: italic;\">Zee Entertainment Enterprises Ltd.<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9002505402\" target=\"_blank\">2024 SCC OnLine SC 426<\/a>, holding that pre-trial injunctions in defamation matters should be granted only in exceptional circumstances because they directly affect the constitutional guarantee of freedom of speech and expression. Consequently, prayers relating to personality rights were not considered.<\/p>\n<p style=\"margin-bottom: 3%;\">Examining the law governing defamation of public figures, the Court referred <span style=\"font-style: italic;\">Bonnard<\/span> v. <span style=\"font-style: italic;\">Perryman<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002371523\" target=\"_blank\">(1891) 2 Ch 269<\/a>, wherein the House of Lords emphasised that courts should exercise extreme caution before restraining publication at an interlocutory stage. Unless the allegedly defamatory statement is shown to be palpably false and incapable of justification, prior restraint upon publication would ordinarily be inappropriate.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court also referred to <span style=\"font-style: italic;\">Kartar Singh<\/span> v. <span style=\"font-style: italic;\">State of Punjab<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9002854180\" target=\"_blank\">(1956) 1 SCC 692<\/a>; <span style=\"font-style: italic;\">R. Rajagopal<\/span> v. <span style=\"font-style: italic;\">State of T.N.<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0000019796\" target=\"_blank\">(1994) 6 SCC 632<\/a>; <span style=\"font-style: italic;\">Amish Devgan<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000721722\" target=\"_blank\">(2021) 1 SCC 1<\/a>; <span style=\"font-style: italic;\">Sardar Charanjit Singh<\/span> v. <span style=\"font-style: italic;\">Arun Purie<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002142725\" target=\"_blank\">1982 SCC OnLine Del 301<\/a> and <span style=\"font-style: italic;\">Naveen Jindal<\/span> v. <span style=\"font-style: italic;\">Zee Media Corpn. Ltd.<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002140541\" target=\"_blank\">2014 SCC OnLine Del 1369<\/a>, the Court noted the settled principle that <span style=\"font-style: italic;\">&#8220;those who fill a public position must not be too thin-skinned in reference to comments made upon them&#8221;<\/span> and <span style=\"font-style: italic;\">&#8220;those who hold office in government and are responsible for public administration, must always be open to criticism&#8221;.<\/span> Public officials necessarily expose themselves to public scrutiny and criticism, including sharp political commentary.<\/p>\n<p style=\"margin-bottom: 3%;\">Applying the above principles, the Court observed that the standard required to establish actionable defamation against a public figure is necessarily more demanding than in the case of an ordinary individual.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court expressed serious concern regarding the increasing use of AI for generating deepfake videos and manipulated content. It categorically observed that the Court does not <span style=\"font-style: italic;\">&#8220;endorses the use of AI to produce deepfake videos, morphed images, etc. when employed to harm the dignity of an individual&#8221;.<\/span> Such misuse has the potential to strike at the very root of the constitutional guarantee of dignity.<\/p>\n<p style=\"margin-bottom: 3%;\">At the same time, the Court acknowledged that AI has increasingly become a medium through which political opinions are expressed, and until comprehensive legislation regulates such content, courts must determine on a case-by-case basis whether the material crosses the threshold of violating an individual&#8217;s right to dignity.<\/p>\n<p style=\"margin-left: 36pt; margin-bottom: 3%; font-weight: bold;\">&#8220;&#8230;a fair balance is to be struck with an individual&#8217;s freedom of speech and expression which is also granted under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution of India<\/a>.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">On examining the documents, the Court found that the majority of the content merely consisted of political satire concerning the plaintiff&#8217;s political decisions regarding change in political party alliances, governance, policies, etc. Such criticism, though unpleasant, are a part and parcel of politics and could not automatically be characterised as defamatory.<\/p>\n<p style=\"margin-bottom: 3%;\">However, the Court found that Documents 2, 8, 9, 11, 25 and 40 contained language that was &#8220;profane and vulgar in nature&#8221; and outside the limits of harmless satirical humour.
