Jayasankaran Nambiar*<\/span> and Preeta A.K., JJ. held that a second marriage contracted after the dissolution of a marriage by a decree of divorce does not become void merely because an appeal against the decree is pending. The Court observed that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543737\" target=\"_blank\">15<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726956\" target=\"_blank\">Hindu Marriage Act, 1955<\/a> (HMA) only prohibits remarriage in specified circumstances and does not revive or treat the dissolved marriage as subsisting. Therefore, a subsequent marriage cannot be regarded as void or bigamous solely because an appeal against the divorce decree is pending.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court held that the husband&#8217;s challenge to the decree of divorce had become infructuous in view of the wife&#8217;s lawful remarriage and accordingly left the decree of divorce undisturbed. However, it set aside the Family Court&#8217;s award of &#8377;20 lakhs as permanent alimony and remanded the issue to the Family Court for fresh adjudication after affording both parties an opportunity to adduce evidence.<\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">The respondent-wife filed a petition before the Family Court seeking dissolution of marriage under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543733\" target=\"_blank\">13(1)(<span style=\"font-style: italic;\">i-a<\/span>) and (<span style=\"font-style: italic;\">i-b<\/span>)<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726956\" target=\"_blank\">HMA<\/a>, on the grounds of cruelty and desertion, along with permanent alimony under Section 25 of the Act. The parties were married according to Hindu rites on 6 September 2009<a id=\"fnref1\" href=\"#fn1\" title=\"1. Ed Note: The source judgment records the date of marriage as 6 September 2019, which is inconsistent with the factual narrative i.e. the wife is stated to have left the matrimonial home on 29 June 2011, and the criminal proceedings under Section 498-A IPC and the maintenance and divorce petitions appear to have been instituted around the same period. It is likely that the marriage year stated in the judgment contains a typographical error.\"><sup>1<\/sup><\/a>. The wife alleged that soon after the marriage, she was subjected to cruelty and persistent demands for dowry by the husband and his mother. She claimed that she was repeatedly humiliated and insulted for bringing insufficient dowry.<\/p>\n<p style=\"margin-bottom: 3%;\">The wife further stated that after becoming pregnant, she returned to her parental home for delivery and later gave birth to her daughter. After she resumed cohabitation with the husband at Chandrapur, the alleged harassment continued. According to her, her father paid &#8377;5 lakh and subsequently another &#8377;3 lakh to the husband in an attempt to meet the dowry demands. Despite receiving these amounts, the husband allegedly continued to ill-treat her. She eventually left the matrimonial home with her daughter on 29 June 2011 and began residing with her parents.<\/p>\n<p style=\"margin-bottom: 3%;\">The wife had earlier initiated criminal proceedings under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561850\" target=\"_blank\">498-A<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">Penal Code, 1860<\/a>, and had also instituted proceedings for maintenance and divorce before the Family Court, Ernakulam. By judgment dated 2 February 2024, the Family Court dissolved the marriage on the grounds of cruelty and desertion and directed the husband to pay &#8377;20 lakhs as permanent alimony within one month, failing which the amount would carry interest at 6 per cent per annum.<\/p>\n<p style=\"margin-bottom: 3%;\">Aggrieved by the judgment, the husband preferred the present appeal. Although the appeal was filed with a delay of 12 days, the delay was subsequently condoned. No interim order staying the operation of the divorce decree was granted during the pendency of the appeal. During this period, the wife contracted a second marriage on 14 September 2025.<\/p>\n<p style=\"font-weight: bold;\">Issues<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">1. Whether the wife&#8217;s remarriage during the pendency of the husband&#8217;s appeal rendered the second marriage void under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543737\" target=\"_blank\">15<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726956\" target=\"_blank\">Hindu Marriage Act<\/a>.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">2. Whether the husband&#8217;s appeal against the decree of divorce survived after the wife&#8217;s remarriage.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt; margin-bottom: 3%;\">3. Whether the award of &#8377;20 lakhs permanent alimony should be sustained.<\/p>\n<p style=\"font-weight: bold;\">Analysis and Decision<\/p>\n<p style=\"margin-bottom: 3%;\">The Court rejected the husband&#8217;s contention that the wife&#8217;s remarriage was void. It held that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543737\" target=\"_blank\">15<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726956\" target=\"_blank\">Hindu Marriage Act<\/a> merely postpones the right to remarry in cases where an appeal against a decree of divorce is filed within the prescribed period of limitation; it does not revive or continue the dissolved marriage. The Court observed that a temporary statutory prohibition on remarriage cannot be construed to mean that the earlier marriage continues to subsist.<\/p>\n<p style=\"margin-bottom: 3%;\">In reaching this conclusion, the Court relied on <span style=\"font-style: italic;\">Leela Gupta<\/span> v. <span style=\"font-style: italic;\">Laxmi Narain<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0000011095\" target=\"_blank\">(1978) 3 SCC 258<\/a>, and <span style=\"font-style: italic;\">Krishnaveni Rai<\/span> v. <span style=\"font-style: italic;\">Pankaj<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000712638\" target=\"_blank\">AIR 2020 SC 1156<\/a>, wherein the Supreme Court held that the incapacity to contract a second marriage during the statutory period does not have the effect of treating the former marriage as subsisting.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further noted that the husband&#8217;s appeal had been filed beyond the prescribed period of limitation and was entertained only after the delay was condoned. It was held that the prohibition under Section 15 of the Act attaches only to appeals filed within the limitation period; an appeal filed beyond limitation, even if later condoned, does not satisfy this requirement and therefore does not bar remarriage in the interim. . The Court also took note of the fact that no interim order staying the operation of the divorce decree or restraining the wife from remarrying had been passed during the pendency of the appeal. Consequently, the wife&#8217;s second marriage was held to be lawful.<\/p>\n<p style=\"margin-bottom: 3%;\">In view of the respondent&#8217;s lawful remarriage, the Court held that the husband&#8217;s challenge to the decree of divorce had become infructuous and dismissed the appeal to that extent.<\/p>\n<p style=\"margin-bottom: 3%;\">With regard to the award of permanent alimony, the Court observed that although the husband had failed to adduce any evidence before the Family Court, the respondent&#8217;s subsequent remarriage constituted a material change in circumstances. Since Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543752\" target=\"_blank\">25(3)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726956\" target=\"_blank\">Hindu Marriage Act<\/a> permits reconsideration of permanent alimony upon the remarriage of the recipient spouse, the Court held that the issue required fresh adjudication.<\/p>\n<p style=\"margin-bottom: 3%;\">Accordingly, the Court set aside the Family Court&#8217;s award of &#8377;20 lakhs as permanent alimony and remanded the matter to the Family Court for fresh consideration after affording both parties an opportunity to adduce evidence.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\"><span style=\"font-style: italic;\">X<\/span> v. <span style=\"font-style: italic;\">Y<\/span>, Mat.
