{"id":389021,"date":"2026-07-01T18:00:42","date_gmt":"2026-07-01T12:30:42","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=389021"},"modified":"2026-07-01T17:50:10","modified_gmt":"2026-07-01T12:20:10","slug":"delhi-hc-upholds-efi-indian-dressage-team-selection-asian-games-2026","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/07\/01\/delhi-hc-upholds-efi-indian-dressage-team-selection-asian-games-2026\/","title":{"rendered":"Delhi HC declines to interfere with Indian Dressage Team selection for 20th Asian Games; reiterates limited scope of judicial review in sports selections"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Delhi High Court:<\/span> In writ petitions challenging the selection of the Indian Dressage Team for the 20th Asian Games, a Single Judge Bench of <span style=\"font-weight: bold;\">Mini Pushkarna, J.<\/span>, declined to interfere with the selection list issued by the Ad hoc Committee of the Equestrian Federation of India (EFI), holding that the Selection Committee had evaluated the competing horse-rider combinations strictly in accordance with the prescribed Selection Criteria Version 4.0. Rejecting the petitioners&#8217; challenge to the methodology adopted for assessing Minimum Eligibility Requirements (MERs), comparative ranking, and the exclusion of a claimed qualifying score, the Court reiterated that judicial review in matters of sports selection is confined to examining the decision-making process and does not permit the writ court to substitute its own assessment for that of an expert body. Finding no arbitrariness, irrationality, procedural impropriety, or bias in the selection process, the Court dismissed both the writ petitions.<\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">The writ petitions arose from the selection of the Indian Dressage Team for the 20th Asian Games, scheduled to be held in Japan from 19 September 2026 to 4 October 2026. The petitioners challenged the selection list dated 16 June 2026 issued by the Ad hoc Committee of the EFI, under which 6 riders were selected for the Dressage discipline while the petitioners were placed as Reserve No. 1 and Reserve No. 2. They sought quashing of the selection list and directions for their inclusion in the final team, alleging that the selection process violated the prescribed Selection Criteria Version 4.0 governing the achievement and evaluation of MERs.<\/p>\n<p style=\"margin-bottom: 3%;\">The controversy centered on the interpretation and application of the selection criteria for Dressage. The framework required horse-rider combinations to qualify through recognised competitions, with ranking based on the best 2 valid MERs and the highest cumulative percentage scores. While one petitioner contended that EFI had incorrectly relied upon individual MER scores instead of first giving precedence to Team MERs, thereby preparing the merit list on an erroneous basis, the other petitioner asserted that his Prix St. Georges (PSG) score achieved at Hagen, Germany, held from 22 to 26 April 2026, ought to have been considered for calculating his MER instead of his PSG score from the Lier, Belgium event conducted from 20 to 24 May 2026. According to him, consideration of the Hagen score would have placed him among the top four riders eligible for selection to the Asian Games team. He also alleged bias in the selection process on the ground that a member of the Selection Committee, had a conflict of interest owing to pending litigation between him and the petitioner&#8217;s family. The petitions, therefore, questioned both the correctness of the evaluation of MERs and the fairness of the decision-making process adopted by EFI.<\/p>\n<p style=\"font-weight: bold;\">Analysis<\/p>\n<p style=\"margin-bottom: 3%;\">The Court held that the petitioners&#8217; challenge to the selection process was devoid of merit and found no infirmity in the methodology adopted by the EFI. Rejecting the contention of the petitioner in W.P.(C) No. 8290\/2026, the Court observed that the Selection Criteria permitted riders based abroad to combine scores from different competitions only where a qualifying event did not include all three prescribed tests. Since the Belgium event in which the petitioner participated comprised all 3 tests, he could not seek substitution of his Prix St. Georges (PSG) score from the Hagen, Germany event. The Court further held that the reliance placed on the cases of other selected riders was misplaced, as their scores had been combined strictly in accordance with Clause 8(<span style=\"font-style: italic;\">e<\/span>) of the amended Selection Criteria where certain tests were unavailable in a qualifying event.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court also rejected the challenge raised in W.P.(C) No. 8329\/2026 regarding the ranking methodology, holding that Clause 8(<span style=\"font-style: italic;\">f<\/span>) of the Selection Criteria unequivocally required riders to be ranked on the basis of the highest cumulative percentage score across their best 2 valid MERs, without drawing any distinction between Team MERs and Individual MERs for the purpose of calculating comparative merit. It noted that while riders who had achieved Individual MERs were rightly placed above those possessing only Team MERs, the comparative ranking thereafter was based on cumulative scores in accordance with the Selection Criteria. Finding the interpretation advanced by the petitioners contrary to the plain language of the Selection Criteria, the Court held that the EFI had correctly assessed the comparative merit of the competing horse-rider combinations.<\/p>\n<p style=\"margin-bottom: 3%;\">Reiterating the settled principles governing judicial review in matters of sports selection, the Court observed that interference under Article 226 was warranted only where the decision-making process was shown to be manifestly arbitrary, irrational, perverse or procedurally improper. Since the Selection Committee had objectively evaluated the MER achievements, trial results and comparative merit of all eligible riders, and the Ad hoc Executive Committee had independently considered and unanimously accepted its recommendations after due deliberation, the Court found that the entire selection process had been carried out strictly in accordance with the Selection Criteria. The absence of further competitive trials under Clause 15(<span style=\"font-style: italic;\">b<\/span>) did not vitiate the selection, particularly in view of the practical difficulties highlighted by EFI and the enabling provision contained in Clause 15(<span style=\"font-style: italic;\">e<\/span>). The Court also rejected the allegation of bias against a member of the Selection Committee, holding that the petitioner had participated throughout the selection process without seeking reconstitution of the Committee and was, therefore, precluded from raising the plea after the declaration of the final results.<\/p>\n<p style=\"font-weight: bold;\">Decision<\/p>\n<p style=\"margin-bottom: 3%;\">Holding that the selection process was neither arbitrary nor unreasonable and that it was impermissible for the writ court to substitute its own assessment for that of an expert body, the Court dismissed both the writ petitions.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;
